HomeMy WebLinkAboutmin 11-02-77 MINUTES OF THE MEETING OF TME CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 2, 1977 - PAGE; 1 The City Council met as the Policy and Standards Committee at 6: 30 P.M. to discuss the traffic impact of planning decisions. The City Council met in regular session at 7 : 30 p.m. with Councilmen Brannon, Wood, Feibusch, Mayor Simpson present. Councilwoman Snyder was absent. INVOCATION AND PLEDGE OF ALLEGIANCE Councilman Wood gave the Invocation and Director of Public Works Al Kruth led in the Pledge of Allegiance. PAYROLL WARRANTS On a motion by Councilman Feibusch, seconded by Councilman Brannon it was carried by the following roll call vote to approve Payroll Warrants #11757 to #11922 inclusive in the total amount of $82,263. 70 for the period of October 2, 1977 to October 15, 1977 , inclusive. AYES: Councilmen Brannon, Wood, Feibusch, Mayor Simpson NOES: None ABSENT: Councilwoman Snyder. GENERAL WARRANTS On a motion by Councilman Feibusch, seconded by Councilman Brannon it was carried by the following roll call vote to approve General Warrants #6915 to #6916 inclusive in the total amount of $14 , 593. 96 and #6917 to #7003 inclusive in the total amount of $118, 489. 75. AYES: Councilmen Brannon, Wood, Feibusch, Mayor Simpson NOES: None ABSENT: Councilwoman Snyder APPROVAL OF MINUTES On a motion by Councilman Brannon, seconded by Councilman Feibusch it was carried by the following roll call vote to approve the Minutes of the meeting of October 19, 1977 , as corrected. AYES: Councilmen Brannon, Feibusch, Mayor Simpson NOES: None ABSENT: Councilwoman Snyder Councilman Wood was absent from the previous meeting and did not vote on subject matter. RESOLUTION NO. 78-42 APPROVING SPECIAL ENERGY CRISIS INTERVENTION PROGRAM On a motion by Councilman Wood, seconded by Councilman Feibusch it was carried by the following roll call vote to adopt Resolution No. 78-42, "Resolution Of The City Council Of The City Of Ukiah Authorizing The Mayor And Clerk To Sign Contract (Special Energy Crisis Intervention Program) " . AYES: Councilmen Wood, Feibusch, Mayor Simpson NOES: Councilman Brannon . ABSENT: Councilwoman Snyder PUBLIC HEARING-AMENDMENT OF SOLID WASTE DISPOSAL SITE Subject hearing proposes to limit pickup or station wagon loads charged at the $1. 25 load rate to two yards per load. . Additional yardage per load is proposed to be charged at the loose yardage rate. No change in compacted or loose yardage fees are proposed. The request for subject amendment was made by Bob Fowler, Attorney for Marvin Bowen, Modern Disposal Service, Inc. Mayor Simpson declared the public hearing opened at 7 : 52 p.m. Bob Fowler, 150 North Pine and Marvin Bowen, 1001 Knob Mill Road spoke concerning subject amendment recommending that users of the disposal site pay on a per yard basis.. 348. NOVEMBER 2 , 1977 -- PAGE 2 Mayor Simpson declared the public hearing closed at 7 : 59 p.m. On a motion by Councilman Wood, seconded by Councilman Feibusch it was carried by the following roll call vote to adopt Resolution No. 78-44 which sets forth the elimination of the per truckload flat fee and measureseach cubic yard at the existing rates, said rates to be effective November 21, 1977 . AYES: Councilmen Brannon, Wood, Feibusch, Mayor Simpson NOES: None ABSENT: Councilwoman Snyder CULTURAL ARTS COMMISSION APPOINTMENTS On a motion by Councilman Wood, seconded by Councilman Brannon it was unanimously carried to direct the City Manager to extend an invitation to each person who has expressed an interest in appointment to said Commission to meet with Council at 6 : 30 p.m. preceeding the November 16t.h meeting PUBLIC HEARING-MAIN STREET EXTENSION FROM GOBBI TO TALMAGE, ROUTE. STUDY & EIR Planning Director Mike Harris reviewed the. map pointing out the six routes considered for subject extension. The alternatives were narrowed down to Route No.. 5 and 6. The cost figures were approximately the same for each. Remnant parcels would be created in Route No. 5 which would not be created in Route No. 6. Planning Commission action recommended .Route No. 5. Mayor Simpson declared the public hearing open at 8 : 32 p.m.- for those who wished to speak. to the sufficiency of the EIR. There was no one present to speak in favor or in opposition to the, EIR. The public he.arin.g was closed at 8 : 33 p.m. On' A motion. by Councilman. Feibusch, seconded by Councilman Brannon-, it was carried by the. fol..l.owing roll. call vote to find the EIR adequate for the Main Street extension from Gobbi to Talmage. AYES: Councilmen Brannon, Feibusch, Mayor Simpson NOES: None ABSENT: Councilwoman Snyder Mayor Simpson declared the public hearing open at 8 : 35 p.m. for those who wished to speak to the Main Street Extension Route Study. Charles Sankovich, 150 Cherry and Jim Foucault who owns property in subject area spoke to subject matter, each expressing the desire that Council make a decision and get on with the matter. Public hearing was closed at 8: 38 p.m. On a motion by Councilman Brannon, seconded by Mayor Simpson it was carried by the following roll call vote to adopt the straight route, Route No. 5, for the Main Street Extension from Gobbi to Talmage. AYES: Councilmen Brannon, Wood, Mayor Simpson . NOES: Councilman Feibusch ABSENT: Councilwoman Snyder PUBLIC HEARING CONTINUED-APPEAL, OF U.B. PERMIT NO. 78-19, FINITZ '& HULL At the request, of applicant,, sub)eco matter was continued to the next. meeting. ADOPTION OF ORDINANCE NO. 700 (ZONE CHANGE APPLICATION NO. 77--71) On a .motion by Councilman Brannon, seconded by Councilman Wood it was unanimously carried to adopt Ordinance No. 700 by short form, 34 9 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 2 , 1977 - PAGE 3 On a motion by Councilman Wood, seconded by Councilman Brannon it was carried by the following roll call vote to adopt *Ordinance No. 700, "Ordinance Of The City Council Of The City Of Ukiah Amending Chapter 2 , Division 9 Of The Ukiah City Code By Rezoning Property From Existing R-1 Zone, To R-3 (Zone Change " Application No. 77-71) " AYES: Councilmen Brannon, Wood, Mayor Simpson NOES: Councilman Feibusch ABSENT: Councilwoman Snyder. ORDINANCE NO. 703 DORA ST. REZONE Councilman Brannon requested that action be deferred on subject matter until an ordinance could be considered at the same time which would "grandfather" in the existing uses in subject area. On a motion by Councilman Wood, seconded by Councilman Feibusch it was unanimously carried to move consideration of Ordinance No. 703 to December 21, 1977 , at which time an ordinance will also be considered which will "grandfather" in the existing uses in the area. RESOLUTION NO. 78-43 APPROVING FINAL MAP (OAK MANOR UNIT #4 , PHASE 1 On a motion by Councilman Wood, seconded by Councilman Brannon it was carried by the following roll call vote to adopt Resolution No. 78-43 , "Resolution Of The City Council Of The City Of Ukiah Approving The Final Map For Oak Manor #4 , Phase 1" AYES: Councilmen Brannon, Wood, Feibusch, Mayor Simpson NOES: None ABSENT: Councilwoman Snyder CITY ATTORNEY REPORTS The City Attorney reported the annexation laws have been completely overhauled. AB1533 gives cities the ability to annex islands. The City may be able to utilize this law regarding the Lewis Lane area. PROPOSED INITIATIVE MEASURE TO PROHIBIT PUBLIC EMPLOYEES STRIKES Council took no action on subject matter, REPORT ON BID OPENING GIBSON CREEK PROJECT No valid bids were received within the requirements of the specifications. One bid was received late in the amount of $192 ,244 . 50 submitted by L & R Construction Company, Pacifica. The Federal Government requires that we have labor on the project by November 30th so there is not sufficient time to re-advertise. M� Options open to Council were to ask EDA for a waiver to the time requirement and go through the bid process again, make a finding that the late bid is trivial and- a minor irregularity, or to negotiate with those interested in the prof ect. , The City, Attorney was of the opinion t.h.e bi.d was not a valid bid since it was late. Mr. Robinson, L & R Construction was present in the audience to request Council consider his bid for the project. 350 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 2 , 1977 - PAGE 4 Councilman Brannon made a motion, seconded by Councilman Wood to authorize staff to request a waiver from the November 30th deadline for the purpose of rebidding the project. In the event permission is not granted to commence immediate negotiations for a contract. The motion failed by the following roll call vote: AYES: Councilman Brannon NOES: Councilmen Wood, Feibusch, Mayor Simpson ABSENT: Councilwoman Snyder ' On a motion by Councilman Wood, seconded by Councilman Feibusch it was carried by the following roll call vote to waive the two minute late requirement, accept the bid if proof is to the City Attorney and City Manager by close of business Friday, November 4th that Mr. Robinson ' s business does qualify as a minority business enterprise. AYES: Councilmen Wood, Feibusch, Mayor Simpson NOES: Councilman Brannon ABSENT: Councilwoman Snyder On a motion by Councilman Wood, seconded by Councilman Brannon it was carried by the following roll call vote that in the event the minority business enterprise fails to qualify based on the previous motion, that an extension of time be sought from EDA and if not secured by 9 : 30 a.m. , November 7th that the matter be rebid. AYES: Councilmen Brannon, Wood, Feibusch, Mayor Simpson NOES: None ABSENT: Councilwoman Snyder. AUTHORIZATION TO CALL FOR BIDS -- FOR TAXI REPLACEMENT On a motion by Councilman Wood, seconded by Councilman Brannon it was unanimously carried to authorize the Clerk to call for bids for two taxi vehicles to replace the existing units. COOPERATIVE PERSONNEL SERVICES AFFIRMATIVE ACTION STUDY City Manager recommended subject matter be reviewed with Operating Engineers. Council concurred. The matter will be come back to Council at a subsequent time. BUDGET TRANSFER AUTHORIZATION DICTATING EQUIPMENT On a motion by Councilman Brannon, seconded by Councilman Wood it was carried by the following roll call vote to authorize the budget transfer as follows: From Account No. 130-908 $400. 00 " 100-1301-690 $300. 00 100-1990-695 $600. 00 To Account No. 100-1201-800 $1300. 00 AYES: Councilmen Brannon, Wood, Mayor Simpson NOES: Councilman Feibusch ABSENT: Councilwoman Snyder COUNCILMAN BRANNON Redwood Empire Workers' Compensation - City Manager attended the meet.in5 in the absence of Councilman. Brannon and gave a report of subject, me.e.tin5. 351 MINUTES OF THE MELTING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 2 , 1977 - PAGE 5 COUNCILMAN FEIBUSCH Drainage problem, Apple Avenue - Request for a plan in the area. City Engineer reported inability to schedule a cleanup time, however a minimum amount of cleanup. will be done in the channel. MAYOR SIMPSON Mendocino Gardens Problem -The District Attorney filed a complaint. The matter went to court and the property owner pled guilty. Absence of TET at airport - City Attorney explained the City' s airport is an uncontrolled airport. Landing and takeoff is left to the pilot' s judgment.
