HomeMy WebLinkAboutmin 07-06-77 302 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JULY 61 1977 - PAGE 1 The City Council met in regular session at 8 : 02 p.m. with Council- men Brannon, Wood, Feibusch, Councilwoman Snyder and Mayor Simpson present. INVOCATION AND PLEDGE OF ALLEGIANCE Councilman Wood gave the invodation and Councilwoman Snyder led in the Pledge of Allegiance. PAYROLL WARRANTS On a motion by Councilman Brannon, seconded by Councilman Feibusch it was carried by the following roll call vote to approve Payroll Warrants #12768 to #12924 inclusive in the amount of $78, 473 . 42 for the period of May 29 , 1977 to June 11, 1977, inclusive and Payroll Warrants #12925 to #13000 inclusive in the amount of $78, 845. 56 for the period of June 12 , 1977, to June 25, 1977, inclusive. AYES : Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder and Mayor Simpson. NOES: None ABSENT: None GENERAL WARRANTS On a. motion by Councilman Feibusch, seconded by Councilwoman Snyder, it was carried by the following roll call vote to approve General Warrants #6155 to #6255 inclusive in the total amount of $197, 966. 40 and #6256 to #6265 in the total amount of $43, 563 . 50 AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder Mayor Simpson NOES: None ABSENT: None APPROVAL OF MINUTES On a motion by Councilwoman Snyder, seconded by Councilman Brannon it was carried by the following roll call vote to approve the Minutes of the June 15, 1977, Council meeting as submitted by the Clerk. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder Mayor Simpson NOES : None ABSENT: None CONSENT CALENDAR Councilman Feibusch requested that Agenda Item No. 1, "Resolution directing compliance with Memorandum of Understanding and Agenda Item No. 2, "Resolution Amending Pay Plan" be pulled from the Consent Calendar. Councilwoman Snyder requested that Agenda Item No. 3 , "Approving filing of amended airport permit with State Division of Aeronautics to accommodate clear zone acquisition" be pulled from the Consent Calendar. On a motion by Councilman Wood, seconded by Councilman Brannon It was carried by the following roll call vote to approve Consent Calendar Agenda Items No. 4 and 5 as set forth below: 4) Resolution No. 78-3 reappointing Commission members to Planning Commission and Recreation and Parks Commission. 5) Resolution No. 78-4 authorizing Mayor and Clerk to sign lease for airport localizes with F.A.A. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder Mayor Simpson NOES: None ABSENT: None 303 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JULY 6, 1977 - PAGE 2 RESOLUTION NO. 78-1 DIRECTING COMPLIANCE WITH MEMORANDUM OF UNDERSTANDING On a motion by Councilman Wood, seconded by Councilman Brannon it was carried by the following roll call vote to approve Resolution No. 78-1, "Resolution Directing Compliance With Memorandum Of Understanding" AYES: Councilmen Brannon, Wood, Councilwoman Snyder, Mayor Simpson NOES: Councilman Feibusch ABSENT: None RESOLUTION NO. 78-2 AMENDING PAY PLAN On a motion by Councilman Wood, seconded by Councilman Brannon it was carried by the following roll call vote to approve Resolution No. 2, "Resolution Amending Pay Plan" . AYES: Councilmen Brannon, Wood, Councilwoman Snyder, Mayor Simpson NOES: Councilman Feibusch ABSENT: None APPROVAL OF FILING AMENDED AIRPORT PERMIT On a motion by Councilman Brannon, seconded by Councilman Feibusch it was carried by the following roll call vote to approve filing of amended airport permit with State Division of Aeronautics To Accommodate Clear Zone Acquisition. AYES : Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None PUBLIC HEARING - ALLOCATION OF REVENUE SHARING The City Manager stated two public hearings are required on subject matter. One was held prior to budget hearings at which time the Senior Citizens group requested funding. Of the $220, 000 available a portion is allocated for the fire station and police department operation. The public hearing before the Council at this time is for more public input. Mayor Simpson opened the public hearing at 8 : 17 p.m. There was no one present in the audience who spoke on subject matter. Mayor Simpson closed the public hearing at 8 :18 p.m. Council took no action. PUBLIC HEARING - ADDING SOCIAL ELEMENT TO GENERAL PLAN Mayor Simpson opened the public hearing at 8 : 19 p.m. There was no one present in the audience who spoke on subject matter. Mayor Simpson closed the public hearing at 8 : 20 p.m. RESOLUTION NO. 78-8 ADOPTING SOCIAL ELEMENT TO GENERAL PLAN On a motion by Councilman Wood, seconded y Councilman Feibusch it was carried by the following roll call vote to amend the General Plan by adding a Social Element thereto. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None 3 0 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JULY 6, 1977 - PAGE 3 RESOLUTION NO. 78-5 GRANTING VARIANCE TO WERNER NASE, 146 GIBSON STREET Subject application is a request for a variance from required five foot sideyard setback to zero setback. This variance consideration is the result of a property line discrepancy, _ location of an existing building on an adjacent property and the close proximity of two buildings. Planning Commission had considered the matter and recommended approval subject to the following conditions : 1) Standard_ Conditions 1 through 9 and the following special conditions : a) that a fire wall be constructed against the existing garage b) that sprinklers be installed in the apartminent complex east wall windows to meet the Fire Code c) that the downspouts be moved so that drainage be directed to Gibson Street and entirely on the apartment complex property d) that a fence be constructed along the existing fence - line to meet the building code e) that any damage to the existing garage be repaired. Councilman Brannon made a motion, seconded by Councilman Wood to grant Variance Application No. 77-80 with the adoption of Resolution No. 78-5, "Resolution Granting Variance to Werner Nase" Madeline Sager, Attorney for the property owners east of subject property was present and stated said property owners were agree- able to granting the variance filed by Mr. Nase subject to the five conditions listed above. Resolution No. 78-5 was adopted by the following roll call vote : AYES : Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None J SENIOR CITIZEN CENTER REQUESTS FUNDING FOR BUS SERVICE OUT OF SB325 FUNDS Mr. George Bartlett, Managing Director for the Center spoke on subject matter. Mayor Simpson advised Mr. Bartlett to make his request through Ernie Dickens, Mendocino County-Cities Planning Agency. REQUEST FOR WAIVER OF RENTAL FEE FOR USE OF COUNCIL CHAMBERS Subject request was from the Department of Health, Education and Welfare. On a motion by Councilman Wood, seconded by Councilwoman Snyder it was carried by the following roll call vote to waive the rental fee for use of the Council Chambers as requested by the Department of Health, Education and Welfare. AYES: Councilmen Brannon, Wood, Councilwoman Snyder, Mayor Simpson RESOLUTION NO. 78-6 APPROVING FINAL NOES : Councilman Feibusch MAP FOR DOOLIN PARK ESTATES UNIT 1 ABSENT: None On a motion by Councilman Wood, seconded by Councilman Brannon it was carried by the following roll call vote to adopt Resolution No. 78-6, "Resolution of the City Council of the City Of Ukiah Approving The Final Map For Doolin Park Estates Unit 1" . AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None .30-5 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JULY 6, 1977 - PAGE 4 RESOLUTION NO. 78-7 AUTHORIZING SIGNATURE TO PURCHASE POWER AGREEMENT WITH NCPA City Manager stated subject agreement is ready for approval. Some of the NCPA cities have already signed. Councilman Wood made a motion, seconded by Councilman Brannon to adopt Resolution No. 78-7, "Resolution Of The City Council Of The City Of Ukiah Authorizing Mayor and Clerk To Sign Purchase Power Agreement With NCPA" . The pro and cons expressed by Council are listed below: 1) ' Council should first decide if the City is to stay in the power business. If the decision is affirmative, then the contract should be refined. 2) For the city to participate in this agreement would be to continue another questionable venture such as our electric distribution system. 3) Citizens should be told the City is getting into a bonded indebtedness. 4) There is no agreement between PG&E and NCPA to bring power to Ukiah. the 5) Nowhere in the contract is reference made to/impact solar energy may have. If the city enters into the agreement, the City must honor all obligations which NCPA may incur. 6) The same fears existed with the first nuclear plants. We have never caught up with energy demand. Question becomes mute. 7) Electrical distribution system has been good to the City. It is a viable system and competitive. 8) If the city does not get into the business, PG&E will be in a position to buy up new sources and keep the competition running. 9) The question is will the City stay in the electric business . The appeal is strong. Utilities are quasi-public agencies. The only way we can conduct a free enterprise is to have other viable sources of generation. Resolution No. 78-7 was adopted by the following roll call vote: AYES: Councilmen Brannon, Wood, Mayor Simpson NOES: Councilman Feibusch and Councilwoman Snyder ABSENT: None ' Councilman Feibusch stated he would like the Mayor and Council to know he will bring the matter to the public for a public referendum vote. RESOLUTION CONCURRING IN THE COUNTY SOLID WASTE MANAGEMENT PLAN On a motion by Councilman Wood, seconded by Councilman Brannon it was unanimously carried to continue subject matter two weeks. APPROVAL OF AGREEMENT WITH UNIFIED SCHOOL DISTRICT TO CARRY OUT PROGRAM OF COMMUNITY RECREATION On a motion by Councilman Wood, seconded by Councilman Feibusch it was carried by the following roll call vote to approve the agreement with the Unified School District for a program of community recreation. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder Mayor Simpson NOES: None ABSENT: None 300 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JULY 61 1977 - PAGE 5 REVIEW OF BUDGET AMENDMENTS On a motion by Councilman Wood, seconded by Councilman Feibusch it was unanimously carried to approach subject review on an item by item basis. It was determined that more information will be provided at the next meeting concerning a $16, 000 expenditure on Page 129 of the proposed budget. The Teen Center budget will also be con- sidered at the next meeting. Councilman Wood made a motion, seconded by Mayor Simpson to indrease the Chamber of Commerce budget to $20, 000 for the coming year. The motion failed by the following roll call vote: AYES: Councilman Wood and Mayor Simpson NOES: Councilmen Brannon, Feibusch and Councilwoman Snyder. APPOINTMENT TO MANPOWER PLANNING COUNCIL On a motion by Councilman Wood, seconded by Councilman Brannon it was unanimously carried to appoint the City Attorney, Randall Hays to the Manpower Planning Council. APPOINTMENTS TO BOARDS & COMMISSIONS RESOLUTION NO. 78-9 MAKING APPOINTMENTS TO AIRPORT, PARKING ADVISORY, PLANNING AND RECREATION & PARKS COMMISSIONS Mike Gomes, 1150 Marwen Drive was present in the audience and expressed an interest in serving on the Planning Commission. On a motion by Councilman Brannon, seconded by Councilman Wood it was unanimously carried to appoint Gail Monpere to the Recreation and Parks Commission. On a motion by Councilman Feibusch,, seconded by Councilman Wood it was unanimously carried to appoint Daniel Hamburg to the Planning Commission. On a motion by Councilman Feibusch, seconded by Councilman Brannon it was unanimously carried to appoint Mike Gomes to the Parking Advisory Commission. On a motion by Councilwoman Snyder, seconded by Councilman Brannon it was unanimously carried to appoint Larry Kier to the Airport Commission. On a motion by Councilman Wood, seconded by Councilman Feil)usch it was unanimously carried to appoint Robert Gran to the Airport Commission. The final appointment to the Airport Commission will be made at the next meeting. MAYOR'S STATEMENT ON WATER CONSERVATION Council determined the Mayor ' s statement on water conservation will be issued to the press. EXECUTIVE SESSION & PERSONNEL SESSION Councilman Feibusch requested an Executive Session and Councilman Brannon requested a Personnel Session.. 3 - 3 1 rN �Mm! City Attorney stated the matter was referred to the Council. Tetrahedron at Airport - There is a safety problem since its removal. City Manager will handle. Request for earlier Agenda - Not enough time to study the agenda. Asked for two days a cUE1onal time to review. No action by Council. MAYOR SIMPSON Dust problem at Park - Request for a cost estimate for putting a coating on parking area at park to correct dust problem. BARBEQUE SCHEDULED The annual City of Ukiah Employees Barbeque will be July 28th. Council will carve meat and serve food. SUN HOUSE Dr. Peri has asked Council to sponsor a meeting with the people involved in the work on the Sun House. The tentative date is July 21st at the Saturday Afternoon Club. Mayor Simpson stated he will contact someone concerning the donation of a painting to the Sun House.
