HomeMy WebLinkAboutmin 1976-06-02 118 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JUNE 21 1976 - PAGE 1 The City Council convened in regular session at 8 : 00 p.m. with Councilmen Feibusch, Brannon, Councilwoman Pearson, and Mayor Wood present. Councilman Simpson was absent. INVOCATION AND PLEDGE OF ALLEGIANCE Councilman Brannon gave the invocation and Councilman Feibusch led in the Pledge of Allegiance. PAYROLL WARRANTS Councilwoman Pearson made a motion, seconded by Councilman Brannon to approve Payroll Warrants #6529 to #6669 inclusive in the amount of $76, 813 . 09 for the period of May 2, 1976 to May 15, 1976 , in- clusive. Councilman Feibusch questioned the large amount of overtime one employee in the Electrical Division of the Department of Public Works had received. Public Works Director explained that this was the employee' s pay for standby duty and overtime work necessary to get Orchard Street project ready for bid. Councilman Feibusch stated it would be interesting to see the amount of overtime paid for standby and the amount paid for the Orchard Street project. City Manager will make this information available to Councilman Feibusch. Payroll"Warrants were approved by the following roll call vote : AYES: Councilmen Feibusch, Brannon, Councilwoman Pearson, Mayor Wood NOES : None ABSENT: Councilman Simpson. GENERAL WARRANTS Councilwoman Pearson made a motion, seconded by Councilman Feibusch to approve General Warrants #3684 to #3746 inclusive in the total amount of $42, 836. 59. Councilman Feibusch referred to the payment made to the American Bar Association for membership fee for the City Attorney. Council- man Feibusch stated he checked with the District Attorney' s office and determined that none of the attorneys in that department are reimbursed for membership dues. In his opinion the City Attorney could afford to pay his membership dues to the Bar Association. Mayor Wood stated this is provided for in the budget and the matter could be discussed during budget discussions. Councilman. Feibusch ref erred to the- Planning Director' s letter of .resignation and a traoul bxpense form submitted subsequent to that time for a meeting he attended. Councilman Feibusch stated he failed to see, what good the City could derive from this. City Manager explained the information brought back was of benefit to the City - not to just the person who attended the meeting. General Warrants were approved by the following roll call vote: AYES: Councilmen Feibusch, Brannon, Councilwoman Pearson, Mayor Wood NOES : None ABSENT: Councilman Simpson APPROVAL OF MINUTES Councilwoman Pearson made a motion, seconded by Mayor Wood to approve the minutes of the meeting of May 5, 1976 . Councilman Feibusch stated that four weeks is a long time to remember what happened at a Council meeting. He pointed out that on Ordinance Nos. 683, 684, and 685 it appears that the Council introduced these ordinances , and approved each one by a roll call vote before the public hearing was held. The Clerk was directed to make the correction by moving the vote down to the conclusion of each of the public hearings. The motion was unanimously carried to approve the minutes of May 5, 1976 as corrected. Councilman Brannon noted that he was not present at subject meeting. 119 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JUNE 2, 1976 - PAGE 2 PUBLIC HEARING-ABATEMENT OF WEEDS, RUBBISH, REFUSE & DIRT ON PARCELS Council had staff report on parcels brought into compliance. Mayor Wood stated if there were no objections expressed, the resolution and accompanying list of parcels could be adopted as submitted. Mayor Wood declared the public hearing open at 8 : 16 p.m. There was no one present in the audience who spoke on subject matter. The public hearing was declared closed at 8 :16 p.m. Council action is set forth in the next order of business . RESOLUTION NO. 76-58 DIRECTING ABATEMENT OF WEEDS, RUBBISH, RUFUSE AND DIRT ON CERTAIN PARCELS OF LAND IN THE CITY On a motion by Councilwoman Pearson, seconded by Councilman Brannon it was carried by the following roll call vote to adopt Resolution No. 76-58 , "A Resolution Of The City Council Of The City Of Ukiah Directing The Abatement Of Weeds , Rubbish, Refuse And Dirt On Certain Parcels Of Land In The City Of Ukiah" . AYES : Councilmen Feibush, Brannon, Councilwom Pearson, Mayor Wood NOES : None ABSENT: Councilman Simpson PUBLIC HEARING CONTINUED - ZONE CHANGE NO. 76-46 City Manager reported Jack Cox has requested that subject matter be held over for later consideration. Mayor Wood stated he would open the public hearing in the event someone in the audience wanted to be heard on the matter. Public hearing was declared open at 8 : 19 p.m. There was no one present in the audience to speak in opposition or in favor of the application Public hearing was declared closed at 8 : 20 p.m. On a motion by Councilman Brannon, seconded by Councilman Feibusch it was unanimously carried to continue the public hearing on Zone Change No. 76-46 to July 21, 1976 . PUBLIC HEARING CONTINUED - ZONE CHANGE NO. 76-56 City Manager reported he received a request from a realtor and the attorney for the owner of the property in question to continue the public hearing to a subsequent meeting. Mayor Wood stated he would open the public hearing in the event someone in the audience wanted to be heard on the matter. Public hearing was declared open at 8 : 21 p.m. There was no one present in the audience to speak in opposition or in favor of the application. Public hearing was declared closed at 8 : 22 p.m. On a motion by Councilman Brannon, seconded by Councilman Feibusch it was unanimously carried to continue the public hearing on Zone Change No. 76-56 to July 21, 1976 . PUBLIC HEARING CONTINUED - PREZONE__NO. 75--50 Applicant for subject application is the same as for the zone change just considered by the Council. Request to continue the public hearing is identical. Public hearing was declared open at 8 : 28. p.m. There was no one present in the audience to speak in opposition or in favor of the application. Public hearing was declared closed at 8 : 24 p.m. 1.)o MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JUNE 2, 1976 - PAGE 3 On a motion_ by Councilman Brannon, seconded by Councilwoman Pearson it was unanimously carried to continue the public hearing for Prezone Application No. 75-50 to July 21st, 1976 . REPORT FROM TRAFFIC COMMITTEE ENCROACHMENT PERMIT FOR BOOK REVUE Mr. Lee Enemark requested, through the Traffic Committee, that a bench be placed in front of his store. It had been determined that the sidewalk area had sufficient width to allow such an encroachment without posing a significant hazard to the public . The Traffic Committee recommended that the encroachment permit be granted by minute action of the Council. Councilman Brannon made a motion, seconded by Councilwoman Pearson to approve the encroachment permit to place a bench in front of the Book Revue, School Street. Councilman Feibusch stated he was pleased with the project, but in his opinion the limit of insurance should be specified in the permit. City Attorney stated the matter was handled in this way inasmuch as the sidewalk is a public right of way. Through the issuance of a permit, the City is transferring this to the permittee. The City Attorney stated he was not adverse to specifying the amount. He could ask Mr. Enemark to disclose the limit of his premium. Mayor Wood asked if this made any difference. IN his opinion, the benches should be provided at city expense and if someone is willing to con- struct and maintain them at no expense to the city, then all the city has to do is make a policy decision. Councilman Brannon stated the City should not take full responsibility. City Attorney pointed out the bench remains the property of the store owner and remains under his control. Councilman Brannon modified his motion that the insurance be in a realistic amount acceptable to the City Manager. Motion carried unanimously. WRITTEN COMMUNICATION FROM HIGH SCHOOL CIVICS CLASS City Manager reported Mr. Pack's High School Civics Class expressed a desire to do something constructive to beautify the City and took on the project of placing trash cans at the bus stops in the City. City Manager met with representatives of the class and pointed out the weight of the container is a consideration as far as the garbage company is concerned. Other problems were discussed and it was requested that the students go back to their class to discuss subject matter further. There was no one present in the audience to speak on subject matter. Councilman Feibusch requested that the matter be held over until 9 : 30 p.m. WRITTEN COMMUNICATION RE TRANSPORTATION PLANNING AGENCY REPORT FOR 1976 Mayor Wood accepted the report and placed it on file. RESOLUTION NO. 76-59 APPROVING APPLICATION FOR TITLE II FUNDS CETA The City Manager explained the City has 16/positions at the present time to continue to October 1, 1976. Between now and then Council will meet and make recommendations to go to the Board of Supervisors . A security of the 16 positions is anticipated. On a motion by Councilwoman Pearson, seconded by Councilman Feibusch it was carried by the following roll call vote to approve Re-solution No. 76-59, "Resolution Of The City Council Of The City Of Ukiah Approving Application For Title II CETA Funds" . AYES : Councilmen Feibusch, Brannon, Councilwoman Pearson, Mayor Wood NOES: None ABSENT: Councilman Simpson MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JUNE 21 1976 - PAGE 4 RESOLUTION NO. 76-60 APPOINTING MEMBER TO REDWOOD EMPIRE WORKER'S COMPENSATION FUND On a motion by Councilwoman Pearson, seconded by Councilman Feibusch it was carried by the following roll call vote to adopt Resolution No. 76-60 "Resolution Of The City Council Of The City Of Ukiah Appointing Member To The Redwood Empire Worker ' s Compensation Fund" . (Ira Brannon) AYES: Councilmen Feibusch, Brannon, Councilwoman Pearson, Mayor Wood NOES : None ABSENT: Councilman Simpson RESOLUTION NO. 76-61 AUTHORIZING AGREEMENT FOR FRANK CARPENTER FOR BUILDING INSPECTION SERVICES On a motion by Councilman Feibusch, seconded by Councilwoman Pearson it was carried by the following roll call vote to adopt Resolution No. 76-61, "Resolution Of The City Council Of The City Of Ukiah Authorizing Execution Of Agreement For Frank Carpenter For Building Inspection Services" . AYES: Councilmen Feibusch, Brannon, Councilwoman Pearson, Mayor Wood NOES : None ABSENT: Councilman Simpson RESOLUTION NO. 76-62 AUTHORIZING ADDENDUM NO. 3 TO AGREEMENT WITH COUNTY FOR COST SHARING AT SANITARY LANDFILL SITE On a motion by Councilwoman Pearson, seconded by Councilman Feibusch it was carried by the following roll call vote to adopt Resolution No. 76-62, "Resolution Of The City Council Of The City Of Ukiah Authorizing Execution Of Addendum No. 3 To That Certain Agreement Dated July 19, 1972 With The County Of Mendocino Providing For Cost Sharing At The Ukiah Sanitary Landfill Site" . AYES: Councilmen Feibusch, Brannon, Councilwoman Pearson, Mayor Wood NOES : None ABSENT: Councilman Simpson RESOLUTION NO. 76-63 AUTHORIZING EXECUTION OF LEASE WITH UKIAH FIREFIGHTERS ASSOCIATION City Attorney reported the Firefighters have negotiated with the Trap Club for the building which remains on the old sewage treatment plant site. The Firefighters Association would like to lease subject property for drill practice and for a meeting place. Councilwoman Pearson made a motion, seconded by Councilman Brannon to adopt Resolution No. 76-63 , "Resolution Of The City Council Of The City Of Ukiah Authorizing Execution Of Lease With Ukiah Firefighters Association" . City Attorney pointed out that under terms of lease, the City has not given up the rights to the property. A clause in the agreement allows 30 days notice to take over for public use. The following roll call vote results in the adoption of Resolution No. 76-63 : AYES : Councilmen Feibusch, Brannon, Councilwoman Pearson, Mayor Wood NOES: None ABSENT: Councilman Simpson CLAIM FOR DAMAGES DENIED - OLGA BURRELL On a motion by Councilman Feibusch, seconded by Councilman Brannon it was unanimously carried to deny the claim for damages filed by Olga Burrell, 278 Empire Drive. REVIEW OF PROPOSED BUDGET On a motion by Mayor Wood, seconded by Councilman Feibusch it was unanimously carried to adjourn this meeting to June 7th at 7 : 00 p.m. and June 8th at 7: 00 p.m. to review the proposed budget for 1976-77. Mayor Wood requested an agenda be prepared indicating budgets to be discussed. x.22 MINUTES OF THE MEETING OF THE CITY COUNCIL: OF THE CITY-;OF UKIAH JUNE 2, 1976 - PAGE 5 REPORT ON PAY AND CLASSIFICATION FOR CLERICAL EMPLOYEES BY RALPH ANDERSEN & ASSOC. City Manager reported that in the current agreement with Operating Engineers the City agreed to conduct a pay and classification study for clerical employees . The agreement does not require that the report be implemented. City Manager recommended that subject report be referred to meet and confer sessions to implement a part of the report. City Manager requested Council to implement the Accountant position immediately by adopting subject resolution amending the pay and classification plan. The Principal Account Clerk intends to retire soon and it is the intent to recruit at the accounting level. Council action is set forth below. On a motion by Councilman Feibusch, seconded by Councilwoman Pearson it was carried by the following roll call vote to adopt Resolution No. 76-64 , "Resolution Of The City Council Of The City Of Ukiah Amending The Classification Plan And Pay Plan" . AYES: Councilmen Feibusch, Brannon, Councilwoman Pearson, Mayor Wood NOES: None ABSENT: Councilman Simpson On a motion by Councilwoman Pearson, seconded by Councilman Feil?usch it was unanimously carried to accept the report submitted by Andersen and Associates for the clerical study. HIGH SCHOOL CIVICS CLASS PROPOSED PROJECT CONTINUED Subject matter continued from earlier in the meeting. Mark Bridgeman, 1511 Talmage Court was the spokesman for the class. He stated the high school civics class was interested in taking on a project to help make the city neat and clean in appearance. The project chosen is to place trash containers at the 8 bus stops in the city. The request was for the City to purchase and maintain the containers . It was pointed out the cost of each con- tainer is $60 to $70 each. Councilman Feibush stated he had met with the class and at that time made suggestions concerning the project. It appears that all of the involvment comes from the City. The class should devise some means of constructing cans or obtain some source for the cans and then make arrangements with the garbage company to have them emptied. Councilman Brannon stated the suggestions made were excellent ones and that perhaps the matter could be brought up before service clubs for their consideration. Mayor Wood expressed his thanks to the class and stated the matter would be taken into consideration. APPOINTMENT OF MEMBERS TO PARKING ADVISORY COMMISSION Publication of applicants for subject commission resulted in receipt of three applications - from Lee Enemark, Paula Worster, Chuck Lewis . Member from Downtown Businessmen' s Association On a motion by Councilman Brannon, seconded by Councilman Feibusch it was unanimously carried to appoint Chuck Lewis to serve on the Parking Advisory Commission , There were no further nominations . CouncilmanBrannon made the ncmination. Member from Greater Ukiah Chamber of Commerce On a motion by Councilwoman Pearson, seconded by Councilman Feibusch it was unanimously carried to appoint Leonard Nix to serve on the Parking Advisory Commission. Tenant from within boundaries of Parking District Councilman Feibusch made a motion, seconded by Councilwoman Pearson to nominate Paula Worster to the Parking Advisory Commission. Mayor Wood nominated Lee Enemark. The motion died for lack of a second. Councilman Feibusch made the nomination. There were no further nominations. Councilwoman Pearson made the nomination. There were no further nominations. City Manager No formal appointment required for City Manager. COUNCILMAN FEIBUSCH Councilman Feibusch stated he attended the meeting of the Underground Coordinating Committee and learned that the Telephone Company plans to run a new service from the corner of Church and School Streets to the Courthouse. Since this is one of our most used streets downtown, Councilman Feibusch stated he would like the Council to consider undergrounding city services at the same time. It was Councilman Feibusch' s understanding this was to be done in the near future and he would like to know the cost and requested the matter to be/oagendater for Council consideration. City Manager stated an underground district would need to be formed to go underground. Councilman stated he mentioned at the last meeting the importance of work sessions to discuss matters before Council action. He understands that the scheduling of such sessions would take place after budget sessions are completed. Mayor Wood stated the suggestion is well taken. COUNCILMAN BRANNON Councilman Brannon reported barricades placed on North Dora at Walnut were not lighted. City Manager stated the matter will be taken care of. COUNCILWOMAN PEARSON Councilwoman Pearson reported that $5000 had been donated, over and above the amount of material donated, toward the reconstruction of the golf pro shop. At the recent Golf Invitational approximately 185 attended. Reservations were made at that time for next year. The work and effort put into the project is beginning to pay off. COUNCILMAN FEIBUSCH Councilman Feibusch referred to the Labor Relations meeting being held in Eureka this week. City Manager stated it is an educational program. The purpose is to give information as to what is going on in the Legislature in Sacramento. MAYOR WOOD Mayor Wood reminded Council of the parade at 10 : 15 a.m. Council is to meet at Mill and State. u4: MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JUNE 21 1976 - PAGE 7 Mayor Wood reminded Council of the dedication ceremony of the Gazebo at the park at 12: 30 p.m. June 6th. REQUEST FROM BEN FRANKLIN Mr. Franklin lives at 1168 West Standley. He pointed out areas of concern which exist on subject street - poor visibility when backing out his driveway and fear for children walking on the street. Council suggested ways he might alleviate the problem but stated to place raised areas in the street as he suggested would not be done. ADJOURNMENT at 9 : 45 p.m. Mayor Wood adjourned the meeting/to June 7, 1976, 7 : 00 p.m. for budget session. A litigation session immediately followed this adjournment. LITIGATION SESSION The subject of the litigation session was a request from the City Attorney that the Council authorize the filing of a claim for damages against Mendocino County. The basis for the claim is the costs incurred to repair and rent a replacement for the D-8 Caterpillar tractor located at the City owned sanitary landfill site which was damaged due to a fire started by a county employee or county inmates under the care, custody or control o' a zv'L{nty employee.
