HomeMy WebLinkAboutmin 1975-11-12 4 1 MINUTES OF THE JOINT MEETING OF THE CITY COUNCIL/REDEVELOPMENT AGENCY OF THE CITY OF UKIAH - NOVEMBER 12, 1975 - PAGE 1 The Joint Public Hearing to consider and act upon the Redevelopment Plan for the Ukiah Redevelopment Project and final Environmental Impact Report on the Redevelopment Plan was called to order by Mayor Weinkauf at 8 : 03 p.m in the Council Chambers after which the meeting adjourned to the Veterans Building, Seminary Lane to accommodate the number attending the hearing . The City Manager called the roll at 8: 25 p.m. with Councilmen Simpson, Wood, Norgard and Mayor Weinkauf present. Councilwoman Pearson was absent. Mayor Weinkauf made introductory statements concerning procedures. He stated the staff presentation would be made by City Manager James Swayne, Environmental Consultant Donna Vaiano, and Planning Consultant Ceil Kibner, and special redevelopment legal counsel to the City Attorney, Joseph E. Coomes, Jr. A transcript was made of the hearing. Persons making statements and giving testimony were sworn in a single oath by the Court Reporter. City Manager entered into the record the Affidavit of Publication and certification of notice of mailing, presented the Redevelopment Plan, the Environmental Impact Report and other evidence and testimony in support of the Plan, including the City Attorney' s written statement regarding conflicts, voting. The following Exhibits were presented and entered into the record: Exhibit #1 Proof of Publication - Notice of Joint Public Hearing on Redevelopment Plan and EIR for Ukiah Redevelopment Project. Exhibit #2 Affidavit of Mailing to property owners in the Ukiah Redevelopment Project Area. Exhibit #3 Affidavit of Mailing to taxing agencies Exhibit #4 Certification of certain official actions in connection with preparation of Redevelopment Plan for redevelopment project. Exhibit #5 Report to Ukiah City Council submitted on October 8, 1975 on the Redevelopment Plan for the redevelopment project. Exhibit #5a Planning Commission Finding of Conformance of Redevelopment with the Ukiah General Plan. Exhibit #13 Letter dated 11-12-75 from Wm. Nelmes Smith. The following persons were present in the audience to speak in favor of the Redevelopment Plan and Final EIR: 1. Dick Green 2. Nancy Biggins , PAC member MINUTES OF THE JOINT MEETING OF THE CITY COUNCIL/REDEVELOPMENT AGENCY OF THE CITY OF UKIAH - NOVEMBER 12, 1975 - PAGE2 Those who spoke in opposition to the Redevelopment Plan and Final Environmental Impact Report were: 1. Ted Feibusch, PAC member 2. Bob Sandelin, PAC member 3. Peter DeVries, Mendocino Community College 4. Wm. Nelmes Smith, resident within the Parking District 5. William Smith, Attorney for Codding Enterprises 6. Oscar Klee 7. Wallace Behm 8. Jim Weller 9. Walter Heady The testimony of those who spoke was recorded by Mr. Lee B. Poole, Court Reporter, 400 Konocti Avenue, Lakeport. A majority of those who spoke indicated their approval of the concept of redevelopment, but were opposed to the plan proposed at this time. The Project Area Committee, on ani8-7 vote, urged that no action be taken on the proposed plan. The Planning Commission requested that the plan not be approved in its present form. Objections were expressed to the proposed 35 year duration of the Agency, the boundaries of the project area, the effect of tax increment on other taxing agencies, the power of eminent domain, the definition of blighted area, the power the pian gives the Agency. The public hearing was closed at 12 :30 a.m. City Manager stated that in his opinion it would be in the best interest of all to rework the plan with the Planning Commission and the Project Area Committee and come back with a plan that more accurately meets the needs of the people. City Manager recommended that Council consider delaying adoption of the resolution on the final EIR and introduction of the ordinance adopting the redevelopment plan and refer the matter to the Planning Commission and PAC for more input based on the testi- mony received at this hearing . The concensus expressed by Councilmen Simpson, Wood and Mayor Weinkauf was to revise the plan to answer objections expressed at the hearing . There was a need expressed for a project priority list, projection of cost, impact on other agencies and more input from said agencies. Councilman Norgard stated he has had doubts about subject matter for sometime, is reluctant to continue, would like for the matter to settle down, start over and perhaps come up with a more palatable plan more acceptable and realistic to the people. Councilman Wood made a motion to continue the public hearing for a period of 60 days with a request to be forwarded to the Planning Commission and PAC to come up with a list of priority projects and a revised project area to support the recommended cost and boundaries. Mayor Weinkauf indicated his intention to step down as Mayor and second the motion. Before this was accomplished Mr. Feibusch stated it was impossible to come up with a cost estimate in 60 days. On a motion by Councilman Simpson, seconded by Councilman Wood, it was carried by the following roll call vote to take the proposed redevelopment plan under submission to the next regular meeting, direct staff to prepare recommendations regarding priority project list, fiscal impact on other agencies, specifics on financing and impact on other agencies, financial projections and forward same to the Project Area Committee and Planning Commission for review and study.
