HomeMy WebLinkAboutmin 1976-08-18 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH AUGUST 18, 1976 - PAGE 1 The Council convened in regular session at 8 : 00 p.m. with Councilmen Feibusch, Brannon, Simpson, Councilwoman Pearson, and Mayor Wood present. INVOCATION AND PLEDGE OF ALLEGIANCE Mayor Wood gave the invocation and Councilman Simpson led in the y.r Pledge of Allegiance. PAYROLL WARRANTS On a motion by Councilman Feibusch, seconded by Councilman Simpson it was carried by the following roll call vote Payroll Warrants #7431 to #7589 inclusive for the periof of July 25th to August 7, 1976, inclusive, be approved in the total amount of $74, 562 . 02. AYES: Councilmen Feibusch, Brannon, Simpson, Councilwoman Pearson Mayor Wood NOES: None ABSENT: None GENERAL WARRANTS On a motion by Councilman Brannon, seconded by Councilwoman Pearson it was carried by the following roll call vote to approve the Gener.al Warrants #4083 to #4232 in the total amount of $256, 259 . 47 . AYES : Councilmen Feibusch, Brannon, Simpson, Councilwoman Pearson Mayor Wood NOES: None ABSENT: None E a APPROVAL OF MINUTES On a motion by Councilinan Feibusch, seconded by Councilwoman Pearson it was unanimously carried to approve the Minutes of the meeting of July 21, 1976 as submitted by the Clerk. ADOPTION OF ORDINANCE NO. 689 - BINGO On a motion by Councilman Simpson, seconded by Councilwoman Pearson it was unanimously carried to adopt Ordinance No. 689 by title only. Councilwoman Pearson made a motion, seconded by Councilman Brannon to adopt Ordinance No. 689, "Ordinance -Of The City Council of The City Of Ukiah Providing For The Operation Of Bingo Games By Non- Profit Charitable Corporations", The question was ,'raised whether -or- riot the- bi-r�go games could be carried on •by any non profit organization in the state of California. The City Attorney stated any non-profit group recognized by the state would be allowed to conduct bingo games. Councilman Feibusch raised the question of the ordinance stating non-profit organization, not corporation. City Attorney stated the change to non-profit corporation was made at the last meeting when subject ordinance was introduced. The corrected copies were not -- distributed to Council. Clerk was directed to distribute corrected copies to Council. Ordinance No. 689 was adopted by the following roll call vote: AYES: Councilmen Brannon, Simpson, Councilwoman Pearson, Mayor Wood. NOES: Councilman Feibusch ABSENT: None RESOLUTION NO. 77-20 ESTABLISHING LICENSING FEE FOR BINGO GAMES Councilwoman Pearson made a motion,seconded by Councilman Simpson to adopt Resolution No. 77-20, "Resolution Of The City Council Of The City Of Ukiah Establishing Licensing Fee For Bingo Games" . 154 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH AUGUST 18, 1976 - PAGE 2 Under the question, Councilman Feibusch amended the motion, seconded by Mayor Wood, so that Line 12 would read, "Annual first day license" and Line 15 would read, "During same year at the same location" . The first day license should be secured annually. The full license is good for one year. The following roll call vote resulted in the adoption of Resolution No. 77-20 : AYES:, Councilmen Feibusch, Brannon, Simpson, Councilwoman Brannon Mayor Wood NOES: None ABSENT: None RESOLUTION NO. 77-21 ADOPTING 1976-66 BUDGET On a motion by Councilwoman Pearson, seconded by Councilman Simpson it was carried by the following roll call vote to adopt Resolution No. 77-21, "Resolution Of The City Council Of The City. Of Ukiah Adopting 1976-77 Budget For The City Of Ukiah" AYES: Councilmen Feibusch, Brannon, Simpson, Councilwoman Brannon Mayor Wood NOES: None ABSENT: None RESOLUTION NO. 77-22 YOUTH PROJECT AGREEMENT On a motion by Councilman Simpson, seconded by Councilman Feibusch it was carried by the following roll call vote to adopt Resolution No. 77-21, "Resolution Of The City Council Of The City Of Ukiah Authorizing Signature To Youth Project Joint Powers Agreement" . AYES: Councilmen Feibusch, Brannon, Simpson, Councilwoman Pearson Mayor Wood NOES: None ABSENT: None RESOLUTION NO. 77-23 AGREEMENT WITH .UKIAH CHAMBER OF COMMERCE Councilwoman Pearson made a motion, seconded by Mayor Wood to adopt Resolution No. 77-23, "Resolution Of The City Council Of The City Of Ukiah Authorizing Execution Of An Agreement For Promotional Services With The Greater Ukiah Chamber of Commerce" . Under the question, Councilman Feibusch amended the motion, seconded by Mayor Wood to delete the provision that the electric consumption at the Chamber office be furnished free of charge. It was pointed out that payment of electric utilities at the Chamber office has been a long standing practice. The average cost to the City is $600 yearly. It was also pointed out that the City derives benefits from the Chamber. The following roll call vote resulted in defeat of the amended motion: AYES: Councilmen Feibusch and Mayor Wood NOES: Councilmen Brannon, Simpson, Councilwoman Pearson ABSENT: None The following roll call vote resulted in adoption of Resolution No. 77-23: AYES: Councilmen Brannon, Simpson, Councilwoman Pearson, Mayor Wood NOES: Councilman Feibusch ABSENT: None RESOLUTION NO. 77-24 AGREEMENT WITH COUNTY CHAMBER OF COMMERCE On a motion by Councilman Feibusch, seconded by Councilman Brannon It was carried by the following roll call vote to adopt Resolution 155 i MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH AUGUST 18, 1976 - PAGE 3 No. 77-24 , "Resolution Of The City Council Of The City Of Ukiah Authorizing Execution Of An Agreement With The Mendocino County Chamber of Commerce For The Fiscal Year 1976--1977" . AYES: Councilmen Feibusch, Brannon, Simpson, Councilwoman Pearson, Mayor Wood NOES: None ABSENT: None CLAIM FOR DAMAGES - MICHELLE BETTINI On a motion by Councilman Simpson, seconded by Councilman Feibusch it was unanimously carried to deny the claim for damages filed by Michelle Bettini and refer same to the insurance carrier. FEDERAL AND STATE CLEAN WATER GRANTS City Manager reported Council has previously authorized funds to eliminate deficiencies in the treatment process at the sewage treatment plant. Phase I of the application for Clean Water Grant Funds has been approved. The City' s share of matching funds will be $10, 625. Required studies are planned for this winter during the period of maximum inflow and infiltration. There was no call for action on subject matter. SOCIAL ELEMENT - PAGES 21, 22, 23 Council discussed the Plans of Action of subject pages which listed items the City will do. A suggestion was made that the city could make the proper referrals but not get into the programs. PRIORITIES FOR APPLICATION FOR FEDERAL PUBLIC WORKS ACT FUNDING Council discussed the following projects to be included in subject application: 1) Gibson Creek drainage 2) Electric substation project 3) 2 fire station projects 4) Other drainage projects 5) Corporation Yard 6) Street system 7) Sidewalk program On a motion by Councilman Simpson, seconded by Councilman Feibusch it was unanimously carried to include the following projects in the application for Federal Public Works Act funding: 1) Drainage, 2) Electric substation, 3) Fire stations. SET PUBLIC HEARING DATE FOR APPEAL OF USE PERMIT NO. 76-64 FOR PARKING AT ZACK'S PIZZA Councilman Feibusch disqualified himself due to a conflict of interest. .On a motion by Councilman Brannon, seconded by Councilwoman Pearson it was carried by a majority voice vote to set September 1, 1976 as the public hearing date for subject appeal. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH AUGUST 18, 1976 - PAGE 4 MAYOR WOOD - AGRICULTURAL-CRITICAL ZONING Mayor Wood spoke to the various zoning decisions made in the past 9 to 12 months wherein Council has rezoned land bordering agricultural. The proposed use may seem compatible at the time but in the final analysis only a portion of the land is used. Such action leaves the door open to all other uses which may or may not be good. Councilman Wood requested Council consider future zoning of such parcels as agricultural-critical , requiring a use permit for every use that goes on said land. Mayor Wood made a motion, seconded by Councilman Simpson that the City ATtorney and Planning Director draft an ordinance designating agricultural-critical zone, requiring a use permit on land bordering agricultural. •Council expressed a need to spell out what goes in that particular zone, guidelines in terms of density, a need for filing an EIR, and the possibility of a general plan amendment issue. The Planning Director suggested that an overlay zoning could be placed on top of existing zoning. On a motion by Councilman Feibusch, seconded by Mayor Wood it was unanimously carried .to amend the motion to allow staff time to come -up with more details and suggestions_ on subject matter for presentation at the next meeting. LITIGATION SESSION` On a motion by Mayor Wood, seconded by Councilman Brannon it was unanimously carried to add Item #14 to the agenda, a litigation session.
