HomeMy WebLinkAboutmin 1975-08-20 19 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH AUGUST 20, 1975 - PAGE 1 The City Council convened in regular session at 8 : 05 p.m. with Councilwoman Pearson, Councilmen Norgard, Wood, Simpson, and Mayor Weinkauf present. PLEDGE OF ALLEGIANCE mY Councilman Wood led in the Pledge of Allegiance. APPROVAL OF MINUTES On a motion by Councilwoman Pearson, seconded by Councilman Wood it was unanimously carried to approve the August 6, 1975, minutes as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Simpson, seconded by Councilwoman Pearson it was unanimously carried Payroll Warrants #2766 to #2970 inclusive for the period of July 13 , 1975 to July 26, 1975, inclusive in the total amount of $80, 551. 90 be approved. GENERAL WARRANTS On a motion by Councilman Norgard, seconded by Councilman Simpson it was unanimously carried General Warrants #1777 to #1939 inclusive in the total amount of $240, 408. 72 be approved and ordered paid. RESOLUTION NO. 76-14 APPROVING AGREEMENT FOR CETA VI FOR FISCAL 1976 On a motion by Councilman Norgard, seconded by Councilwoman Pearson �. it was unanimously carried Resolution No. 76-14 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Of The City Council Of The City Of Ukiah Authorizing The Mayor To Sign Agreement For Comprehensive Employment And Training Act Title VI Participation For Fiscal 1976. " PROPOSED RATE INCREASE TELEPROMPTER CABLE TV Council had been furnished with information to support justification for subject rate increase to $8 per month, effective September 1, 1975. Attorney Jim Larsen, Fort Bragg, represented Teleprompter. Mr. Larsen stated the ordinance under which the company is operating provides for a reasonable rate of return to the company with the provision of satisfactory service to the customer. In his opinion, said service has been rendered and one incident was cited to sub- stantiate this fact - the replacement of virtually dll the hardware to the entire system over the past 10 years. A reasonable rate of return has not occurred due to the increased cost of operation and the effect of the inflationary spiral. Mr. Jim Langton, Manager of the local company spoke to the subject explaining efforts his company has made to provide the best service possible to the customer. Mr. Tom Kirkpatrick, 1131 North Oak was present to speak in opposi- tion to the proposed increase. He stated, in his opinion, it is unreasonable to give the public 24 hours notice of a proposed in- crease, then increase the rates within a period of 10 days. He urged Council to slow down in its action, be objective and look at what the customers are getting for their money and compare rates charged in other cities. Mr. Krikpatrick stated there is a need for better service and he would like to know what percent of the increase will be spent on renovation of equipment and construction. Council indicated the proposed increase is minimal, recognized the effect of the inflationary spiral, recognized that this is a public rate schedule and therefore subject to public input, and also recognized the choice the customer has - to continue the Teleprompter service or choose the other service available for television reception. City Manager stated it would be proper to hold the matter over for two weeks to publicize the proposed in- crease and coordinate with the County. 20 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH AUGUST 20, 1975 - PAGE 2 On a motion by Councilman Simpson, seconded by Councilman Wood it was unanimously carried to hold a public hearing on the proposed television rate increase September 3, 1975, 8 : 00 p.m. PROTEST OF GERALD PICHE TO CANCELLATION OF HANGAR LEASE Subject protest is the result of the cancellation of Mr. Gerald Piche' s hangar lease due to his failure to live up to the terms of the lease. Subject account has been in arrears continuously with the exception of a single month since September 1973 . Mr. Piche, who was present in the audience to speak on subject matter, admitted the fact that his account was in arrears. He explained efforts he had made to obtain information regarding the status of his account and was finally successful in obtaining said information from the City Attorney. Mr. Piche ' s request to Council was that the lease not be forfeited with a payment of the lease in advance for a period of one year. The request had been made to the Airport Manager and the City Manager and denied by both, hence the appeal to the Council at this time. On a motion by Councilman Norgard, seconded by Councilwoman Pearson, it was unanimously carried that the lease cancellation decision by the Airport Manager and the City Manager regarding the Gerald Piche hangar lease be supported by the Council. PUBLIC HEARING DATE SET ZONE CHANGE APPLICATION NO. 76-3 On a motion by Councilman Simpson, seconded by Councilman Norgard it was unanimously carried to set September 3 , 1975, as the public hearing date for Zone Change Application No. 76-3) The Planning Director will be present at subject public hearing. CALL FOR BIDS FOR PAVING STREETS AND ANTON STADIUM PARKING LOT On a motion by Councilwoman Pearson, seconded by Councilman Norgard it was unanimously carried to authorize the Clerk to call for bids for asphalt concrete surfacings on city streets and Anton Parking Lot, bids to be received prior to 2: 00 p.m. September 11, 1975. AUTHORIZATION TO PURCHASE BACKHOE USED FOR THE CETA PROGRAM Subject equipment has been rented for the past six months for the CETA program. It will be needed for another ten months. 100% of the rent paid to date can be applied to the purchase price. Since an extra backhoe is rented during heavy work periods, it would seem economically feasible to purchase said equipment rather than continue with rental payments. On a motion by Councilman Norgard, seconded by Councilman Wood it was unanimously carried to authorize the purchase of the backhoe currently rented from Hogue Equipment Company in accordance with the proposal dated July 31, 1975, the total to be $12, 508 . 00 including tax. PLANNING COMMISSION APPOINTMENT On a motion by Councilman Norgard, seconded by Councilman Wood it was unanimously carried to postpone to September 3 , 1975, con- sideration of the Planning Commission vacancy. On a motion by Councilman Simpson, seconded by Councilwoman Pearson it was unanimously carried to express Council appreciation to Commissioner Robert Cannon for his years of service on the Planning Commission.
