MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH

The City Council convened in regular session at 8 :03 p.m. with
Councilmen Brannon, Feibusch, Councilwoman Snyder•and Mayor Simpson
present. Councilman Wood was absent.
INVOCATION AND PLEDGE OF ALLEGIANCE
Councilman Brannon gave the invocation and Councilwoman Snyder
led in the Pledge of Allegiance.
PAYROLL WARRANTS
On a motion by Councilman Feibusch, seconded by Councilman Brannon
it was carried by the following roll call vote to approve Payroll
Warrants #10438 to #10500 inclusive and #12501 to #12592 inclusive
for the period of May 1 , 1977, to May 14 , 1977 , inclusive in the
total amount of $72, 279. 20.

GENERAL WARRANTS
City Manager requested that Warrant #6004 in the amount of $21. 06
to B and B Electronics be deleted.
On a motion 'by Councilwoman Snyder, seconded by Councilman Feibusch
it was carried by the following roll call vote to approve General
Warrants #5994 to #6045 inclusive, with the deletion of Warrant
#6004, in the total amount of $85, 454 . 74 .

APPROVAL OF MINUTES
On a motion by Councilman Brannon, seconded by Councilman Feibusch
it was carried by the following roll call vote to approve the
Minutes of the meeting of May 18 , 1977 as submitted by the Clerk.

On a motion by Councilman Feibusch, seconded by Councilman Brannon
it was carried by the following roll call vote to approve the
Consent Calendar as set forth below:,

1) Resolution No. 77-97 calling for contract with Highway Patrol
for participating in the Abandoned Vehicle Abatement Program.

c) Tires - Burns Tire Service, Ukiah

REPORT FROM PARKING ADVISORY
COMMISSION CHAIRMAN NELMES SMITH
Chairman Nelmes Smith gave a detailed report on projects of the
Commission during the past year. He enumerated the changes which
have been made in an attempt to solve the downtown parking problem
and the results of a recent survey of the parking lots in the Park-
ing District which showed how effective the changes have been.
Commissioner Smith was commended for the outstanding work he has
done as a member of the Commission.
VARIANCE APPLICATION NO. 77-45
KEITH L. TROUETTE, 312 JONES
Subject application requests variance from rear and side yard
requirements as prescribed by Section 9017 of the Municipal Code.
Planning Commission recommended approval of the rear yard variance and
denial of the side yard variance as set forth in Planning Commission
Findings dated May 20, 1977 .
Councilman Brannon made a motion to approve subject variance as
recommended. Councilman Feibusch seconded the motion.
In the discussion, Council questioned the fact that a new garage
was allowed to be constructed five feet from the rear yard property
line. A Personnel Session was requested to be held after the meeting.
Mayor Simpson granted the request.
"Resolution No. 77-98 Granting Variance To Keith L. Trouette" was
adopted by the following roll call vote:

VARIANCE APPLICATION NO. 77-61
EMPIRE DEVELOPMENT COMPANY
Subject application requests a variance from side yard requirements
as prescribed by Section 9017. The property is located at the
northwest corner of Louise Court and South Oak Street, aka #1 Louise
Court. Planning Commission recommendation was to allow a two foot
encroachment into the side yard and a three foot encroachment into
the front yard.
On a motion by Councilman Feibusch, seconded by Councilman Brannon
it was carried by the following roll call vote to adopt "Resolution
No. 77-99 Granting Variance to Empire Development Company" .

CODE EXEMPTION NO. 77-66
STERLING NORGARD-WESTERN AUTO
Subject application requests exemption from off street parking
requirements prescribed in Section 9165 of the Municipal Code.
The property is the 121 Main Street. Planning Commission recommenda-
tion is to reduce the required number of off street parking spaces
from 18 to 15 to facilitate an addition to the rear of the Western
Auto Store.
Councilman Brannon made a motion, seconded by Councilwoman Snyder
to approve the code exemption request as recommended by the
Planning Commission.

Sterling Norgard was present in the audience to speak in favor
of the request.
"Resolution No. 77-100 Granting Code Exemption to Sterling Norgard"
was adopted by the following roll call vote:

RESOLUTION NO. 77-101 EXPRESSING
SUPPORT OF THE ARCTIC GAS PIPELINE PROJECT
On a motion by Councilman Brannon, seconded by Councilman Feibusch
it was carried by the following roll call vote to adopt Resolution
No. 77-101, "Resolution of The City Council Of The City Of Ukiah
Expressing Support Of The Arctic Gas Pipeline Project" .

ORDINANCE NO. 696 AMENDING UTILITY DEPOSITS
On a motion by Councilman Feibusch, seconded by Councilman Brannon

ing Utility Deposits (Cahpter 51 Division 4 , Ukiah City Code) "

ENFORCEMENT AGENCY TO COMPLY WITH

On a motion by Councilman Brannon, seconded by Councilman Feibusch
it was carried by the following roll call vote to adopt Resolution
No. 77-102 , "Resolution Of The City of Ukiah City Council Designa-
ting An Enforcement Agency To Comply With The Z 'Berg-Kapiloff
Solid Waste Control Act of 1976" .

RESOLUTION NO. 77-103 ESTABLISHING
RENTAL FEE FOR CITY COUNCIL CHAMBERS

No. 77-103, "Resolution Of The City Council Of The City Of Ukiah
Establishing Rental Fee For City Council Chambers" .

RESOLUTION NO. 77-104
CETA TITLE VI SUBGRANT
On a motion by Councilman Snyder, seconded by Councilman Feibusch

Authorizing Mayor And Clerk To Sign CETA Title VI Subgrant" .

APPROVAL OF PURCHASE OF LOW
HOUR USED CATERPILLAR D8 TRACTOR
On a motion by Councilman Brannon, seconded by Councilman Feibusch
it was carried by the following roll call vote to purchase the
low hour used Caterpillar D8 Tractor with trade-in allowance; the
balance of $84, 000 to be financed through the Savings Bank of
Mendocino County.

ABSENT: Councilman Wood
PRESENTATION OF PRELIMINARY BUDGET
On a motion by Councilman Feibusch, seconded by Councilman Brannon
it was unanimously carried to meet from 6 : 30 p.m. to 8 : 00 p.m.
June 15th prior to the regular Council meeting to commence budget
hearings.
APPOINTMENTS TO COMMISSIONS
On a motion by Councilwoman Snyder, seconded by Councilman Brannon
it was unanimously carried to move subject agenda item to the next
meeting to allow time for staff to contact those Commissioners
whose terms are expiring to determine if they would accept appoint-
ment for another term.
Mayor Simpson read a letter of resignation from Colette Morris ,
Planning Commissioner. Council directed the City Manager to write-----
an appropriate letter to Commissioner Morris and to each of the
retiring Commissioners.
RESOLUTION NO. 77-105 APPOINTING
DICK SARBER TO AIRPORT COMMISSION
On a motion by Councilman Brannon, seconded by Councilman Feibusch
it was carried by the following roll call vote to adopt Resolution
No. 77-105, "Resolution Of The City Council Of The City Of Ukiah
Appointing A Member To The Airport Commission (R. H. Sarber) " .

PROPOSED PURCHASE POWER AGREEMENT
Councilwoman Snyder reported on the NCPA meeting in Palo Alto
at which time subject agreement was discussed. Each city is
to adopt said agreement by June 30, 1977, if they are to be a
part of the Shell agreement. Ukiah would share 5% of the 1000.
The amount of money the 5% represented is an unknown. Council
determined to hold over further discussion to the next meeting,
said discussion to begin at 6 : 00 p.m.
COUNCILMAN BRANNON
Proposed use of Hillside Hospital . Referred to publicity Planning
Commission received on subject matter and expressed appreciation
for the Letter to the Editor by Planning Commissioner Sandelin.
In line filtration system. Asked if there were merit to explore
t e possibility of a well located in the area of the old sewer farm
in lieu of the proposed in line filtration system.
AB155 and AB840. Review each and expressed opposition, urging
Council to contact legislators regarding same.

COUNCILMAN FEIBUSCH
West Church Street. Expressed thanks to Public Works Department
for removal of the electric poles on Church Street.
Use of surplus property. As members of the Industrial Development
Committee, Councilmen Feibusch and Brannon made a presentation to
the Board of Realtors regarding subject matter. It appears that
the presentation was successful inasmuch as there is an interested
party for subject property.
Proposal to widen Perkins between School & Oak. The Planning
commission recently considered a proposed four story building at
this location. To widen the street and merge other lots into one
large lot would better accommodate the building. Contractor of
proposed building is willing to negotiate. The City Engineer
stated such a project may qualify for SB325 monies.
Downtown Study Committee. Councilmen Brannon and Feibusch will
serve on subject committee.
COUNCILWOMAN SNYDER
City/County Relations Committee. Council received a written report
of subject meeting. The committee will meet again 7: 30 a.m. ,
June 8th.
Mobile- Homes at Airport. Second inquiry. City Engineer will
make inquiry..
Western Auto Building. Referred to Code exemption approved earlier
in meeting and asked if it should be .agendaed for a Use Permit.
Is the proposed use appropriate in a C-1 or C-2 zone?
Retiring Commissioners. Some appropriate gesture other than a
letter should be given to those who have served on the various
commissions .
MAYOR SIMPSON
Japanese Delegation To Visit City. A group of 17 Japanese will be
visiting Ukiah June 6th consid-e-r ng Ukiah as a Sister City. Their
city is on the same latitude as Ukiah, has the same products , and
approximately the same population. Council will be present in
the Council Chambers to welcome the delegation.
On a motion by Councilman Brannon, seconded by Councilwoman Snyder
it was unanimously carried to purchase an appropriate gift for
the group.
ADJOURNMENT
Mayor Simpson adjourned the meeting at 10 : 02 after which the Council
reconvened in Personnel Session.
