HomeMy WebLinkAboutmin 1976-03-17 83 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MARCH 17, 1976 - PAGE 1 The City Council convened in regular session at 8 : 01 p.m. with Councilmen Feibusch, Brannon, Councilwoman Pearson, and Vice Mayor Simpson present. Mayor Wood was absent. INVOCATION & PLEDGE OF ALLEGIANCE Councilman Brannon gave the invocation and Councilman Feibusch led in the Pledge of Allegiance. PAYROLL WARRANTS On a motion by Councilwoman Pearson, seconded by Councilman Brannon it was unanimously carried Payroll Warrants #5715 to #5897 inclusive in the amount of $79, 352. 16 for the period of February 22, 1976 to March 6, 1976 inclusive be approved. GENERAL WARRANTS On a motion by Councilwoman Pearson, seconded by Councilman Brannon it was unanimously carried General Warrants #3150 to #3304 inclusive in the total amount of $224, 292. 92 be approved and ordered paid. Councilman Feibusch abstained from voting. In his opinion , approval of subject warrants was not in compliance with Section 1620 of the Ukiah Municipal Code. The need for supporting documents with the general warrant register was stressed. Council disucssicli followed. On a motion by Councilwoman Pearson, seconded by Councilman Brannon it was unanimously carried the detailed General Warrant Register be included with the agenda material for the April 7th and April 21, 1976, Council meetings. WRITTEN COMMUNICATION-CITY OF ALAMEDA OPPOSING REQUIREMENT FOR PREPARATION OF FORM EU-07 (ENERGY CONSUMPTION PATTERNS) Subject communication requested Council to join in subject opposition. The requirement for the preparation of Form EU-07 comes from the Energy Resources Conservation and Development Commission, Sacramento. Compilation of information from the forms submitted should give energy consumption patterns which hopefully will determine the need for additional energy and/or energy conservation in the State of California. Council determined this requirement was a time consuming procedure that is unnecessary and could be of . little real value. On a motion by Councilwoman Pearson, seconded by Councilman Brannon it was unanimously carried to send a letter of protest to the Energy Resources Conservation and Development Commission opposing the requirement for the preparation of Form EU-07 . WRITTEN COMMUNICATION-JEANNE LEWIS Subject communication contained remarks made at the last Council meeting at which time Council action was requested concerning location of the Community College, and follow up meeting at the college. Council acknowledged receipt and placed it on file. PROPOSED LEASE OF CITY JAIL FOR COUNTY PRISONERS Coupty Administrator has requested use of the city jail for County. prisoners. The amount proposed to be paid to the City is $70, 000/year. City Manager asked for Council direction on subject proposal. Parking facilities for county employees was considered to be an important part of the agreement to work out with the County. 84 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MARCH 17, 1976 - PAGE 2 On a motion by Councilwoman Pearson, seconded by Councilman Feibusch it was unanimously carried to approve the concept of leasing the City Jail facility to Mendocino County at an annual cost of approximately $70, 000 per year. The proposal will be brought back to the Council for final consideration. MENDOCINO COUNTY YOUTH PROJECT Mr. Dave Patton, Director of the Mendocino County Youth Project was present in the audience to speak to a request for Council to participate in the formation of the Mendocino County Youth Service Bureau through a cooperative arrangement with the Board of Supervisors . The purpose of the Bureau is to divert children and youth from the juvenile justice system. This is accomplished through case work system to discover the problem then provide the service when the problem is derermined. The proposal for city participation is "in kind" contribution by assigning a recreation director and police officer to the bureau in a contractual way. Mr. Patton indicated there is no guarantee of a return dollar for dollar, but every service that is being given now would continue without interruption. Council directed questions concerning total cost of the program, total funds required, how much of the service provided comes back down to the city, etc. Councilman Brannon stated, in his opinion, there appears to be no general plan or related costs for the proposal. On a motion by Councilwoman Pearson, seconded by Councilman Feibusch it was carried by a majority voice vote to endorse the concept of the establishment of a county wide youth service bureau and assign the major portion of the time of one police officer and one recreation super- intendent to assist in the program, subject to approval and submission of the grant request by the Board of Supervisors, the awarding of funds, and Council approval of the specific contract document between the City and the youth service bureau. WRITTEN COMMUNICATION-MEN' S GOLF CLUB On a motion by Councilwoman Pearson, seconded by Councilman Brannon it was unanimously carried to approve the written request from the Men' s Golf Zlub to provide a free round of golf to out of county participants in the tournament to be held on May 29th and 30, 1976 . INTRODUCTION OF ORDINANCE NO. 679 AMENDING & REPEALING SECS. 9051 & 9052 (HOTELS, MOTELS, MORTUARIES) On a motion by Councilman Feibusch, seconded by Councilman Brannon, it was unanimously carried to introduce Ordinance No. 679, "Ordinance Of The City Council Of The City Of Ukiah Amending And Repealing Portions Of Sections 9051 and 9052 of The Ukiah City Code" . INTRODUCTION OF ORDINANCE NO. 680 REZONING PROPERTY FROM R-2 TO R-3 (ZONE CHANGE APPLICATION NO. 76-30) On a motion by Councilwoman Pearson, seconded by Councilman Feibusch it was unanimously carried to introduce Ordinance No. 680, "An Ordinance Of The City Council Of The City Of Ukiah Amending Chapter 2, Division 9 Of The Ukiah City Code By Rezoning Property From R-2 Zone To R-3 Zone (Zone Change Application No. 76-30; Planning Commission Initiated) " . RESOLUTION NO. 76-44 DIRECTING UNPAID WEED ABATEMENT COST PLACED ON TAX ROLL On a motion by Councilman Brannon, seconded by Councilwoman Pearson it was unanimously carried to adopt Resolution No. 76-44 and the Mayor and Clerk be authorized to sign same, "Resolution Of The City Council Of The City Of Ukiah Directing Unpaid Weed Abatement Cost Placed On Tax Roll" . 85 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MARCH 17, 1976 - PAGE 3 RESOLUTION NO. 76-45 ESTABLISHING PROCEDURES FOR CONDUCTING COUNCIL MEETINGS Council had two points for clarification in subject resolution - who will be responsible for delivery of notice of special Council meetings and a requirement for roll call vote on both ordinances and resolutions. These corrections will be made in the final draft. On a motion by Councilwoman Pearson, seconded by Councilman Brannon it was unanimously carried Resolution No. 76-45 be adopted and the Mayor and Clerk be authorized to sign same, "A Resolution Of The City Council Of The City Of Ukiah Establishing Procedures For The Conduct Of City Council Meetings" . CLAIM FOR DAMAGES DENIED ROBERT MACDOUGALL, III; GREGORY J. SANCHEZ & DAVID C. MINSINGER; ARTHUR PIVER On a motion by Councilwoman Pearson, seconded by Councilman Brannon it was unanimously carried to deny subject claims and refer same to the insurance carrier. The City Attorney reported the number of claims being received indicate the possibility of a need for self insurance. We have asked for a rate structure for self insurance and will evaluate the savings from the standpoint of our insurance premiums. PUBLIC HEARING DATE SET SOCIAL ELEMENT TO GENERAL PLAN On a motion by Councilwoman Pearson, seconded by Councilman Brannon it was unanimously carried to set the public hearing date for April 7, 1976, to consider adoption of the social element to the general plan. PUBLIC HEARING DATE SET FOR PLANNING COMMISSION INITIATED REZONING ON LESLIE On a motion by Councilwoman Pearson, seconded by Councilman Feibusch it was unanimously carried to set the public hearing date for April 7, 1976, to consider Planning Commission initiated rezoning from R-2 and R-3 to C-1 for parcels on east side of Leslie Street between 310 feet and 762 feet south of Peach Street. PEARSON AND FEIBUSCH APPOINTED TO FIRE DISTRICT ADHOC COMMITTEE On a motion by Councilman Feibusch, seconded by Councilman Brannon it was unanimously carried Councilwoman Pearson be appointed to serve on the Fire District Adhoc Committee, Councilman Feibusch to serve as Alternate on said committee. INITIATION OF ANNEXATION PROCEEDINGS ON MUNSON SUBDIVISION & ADJACENT TERRITORY PROPOSED Planning Commission had considered subject matter and recommended Council consider initiation of subject proceedings. Councilman Feibusch asked if any inquiries had been received from residents within subject area indicating a willingness to be a part of the city. Mr. Ray Jennings, 9 Betty was present in the audience, asked who would vote on the matter and stated he is not interested in the annexation. Councilman Feibusch also indicated a need to prepare a financial impact study of the proposal prior to any further action. On a motion by Councilman Feibusch, seconded by Councilman Brannon it was unanimously carried to defer action on the proposed Munson Subdivision annexation until a financial impact on the city and the Fire Protection District is completed. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MARCH 17, 1976 - PAGE 4 ANNUAL TRANSPORTATION CLAIM FOR ASSEMBLY BILL 325 FUNDS City Manager reported $253, 322 available funds for subject claim. Use of these funds in order of priority are: 1. City Dial-a-ride Bus $30, 000 2. Ford Street Bridge Construction $140, 000 3. Bush Street Right of Way $50, 000 4. Main Street Right of Way $33 , 322 The recommendation would move Bua.h Street right of way up in order of priority from those previously established. This is suggested because development in the area appears imminent plus the fact that right of way should be acquired before development occurs. On a motion by Councilwoman Pearson, seconded by Councilman Feibusch it was unanimously carried to submit a claim for 325 funds to Mendocino Transportation Agency for the four projects listed above as recommended by the City Manager. DAMAGE TO DISPOSAL SITE "CAT" City Manager reported that due to negligent burning, the caterpillar at the Disposal Site caught on fire and was damaged to the extent of a $30, 000 repair bill. The City Attorney will be determining the legal ramifications of this violation. COUNCILMAN FEIBUSCH Councilman Feibusch explained the efforts that have been made since July 1975 to establish a hemodialysis unit in Ukiah. There are six to eight kidney patients in our health service area who could use this unit. This could save these patients-;having to go to Santa Rosa or San Francisco three times a week for the 8 hour treatment. Council support of this proposal was urged. On a motion by Councilman Feibusch, seconded by Councilman Brannon it was unanimously carried to instruct the City Manager to write a letter of support for the establishment of a hemodialysis unit in Ukiah, said letter to be mailed to NORCOA Health Agency. Councilman Feibusch read Section 1050 of the Municipal Code wherein it refers to the establishment of an Industrial Development Commission. In his opinion there is a need for such a commission. One of its functions could be consideration for development of some of the City' s vacant properties. On a motion by Councilman Feibusch, seconded by Councilman Brannon it was unanimously carried to establish an Industrial Development C6mmission. Councilman Feibusch referred to action taken by the previous Council at the last regular meeting on rezoning of property bounded by Hope, Barnes, Perkins and Church. He read two legal notices filed by the Planning Department which were contrary to action taken by the Council, indicating they favored an R-2 zone. - The City Attorney stated the notice which advertised the area for an R-3 zone change was not fatal to the Planning Commission consideration as a more restrictive zone can be considered under subject notification. Council expressed a need for more precise language. It was also pointed out that the Council should look forward to enhancing the city and not in more density. 87 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MARCH 17, 1976 - PAGE 5 COUNCILWOMAN PEARSON Councilwoman Pearson referred to the bus stop at Leslie and Gobbi and asked if it could be set back inasmush as it obstructs the view at that point. On a motion by Councilwoman Pearson, seconded by Councilman Feibusch it was unanimously carried to direct the City Attorney to prepare a resolution requiring Council authorization of the person who will make out of state trips for city business . VICE MAYOR SIMPSON Vice Mayor Simpson asked if there had been any complaints on the Teen Center in the last few months. No complaints have been registered.
