HomeMy WebLinkAboutmin 1975-12-17 54 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 17, 1975 - PAGE 1 The City Council convened in regular session at 8 : 05 p.m. with Councilwoman Pearson, Councilmen Wood, Simpson and Mayor Weinkauf present. Councilman Norgard was absent. INVOCATION & PLEDGE OF ALLEGIANCE Councilman Simpson gave the invocation, and Councilman Wood led in the Pledge of Allegiance. APPROVAL OF MINUTES i On a motion by Councilwoman Pearson, seconded by Councilman Simpson it was unanimously carried the minutes of the meeting of December 3 , 1975, be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Simpson, seconded by Councilwoman Pearson it was unanimously carried Payroll Warrants #4466 to #4646 inclusive in the amount of $83, 005. 41 for the period of November 16, 1975, through November 29, 1975, be approved. GENERAL WARRANTS On a motion by Councilwoman Pearson, seconded by Councilman Simpson it was unanimously carried General Warrants #2548 to #2701 inclusive in the total amount of $379, 703 . 01 be approved and ordered paid. MAYOR WEINKAUF ADJOURNED THE COUNCIL MEETING TO A MEETING OF THE UKIAH REDEVELOPMENT AGENCY - 8 : 07 P.M. The City Council reconvened in regular session at 8 : 09 p.m. WRITTEN COMMUNICATION WOMEN' S GOLF CLUB Subject correspondence requested Council consider placing a restroom on the front nine of the golf course similar to the type on the back nine. On a motion by Councilman Simpson, seconded by Councilwoman Pearson it was carried by a majority voice vote to place a portable type restroom on the front nine of the golf course as requested by the Women' s Golf Club. ADOPTION OF ORDINANCE NO. 674 AMENDING CODE - ZONE CHANGE APPLICATION NO. 75-56 (HILLSIDE HOSPITAL) Subject ordinance was introduced at the last meeting and is in order for adoption at this time. Councilwoman Pearson made a motion for adoption of the ordinance whereupon various members of the audience indicated a desire to give further input in opposition to the proposed zone change and/or use permit which was granted at the previous meeting with specific stipulations. Those present who spoke in opposition were: Gene Lyne, presently living in Upper Lake but currently buying property in Redwood Valley. Barry Vogel, 280 North Oak Colette Morris, 1019 West Perkins Jim Weller, 710 West Clay Marsha Harrington, West Perkins Herbert Wells, 130 Marlene The opposition made the following allegations: 1. The EIR is inaccurate and misleading 2. The statement in the EIR concerning freeway access leads to an erroneous concept. 3 . Have not been forthright with the public . 4. The EIR reflects generalities, not specifics 5. Lack of projection of noise level and traffic flow in the future years. The hospital is operating on a break-even basis now - will the hospital be able to carry the indebtedness? 7. Proposed traffic flow faulty 8. FAA not consulted 9. No answer to ,the County employees letter 10. EIR devotes 4 lines to adverse effect the hospital will have. 11. EIR devotes 1 1/2 pages to alternatives 12. The cost estimate for an addition to the present site appears to be excessive. 13. With a debt to pay off the rates will be higher. 14. Zone change is in direct conflict with General Plan. 15. There will be industry around the hospital. Is this conducive to good planning? 16. Notice of determination as to adequacy of the EIR has yet to be filed. 17. If final decision is made without considering subsequent options, it leaves the City open to 6uit on the grounds of abusive discretion. 18. It is not the zone change that is inconsistent with the General Plan, it is the use permit. 19. The granting of the zone change is one more step on the road to chang- ing the entire area now devoted to prime agricultural land. This will cost the taxpayers millions of dollars. 20. Pro County Hospital - anti Hillside. Council was asked to consider the adverse effect this proposal will have on the City, to look at what Ukiah needs, and to consider the cost to the taxpayers. Mayor Weinkaur pointed out that the Council is to consider the zone of subject area; not to grant a use permit to build. The City Attorney stated two public hearings have been held on the matter and that the Council has no responsibility to change its decision unless it so chooses. Findings of fact regarding the use permit were requested. The City Attorney pointed out that the minutes of the last Council meeting reflect the findings of fact. Council maintained the position taken at the public hearing on subject matter on December 3 , 1975 . On a motion by Councilwoman Pearson, seconded by Councilman Simpson it was carried by the following roll call vote Ordinance No. 674 be adopted and the Mayor and Clerk be authorized to sign same, "An Ordinance of the City Council Of The City Of Ukiah Amending Chapter 2, Division 9 Of The Ukiz City Code By Rezoning Property From Existing C-M and R-1 to C-2 (Zone Change Application No. 75-56, Hillside Community Hospital) " . AYES: Councilwoman Pearson, Councilman Simpson, Mayor Weinkauf . NOES: Councilman Wood ABSENT: Councilman Norgard RESOLUTION NO. 76-34 DECLARING PROPERTY PUBLIC NUISANCE & STATING INTENT TO ABATE FIRE DAMAGED DWELLING (241 ARLINGTON DR. ) On a motion by Councilman Wood, seconded by Councilman Simpson it was carried by the following roll call vote Resolution No. 76-34 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Of The City Council Declaring Property A Public Nuisance And Stating Intention To Abate Same" . AYES: Councilwoman Pearson, Councilmen Wood, Simpson, Mayor Weinkauf . NOES: None ABSENT: Councilman Norgard RESOLUTION NO. 76-35 AMENDING PAY PLAN On a motion by Councilman Wood, seconded by Councilman Simpson, it was unanimously carried Resolution No. 76-35 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Of The City Council Of The City of Ukiah Amending Pay Plan" . Councilwoman Pearson suggested that a projection of retirement costs be made for the future so the City can attempt to keep from happening what has already happened to some cities in California and Oregon. v MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 17, 1975 - PAGE 3 RESOLUTION NO. 76-36 AUTHORIZING FILING APPLICATION FOR FEDERAL & STATE GRANTS FOR WASTEWATER TREATMENT WORKS On a motion by Councilman Simpson, seconded by Councilwoman Pearson it was unanimously carried Resolution No. 76-36 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Of The City Council Of The City Of Ukiah Authorizing Filing Application For Federal And State Grants For Publicly Owned Wasterwater Treatment .Works And Providing Certain Assurances" . CLAIM FOR DAMAGES DENIED (ERNEST ROBINETT) City Attorney reported subject claim was generated by arrest and claimant has filed a false arrest claim. It was recommended the claim be denied. On a motion by Councilman Wood, seconded by Councilman Simpson it was unanimously carried to deny the claim filed by Ernest Robinett and refer it to the insurance carrier. APPROVAL OF LEASE AGREEMENT & AIRPORT PERMIT (MARIN AVIATION) On a motion by Councilwoman Pearson, seconded by Councilman Simpson it was unanimously carried to approve the Lease Agreement and Airport Permit with Marin Aviation and authorize the Mayor and Clerk to sign same. AWARD OF BID FOR POWER POLES TO J. H. BAXTER COMPANY City Manager reviewed the following tabulation of bids received for 40 wood power poles: ,.. .A. -N4 }. H. Baxter Company in the total amount of $3 , 250. 76. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 17, 1975 - PAGE 4 COUNCILMAN WOOD Councilman Wood reported he would be out of the state and will therefore not be present at the January Council meetings. COUNCILMAN SIMPSON Councilman Simpson extended holiday greetings to all. MAYOR WEINKAUF Mayor Weinkauf stated he noted in the current Legislative Bulletion that revisions have been made to the Brown Act pertaining to commission appointments. The City Attorney reported he is in the process of drafting a memo to the Council on subject matter for distribution to the Council in January. WALLACE BEHM Mr. Wallace Behm asked the manner in which employee' s overtime is designated and the justification for same. City Manager stated this is set forth in the budget and also in monthly reports which the Council receives. COUNCILWOMAN PEARSON Councilwoman Pearson expressed her appreciation for the installation of the effective public address system.
