MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH

The City Council convened in regular session in the Council Chambers at
8: 04 p.m. with Councilmen Norgard, Wood, Simpson and Mayor WeinkaufpresEn
Councilwoman Pearson was absent.
INVOCATION AND PLEDGE OF ALLEGIANCE
The Reverend Dr. Elmer Schmitt led in the invocation and Councilman
Simpson led the Pledge of Allegiance.
PROCLAMATION - REALTOR WEEK
Mayor Weinkauf read a proclamation declaring the week of April 20th
to 26th as Realtor Week.
PAYROLL WARRANTS
On a motion by Councilman Norgard, seconded by Councilman Simpson
it was unanimously carried Payroll Warrants #1163 to #1351 inclusive
for the period of March 23 to April 5, 1975 inclusive in the total
amount of $77, 841. 97 be approved.
GENERAL WARRANTS
On a motion by Councilman Wood, seconded by Councilman Norgard
it was unanimously carried General Warrants #858 to #1036 inclusive
in the total amount of $268, 572. 27 be approved and ordered paid.
FLUORIDATION HEARING
City Manager reviewed a letter from the County Health Officer, Dr.
R. L. Holtzer dated February 4th urging the City to fluoridate its
water supply. Council considered subject matter at the meeting of
March 5, 1975, and approved purchase of equipment to fluoridate the
City' s water supply. Council action stimulated citizen interest
which led to the need for further input on subject matter. The
hearing scheduled at this time is for this purpose.
The City Manager reviewed correspondence received from 12 individuals,
including Ukiah Unified School District Health Advisory Council,
the Mendocino Lake County Medical Society, Oak Manor Elementary
School, and several doctors expressing the merits of fluoridation.
Opposition to fluoridation of the water system was expressed from
citizens who lived within and outside the city limits.
Public hearing was declared open at 8 :11 p.m.
The following persons present in the audience spoke in favor of the
addition of fluoride to the city' s water system:

1. There is no possibility of poisoning from fluoride in small
amounts. Some areas of the country have high concentration of
� fluoride already in the water naturally. Nature has more than ade-
quately proven that fluoride in the water is not harmful.
2. Fluoride not only controls cavities in children, but increases
bone density in adults.
3. No disease has ever been linked to fluoride in the water.
4. Ukiah, as a municipal corporation would not be required to have
an election on subject matter. In the case of a municipal water
district, it would be necessary to have an election since no single
body in said district makes the decisions.
5. Cost benefit: 67 million dollars is being paid to welfare recipients
for denistry - millions of dollars in taxes could be saved if all
areas of the state had fluoride in the water.

6. Prevention is the logical approach - fluoridation reduces
tooth decay.
7. March 17, 1975 issue of the Journal of the American Medical
Association contained an article wherein it states medical proof
favors f lurodation� that fluoride can be added safely at the
optimum level.

to the addition of fluoride to the city' s water system:

1. There is no good reason why government should force fluoridated
water on those who do not want it.
2. Fluoride can be administered individually
3. Government does not have a right to force fluoride on the
citizenry without a vote.
4. Harmf u 1 to the body.
5. Alternative ways to dispense without forcing on everyone.
6. Public agency has no right to be concerned over a private
health matter.
7. Fluoridation causes mottling of the teeth.
8. It would be well for doctors to campaign against sugar
instead of for fluoride - young children drink little water
and large amounts of soft drinks.
9. It has not been proven that the U. S. Public Health Service
has made an in depth study of fluoride before endorsing its use
in water.
10. Fluoride causes or worsens many internal diseases
11. Fluoride has corrosive effect on pipes.
12. Fluoride delays eruption of teeth.
13 . Subject matter is not a matter of public health.
14. Put the efforts on purifying the water supply.
Public hearing was closed at 9: 49 p.m.
Councilman Wood stated he has listened to the pros and cons and
is not overwhelmed by either. In his opinion subject matter is
a political issue rather than an economic or medical issue. He
stated after other Councilmen had expressed their thinking., he
may introduce a motion to amend the budget to purchase subject
equipment. Councilman Simpson stated he feels a responsibility
to do the best for people of the city after being informed. He
stated he tries to be consistent and referred to Council action
on the formaldehyde issue When concern and fear was expressed
by the citizens. In his opinion the same fear has been ex-
pressed with fluoride; people should be able to choose.
Councilman Norgard reported the City of Healdsburg has had fluo-
ride in the city water for 20 years. There have been no com-
plaints and no rust in the pipes. In his opinion, the benefits
are so great that if Councilman Wood makes the aforementioned
motion, he would second it. Mayor Weinkauf stated the benefits
outweigh the negative aspects.

On a motion by Councilman Wood, seconded by Councilman Norgard
the following roll call vote to amend the budget and authorize
the purchase of the necessary equipment to fluoridate the city's
water supply resulted in a tie vote.
AYES: Councilman Norgard and Mayor Weinkauf
NOES: Councilman Wood and Councilman Simpson.
The matter will be considered again when there is a full Council.

JAPANESE STUDENT INTRODUCED
Mr. Kruth, Director of Public Works, introduced Miss Kumiko Suzuki,
American Field Service Exchange Student from Japan. Mie Suzuki
is attending high school and living in the home of Dr. Fisher during
her stay in the United States. Miss Suzuki was accompanied by Mrs.
Annette Kruth who was attending the Council meeting for the first
time.
VARIANCE APPLICATION NO. 75-41
GEORGE F. WEEKS - 18 HIGHLAND DRIVE
Subject variance application is a request to reduce minimum side
yard from 5' to 4 ' to accommodate construction of partially en-
closed carport. City Manager reviewed Planning Commission findings
dated April 9, 1975, recommending approval of the application.
There was no one present in the audience to speak concerning subject
matter.
Council action is set forth in the following resolution.
RESOLUTION NO. 75-63 GRANTING
VARIANCE TO GEORGE F. WEEKS
On a motion by Councilman Simpson, seconded by Councilman Norgard
it was unanimously carried Resolution No. 75-63 be adopted and the
Mayor and Clerk be authorized to sign same, "Resolution Granting
Variance To George Weeks" .
INTRODUCTION OF ORDINANCE NO. 668
(UNIFORM BUILDING CODES) AND ORDINANCE
NO. 669 (ICBO UNIFORM FIRE CODE),
On a motion by Councilman Simpson, seconded by Councilman Norgard
it was unanimously carried to introduce Ordinance No. 668, "An
Ordinance Of The City Council Of The City Of Ukiah Repealing
And Amending Certain Chapters And SEctions Of Division 3 Of The
Ukiah City Code (Building Regulations) " and Ordinance No. 669 , "An
Ordinance Of The City Council Of The City Of Ukiah Repealing
Chapter 3 Of Division 6 Of The Ukiah City Code And Adding A New
Division 6 To The Ukiah City Code Adopting By Reference The 1973
Uniform Fire Code: Also Renumbering Chapter 4 of Division 6" .
APPROVAL OF REQUEST FROM CHAMBER OF
COMMERCE FOR FUNDS FOR DOWNTOWN STUDY
The Downtown Revitalization Committee of the Chamber of Commerce
requested funds in the amount of $200 to match equal amounts
already allocated by the Chamber of Commerce and Downtown Merchants
Association. Subject funds will be utilized for a study of the
needs of the downtown area by Architects, Max Kappeler and Bob
Axt. Mr. Lee Enemark, representing the Revitalization Committee
was present in the audience and spoke concerning the needs of
the downtown area for parking, traffic control, landscaping,
store front design and sign ordinances. The study is expected to
be completed in 1 1/2 months.
Mr. Ted Feibusch was present in the audience and voiced his
objection to the proposed expenditure. In his opinion each business-
man should finance his own improvements; not depend on taxpayers
money to do it for them.

On a motion by Councilman Wood, seconded by Councilman Simpson
it was unanimously carried to contract in an amount of $200
for a report and recommendation from the Revitalization Committee
of the Chamber of Commerce for a study of the needs of the
downtown area.
OFFER OF PROPERTY REFERRED TO PARKS & RECREATION COMMISSION

Correspondence from Dr. Bernarr Johnson inquired of the City' s
interest in a 10 acre parcel of land south of town for a
proposed park site at a price of $60, 000. Council expressed
concern with the potential high maintenance cost, current
budget status, possible cooperation of school district with
City for costs, and the need for input from the Parks and
Recreation Commission.
On a motion by Councilman Simpson seconded by Councilman Wood
it was unanimously carried to refer the proposal from Dr.
Johnson to the Parks and Recreation Commission along with the
concerns registered by the Council.
CLAIM FOR DAMAGES DENIED

On a motion by Councilman Simpson, seconded by Councilman Wood
it was unanimously carried to deny the claim in the amount of
$351. 78 filed by Alice Thornhill and refer same to the insurance
carrier.

On a motion by Councilman Norgard, seconded by Councilman Wood
it was unanimously carried to deny the claim in the amount of
$44. 00 filed by Mrs. Lillian Alberti and refer same to the insur-
ance carrier.
RESOLUTION NO. 75-64 AMENDING PAY
PLAN & CLASSIFICATION PLAN BY ADDING
POSITION OF DEPUTY POLICE CHIEF
On a motion by Councilman Norgard, seconded ''by Councilman Wood,
it was unanimously carried Resolution No. 75-64 be adopted and
the Mayor and Clerk be authorized to sign same, "A Resolution
Of The City Council Of The City Of Ukiah Amending The Pay Plan
Dated July 1, 1975, And The Classification Plan By Adding Position
Of Deputy Police Chief" .

City Manager reviewed bids received for subject equipment and
recommended bid be awarded to the low bidder.

On a motion by Councilman Norgard, seconded by Councilman Simpson
it was unanimously carried the bid for poles be awarded to
McCormick and Baxter in the amount of $3649. 20 and the bid for

$1040. 00.

APPROVAL OF CONTRACT FOR ENGINEERING
POST, BASHFORD AND ASSOCIATES, INC.
FORD STREET BRIDGE PROJECT
Subject project is an approved project from AB 325 Tax Funds.
The City has received approximately one third of the estimated
project costs for development of the plans and specifications,
and the balance of project costs have been requested from 325
funds now accumulating and for which the City is eligible.
Proposals from three local Engineering Consultants to provide
the required design and construction engineering services has
been requested. Analysis of the two proposals received has
been made. It was recommended the proposal from Post, Bashford
and Associates be accepted.
On a motion by Councilman Norgard, seconded by Councilman Simpson
it was unanimously carried to accept the proposal of Post, Bashford
and Associates as consulting engineers for design of the Ford
Street Bridge,as recommended by the Director of Public Works.
REDEVELOPMENT AGENCY IMPLEMENTATION
Council had been provided with resolutions that would provide
operating funds and establish a survey area for the Redevelopment
Agency. There is an urgency in completing the Redevelopment Plan
by the statutory date of August 19th so we will not lose a full
year of tax increment. Outside resources will be needed to meet
this deadline. It was recommended to retain three consultants
on the basis of charges based on time and materials with a
maximum expenditure limit established by Council.
Mr. Ted Feibusch was present in the audience and voiced his objections
to the establishment of the redevelopment agency. He referred to
the experience cities in the Bay Area have had where redevelopment
costs have gone millions of dollars beyond the original cost.&Feibusch
pleaded with the Council to forget the matter and let free enter-
prise take its course. Mr. Lee Enemark, Book Revue stated downtown
merchants main impetus came from what Mr. Feibusch has done by
restoring buildings in the downtown area - the redevelopment agency
will assist in this area as well as providing parking and enhancing
the general beauty of the area. The City Manager explained the
Agency is the Council; it is not replacing the Council. It was
also pointed out that the ordinance establishing a redevelopment
agency was introduced several months ago. At that time it was
determined that public hearings be scheduled to give merchants in
the area an opportunity to voice their objections, if any.
The public hearings were held, after which the ordinance was adopted.
The next order of business sets forth Council determination of
subject matter.
RESOLUTION NO. 75-65 AUTHORIZING LOAN
TO UKIAH REDEVELOPMENT AGENCY
On a motion by Councilman Simpson, seconded by Councilman Wood,
it was unanimously carried Resolution No. 75-65 be adopted and the
Mayor and Clerk be authorized to sign same, "Resolution Of The
City Council Of The City Of Ukiah Authorizing Loan To Ukiah
Redevelppment Agency."
RESOLUTION NO. 75-66 ESTABLISHING
REDEVELOPMENT SURVEY AREA
On a motion by Councilman Simpson, seconded by Councilman Wood,
It was unanimously carried Resolution No. 75-66 be adopted and the
Mayor and Clerk be authorized to sign same, "Resolution Of The
City Council Of The City Of Ukiah Establishing Redevelopment
Survey Area".

AUTHORIZATION TO RETAIN CONSULTANTS
FOR REDEVELOPMENT AGENCY
On a motion by Councilman Simpson, seconded by Councilman Wood
it was unanimously carried to authorize the City Manager to
schedule a meeting and have the necessary documents to enter
into an agreement with Genge Consultants, Ms. Donna Vaiano, and
Attorney Joseph E. Coomes with the understanding the work will i
commence April 17, 1975.
REQUEST & AUTHORIZATION TO CALL
FOR BIDS FOR TWO POLICE VEHICLES
On a motion by Councilman Norgard, seconded by Councilman Wood
it was unanimously carried the Clerk be authorized to call for
bids for two police vehicles, bids to be received prior to 2 : 00
p.m. May 13, 1975.
COUNCILMAN SIMPSON
Councilman Simpson reported favorable comments regarding the
looks of the city as a result of the sidewalk construction pro-
ject.
COUNCILMAN WOOD
Councilman Wood stated a possibility of a no quorum meeting the
second meeting in May due to a League meeting in Sacramento re-
sulting in the absence of some members of the Council.
GOLF PRO
Mr. Bill Clarke, a member of the ad hoc committee of the Mens
Golf Club was present in the audience to speak on the matter
of renewing the contract with the Golf Pro. Mr. Clarke re-
quested Council reconsider the matter by receiving input from
the Recreation and Parks Commission and allow a hearing so
the' f acts of the matter can be weighed again. Council discussion
of the matter continued in closed personnel session.
ADJOURNMENT
Mayor Weinkauf adjourned the meeting at 11 : 25 p.m. after which
the Council reconvened in Closed Personnel Session.
