MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH
OCTOBER 51 1977 - PAGE 1
The City Council met in regular session at 7 :31 p-m. with
Councilmen Brannon, Feibusch, Councilwoman Snyder, and Mayor
Simpson present. Councilman Wood was absent.
INVOCATION & PLEDGE OF ALLEGIANCE
Councilman Brannon gave the invocation and Councilman Feibusch
led in the Pledge of Allegiance.
COUNCILMAN WOOD ARRIVED AT THIS TIME - 7 : 33 p.m.
PAYROLL WARRANTS '
On a motion by Councilwoman Snyder, seconded by Councilman Brannon
it was carried by the following roll call vote to approve Payroll
Warrants #11427 to #11579 inclusive in the total amount of
$84 , 048. 88 for the period of September 4th to September 17, 1977 ,
inclusive.
AYES: Councilmen Brannon, Wood, Councilwoman Snyder, Mayor Simpson
NOES: Councilman Feibusch
ABSENT: None
GENERAL WARRANTS
On a motion by Councilman Feibusch, seconded by Councilman Brannon
it was carried by the following roll call vote to approve General
Warrants #6778 to x#6837 inclusive in the total amount of $135, 568. 00.

APPROVAL OF MINUTES
On a motion by Councilman Feibusch, seconded _by Councilwoman Snyder
- it was carried by the following roll call vote to approve the
minutes of the. regular meeting September 21, 1977 , as submitted
by the Clerk.

CONSENT CALENDAR
Councilman Feibusch requested Agenda Item #3 , bids for test wells,
be pulled from the Consent Calendar.
Councilman Wood requested Agenda Item #1, bids for parking meters,
be pulled from the Consent Calendar.
Councilman Brannon requested Agenda Item #13, claim for damages,
be deleted from its proposed position on the agenda and be considered
under Consent Calendar. Council concurred.
On a motion by Councilman Feibusch, seconded by Councilman Brannon
it was carried by the following roll call vote to approve Consent
.,Calendar Agenda Items No. 2, 4, 5, and 13 as set forth below:
1) Award of bid for street light fixtures to Industrial Electrics
Service, Arcata in the total amount of $2747. 05.
2) Resolution No. 78-35, "Resolution Of The City Council Of The 'City
Of Ukiah Autnorizing The Destruction Of Certain Records.
3) Resolution No. 78-36, "Resolution Of The City Council Of The City
Of Ukiah Authorizing The Mayor To Sign Grant Agreement (State
Criminal Justice Planning Office) " .
4) Deny Claim for Damages filed by Ronald D. Smith, 105 Faull 'Ukiah.

AWARD OF BID FOR PARKING METERS
TO TRAFFIC APPLIANCE CORP. , LOS ANGELES
On a motion by Councilman Feibusch, seconded by Councilwoman Snyder
it was carried by the following roll call vote to award the bid
for parking meters to Traffic Appliance Corporation, Los Angeles,
in the total amount of $6395. 00.

BID FOR TEST WELLS REJECTED
On a motion by Councilman Feibusch, seconded by Councilman Brannon
it was carried by the following roll call vote to reject the bid
received for test wells, readvertise on the basis of new specifica-
tions and eliminate the requirement for an electro-log instrument.

PUBLIC HEARING ZONE CHANGE APPLICATION
NO. 78-2 , DORA STREET AREA
Subject application was initiated by the Planning Commission to
rezone the area west of Dora from Clay Street to the alley between
Walnut and Willow from R-3 and R-2 to R-1 and the area from Dora
to Bush between Clay and the alley from R-3 to R-2 . The Planning
Commission initiated the subject zone change in response to concerns
for General Plan implementation and also preservation of neighborhnnd
identity and characteristics as outlined by some property owners
in the area.
City Manager reviewed Planning Commission action on subject matter
which recommends favorable action on the zone change.
On the request by Mayor Simpson, the City Attorney reviewed the
sections of the City. Code setting forth uses allowed in R-3 zones
which are not allowed in R-1 or R-2 zones. The City Attorney also
read Section 9168e of the City Code for clarification of non-con-
forming
oncon-
forming uses.
Mayor Simpson declared the public hearing open at 7: 53 p.m.
No one spoke in favor of the proposed zone change.
The following persons spoke in opposition to the proposed change:
Attorney Don Hinkle, representing Jennie Hawn, Dora Street
Ray Worster, 115 South Spring
Mrs. James Williams, Calvert Court
Floyd Owen, representing Jeannie Owen
Planning Director Harris spoke to the objections raised by Mr.
Hinkle.
Mayor Simpson declared the public hearing closed at 8:14 p.m.
Council action on subject matter is set forth in the following
order of business.
INTRODUCTION OF ORDINANCE NO. 703
AMENDING CODE BY REZONING PROPERTY
ON DORA STREET (ZONE CHANGE APPL. NO. 78-2)
On a motion by Councilman Wood, seconded by Councilman Feibusch
it was unanimously carried to introduce Ordinance No. 703 by
title only.
On a motion by Councilman Wood, seconded by Councilman Feibusch
it was carried by the following roll call vote to introduce
Ordinance No. 703 , "Ordinance Of The City Council Of The City Of
Ukiah Amending Chapter 2, Division 9 Of The Ukiah City Code By
Rezoning Property From Existing R-3 and R-2 to R-1 and R-3 to R-2,

Councilman Wood requested that an amendment of non-conforming uses
in the Code be included in the next agenda.
Councilman Feibusch requested a policy and standards committee
meeting to discuss subject matter.
AIRPORT IMPROVEMENT PROJECT APPROVED
TRI CLUB LIONESS, INC.
On a motion by Councilman Wood, Seconded by Councilwoman Snyder
it was unanimously carried to approve the Tri Club Lioness,
Inc. proposal to adopt the Ukiah Municipal Airport as a
community improvement project under the Chairmanship of Barbara
Bassett.
WRITTEN COMMUNICATION RE
PROPOSED PERKINS STREET WIDENING
Councilman Wood referred to frequent communication Council has
received on subject matter and requested the news media to
indicate the Council is not interested in the proposal and
same has been withdrawn. Council concurred.
ORDINANCE NO. 700, ZONE CHANGE
APPL. NO. 77-71, HUNT CONSTRUCTION
SIDNIE AND CLARA STREETS -
Councilman Feibusch asked why subject zone change is acted on
before the use permit on subject property is effective.
Councilman Feibusch made a motion that before any action is
taken on subject zone change, that Council see a draft of the
Use Permit containing the conditions. Motion died for lack
of a second.
Councilman Brannon made a motion, seconded by Councilman Wood
to adopt Ordinance No. 700 by title only. Motion carried
unanimously.
Councilman Wood made a motion, seconded by Councilman Brannon
to adopt Ordinance No. 700 , "Ordinance Of The Citu Council Of
The City Of Ukiah Amending Chapter 2 , Division 9 Of The Ukiah
City Code By Rezoning Property From Existing R-1 Zone, To R-3
(Zone Change Application No. 77-71) " .
Councilman Wood withdrew his motion, with. the consent of Council--
man Brannon.
On a motion by Councilman Brannon, seconded by Councilman Wood
it was carried by the following roll call vote to defer action
on Ordinance No. 700 to the next meeting to allow Council consideration
of a contract between the City and Mrs. Helen Rea for the extension
of Ford Street.

Mayor Simpson

GARBAGE RATES SUBJECT TO PUBLIC HEARING
On a motion by Councilman Wood, seconded by Councilman Branno
it was unanimously carried to adopt Ordinance No. 701 by
title only.
On a motion by Councilman Brannon, Secondedby Councilman Wood
it was carried by the following roll call vote to adopt
Ordinance No.. 701, "Ordinance Of The City Council Of The
City Of Ukiah Amending Section 3951 Of The Ukiah City Code
(Public Hearing On Utility Rates) "

it was unanimously carried to adopt Ordinance No. 702 by

On a motion by Councilman Wood, seconded by Councilman Feibusch
it was carried by the following roll call vote to adopt Ordinance
No. 702, "An Ordinance Of The City Council Of The City Of
Ukiah Amending Sections 4300 And 4334 Of The Ukiah. City Code
Thereby Establishing a Leash Law For Dogs

RESOLUTION NO. 78-37 AUTHORIZING AGREEMENT
WITH SENIOR•CITIZENS CENTER FOR TRANSPORTATION SERVICES
On a motion by Councilman Wood, seconded by Councilman Snyder,
it was carried by the following roll call vote to adopt
Resolution No. 78-37 , "Resolution Of The City Council Of
The City Of Ukiah Authorizing Mayor And Clerk To Sign Agreement
With Senior Citizens Center For Transportation Services" .

On a motion by Councilman Brannon, seconded by Councilman
Feibusch, it was carried by the following roll call vote to
adopt Resolution No. 78-38, "Resolution Of The City Council
Of The City Of Ukiah Authorizing The City Manager To Sign
And Submit Preapplication For ADAP Funding" .

On a motion by Councilman Foibusch, .seconded by Councilman
Brannon it was carried by the following roll call vote to
introduce Ordinance No. 704 , "An Ordinance Of The City Council
Of The City If Ukiah Adding Article L (a) To Chapter 4 Of
Division 1 Of The Ukiah Municipal Code Relating To ' The
Establishment, Appointment, And Duties Of The Ukiah Cultural
Arts Commission" .

PROPOSED EXPANSION OF REWCF TO
INCLUDE A LIABILITY INSURANCE POOL
City Manager reported member cities of Redwood Empire Workers '
Compensation Fund authorized a study and report on the
feasibility of establishing a "risk management pool" expanding
the operational Workers ' Compensation pool to include liability
exposures. The basic concept is that the cities jointly
establish a cash pool to pay claims up to a certain level.
Each city would select the level of self insurance desired.
Then all other exposures would be insured on a joint basis.
The conclusions of the Consultant' s report were reviewed as
contained in the City Manager' s memo dated October 5, 1977 .
On a motion by Councilman Wood, seconded by Councilman Feibusch
it was unanimously carried to direct .Councilman Brannon to
give further consideration to the report, explore the possibilities,
and report back to the Council at a subsequent time.
CITY ATTORNEY OPINION RE REFUND
OF ADVANCED COSTS (OAK MANOR SUED. #4)
City Attorney opinion dated July 1, 1977 , based on specific facts
contained therein, stated subject subdivision is residential
in character and under the regulations adopted by Council should
be classified as a residential subdivision and therefore eligible
for refund of advanced costs.
On a motion by Councilman Wood, seconded by Councilman Brannon,
it was carried by the following roll call vote to accept the
City Attorney opinion regarding Oak Manor Subdivision #4 .

Progress report on Mendocino Drive complaint - District Attorney
has issued a complaint to be circulated in the neighborhood.
COUNCILMAN FEIBUSCH
Complaint from Mrs. Allen regarding Main Street alley - Referred
o Traffic Committee.
Trash at Bush and Perkins - Has been there 2� months. Whose
responsibility to pick up.
Safety Committee Matter - The step in City Hall just outside
Council Chambers is azardous. '

Goodwill Stop at Safeway Parking hot - Request to ask Safeway to.
clean up the area.
MAYOR SIMPSON
League of California Cities Conference - A detailed report was
given Council. Brochures were given -to City Manager which
was available to members of Council.

Mayor Simpson adjourned the meeting at 11: 05 p.m.
