HomeMy WebLinkAboutmin 12-07-77 357 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 71 1977 - PAGE 1 The City Council met at 7:31 p.m. in regular session with Councilmen Brannon, Wc,od, Feibusch, Councilwoman Snyder and Mayor Simpson present. - - INVOCATION & PLEDGE OF ALLEGIANCE Councilman Wood gave the Invocation and Councilwoman Snyder led in the Pledge of Allegiance. PAYROLL WARRANTS On a motion by Councilwoman Snyder, seconded by Councilman Feibusch it was carried by the following roll call vote to approve Payroll Warrants #12100 to #12267 inclusive in the total amount of $83 , 380. 10 for the period of October 30th to November 12 , 1977 , inclusive. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None GENERAL WARRANTS On a motion by Councilman Feibusch, seconded by Councilman ;good it was carried by the following roll call vote to approve General Warrant #7114 in the amount of $12, 468 . 41 AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None On a motion by Councilman Feibusch, seconded by Councilman Brannon it was carried by the following roll call vote to approve General Warrants #7115 to #7206 inclusive, in the total amount of $74,110. 31. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None APPROVAL OF MINUTES On a motion by Councilman Feibusch, seconded by Councilman Brannon it was carried by the following roll call vote to approve the Minutes of the November 16, 1977 , meeting as corrected. CONSENT CALENDAR Mayor Simpson requested that Agenda Item No. 7 be pulled and Councilman Feibusch requested that Agenda Item No. 2 be pulled from the Consent Calendar. On a motion by Councilman Wood, seconded by Councilwoman Snyder -�- it was unanimously carried to approve Agenda Item Nos. 1, 3,4 ,5,6 from the Consent Calendar as follows: No. 1. Direct the Clerk to file the required Notice of Completion for traffic signals, East Perkins & Orchard Avenue. No. 3. Adopt Resolution No. 78-47 authorizing agreement with County for election services for March 7 , 1978, election. No. 4. Award the bid for aluminum conductors to Bray Wholesale Electric Supply for $3,233. 80 plus tax, Consolidated Electric Service for $3,730. 27 plus tax, and General Electric Supply Company for $3, 022 . 32. No. 5. Award the bid for test wells to Weeks Drilling Company with the electro-log option in the estimated amount of $5200. 00. 358 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 7 , 1977 - PAGE 2 No. 6. Award the bid for taxicabs for City' s Dial-A-Ride System to Tri-County Checker Sales for two 8 cylinder model A-11 cabs in the total amount of $13, 622 . 98. DAMAGE ASSESSMENT OFFICERS APPOINTED On a motion by Councilman Feibusch, seconded by Councilwoman Snyder it was carried by the following roll call vote to appoint Director of Public Works Al Kruth for the public sector and Councilman Brannon for the private sector as Damage Assess- ment Officers; the Mayor to appoint an Alternate for Councilman Brannon, if the need. arises. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None COUNCILMAN WOOD EXCUSED HIMSELF FROM THE MEETING AT THIS TIME BID AWARD FOR POLICE VEHICLES TO STATE OF CALIFORNIA Three local bids were received with Stegemann Motors the low bidder in the amount of $19, 384. 00 including sales tax for 3 units. Through the cooperative purchasing arrangement with the State of California the total cost of these units including sales tax would be $17 , 406. 00. Budgeted funds available for this acquisition are $18 ,283. 00. If the bid were awarded to the low bidder, a budget transfer authorization would be necessary. City Manager recommended all bids be rejected and award t.-,.e bid to the State of California for the 1978 Dodge Monaco for a 360 cubic inch displacement engine in the amount of $17 ,406. 00. On a motion by Councilman Brannon, seconded by Councilwoman Snyder it was carried by the following roll call vote to award the bid for three 1978 Dodge Monaco vehicles with a 360 cubic inch displacement engine as recommended by the City Manager. AYES: Councilmen Brannon, Feibusch, Councilwoman Snyder, NOES: '_Mayor Simpson ABSENT: Councilman Wood COUNC=LMAN WOOD RETURNED AT THIS TIME - 7 : 47 P.M. HIGHLAND AVENUE Traffic Committee has considered the traffic problem which existed on Highland Avenue. Council considered the matter prior to this time and determined to make subject street one way. Residents in the area were present in the audience and stated problems they have experienced with the change and asked Council consider other solutions to the problem. The following persons spoke concerning the matter: Wm. H. A. Smith, 260 S. Highland Ave. Max Schlinger, 490 Highland Drive Mrs. Paul Elder, 495 S. Highland Avenue Ruell Stickney, 1 Highland Court Councilman Feibusch made a motion, seconded by Councilman Brannon to create a one way counter clockwise on Highland Drive and Highland Court and put a stop sign north bound on Highland Avenue and west on Clay Street. After discussion, Councilman Feibusch withdrew his motion. On a motion by Councilman Feibusch, seconded by Councilman Brannon it was unanimously carried to refer the matter to the Traffic Committee again and report back to Council. RESOLUTION NO. 78-48 ESTABLISHING USE FEES FOR RECREATION FACILITIES Councilwoman Snyder made a motion, seconded by Councilman MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CI'wx OF U*':,IH DECEMBER 7, 1977 - PAGE 3 Brannon to adopt Resolution No. 78-48, "Resolution Of The City Council Of The City of Ukiah Establishing Use Fees For City Recreation Facilities" . Council discussed the proposed $50 charge for use of,. the club house and determined a $40 fee to be adequate. Councilwoman Snyder withdrew her motion with the consent of the second. On a motion by Councilwoman Snyder, seconded by Councilman Brannon it was carried by the following roll call vote to adopt Resolution No. 78-48 , "Resolution of the City Council of the City of Ukiah Establishing Use Fees For City Recreation Facilities" , and change Line 12 to read as follows: "Municipal Club House: $40 per day or evening, for those events not open to the public" , AYES: Councilman Brannon, Councilwoman Snyder, Mayor Simpson NOES: Councilmen Wood and Feibusch. FEE FOR COUNCIL CHAMBERS WAIVED WORKERS' COMPENSATION APPEALS BOARD On a motion by Councilman Feibusch, seconded by Councilwoman Snyder it was carried by the following roll call vote to waive the fee for use of the Council Chambers as requested by the Division of Industrial Accidents-Workers ' Compensation Appeals Board in their letter of November 9, 1977 . AYES: Councilmen Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: Councilman Brannon ABSENT: None COUNCILWOMAN SNYDER APPOINTED TO BOARD OF DIRECTORS FOR CULTURE/RECREATION COMMITTEE On a motion by Councilman Feibusch, seconded by Councilman Brannon it was unanimously carried to appoint Councilwoman Snyder to serve as a member of the Board of Directors for the Culture/Recreation Committee. PETITION FOR ASSESSMENT DISTRICT (ORCHARD AVENUE AREA) Council had been provided with a petition from K. W. Hunt, Pulex Thomas, Alexander R. Thomas, and Ruel R. Stickney re- questing that an Assessment District be established in the Orchard Avenue, Clara Avenue area. Concern was expressed regarding the - storm drain facilities and a portion- of the January 14, 1976, Planning Commission minutes was read wherein the developer ' s commitment for drainage was set forth. It was explained that the plan is to assign costs only to those who benefit. On a motion by Councilman Wood, seconded by Councilman Brannon it was carried by the following roll call vote to approve the assessment district in concept with letters advising of previous obligations in this matter and direction to staff to prepare a proposal in final form for Council consideration at a. later date. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None 36.0 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CIT OP UKIAH DECEMBER 7 , 1977 - PAGE 4 , ADDITIONAL APPROPRIATION FOR VOLUNTEER BUREAU The Coordinator of the Volunteer Bureau was present in the audience to ask Council to support the Bureau out of revenue sharing or other city funds. The Bureau has been supported with a CETA allocation which will expire 12-31-77 . It was pointed out that all revenue sharing monies have been expended. A letter from the Senior Citizens Center supported the continua- tion of the program and the Mayor read a letter of support from Steve Prochter. - On a motion by Councilman Wood, seconded by Councilman Feibusch it was carried by the following roll call vote to contract with North Coast Opportunities to provide a Volunteer Bureau between January 1, 1978 and June 30, 1978 in an amount not to exceed $4000, said funds to come from General Fund monies. AYES: Councilmen Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: Councilman Brannon ABSENT: None RECESS - 9:22 P.M. RESOLUTION NO. 78-49 AMENDING PAY & CLASSIFICATION PLAN (ELECTRICAL ENGINEERING TECHNICIAN) On a motion by Councilman. (mood r se.conde:d, by Counctiman. Brannon it was carried by the following roll call vote to adopt Resolution No. 78-49, "Resolution Of The City Council of the City of Ukiah Amending The Pay and Classification Plan To Incorporate The Classification Electrical Engineering Technician" . AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder Mayor Simpson NOES: None ABSENT: None ' RESOLUTION NO. 78-50 APPROVING FINAL _ MAP (OAK MANOR UNIT #4 PHASE 2 Council discussion related to the drainage in subject sub- division. A request was made for a recorded easement so the City would be able to get equipment in to maintain the proposed storm drain. It was explained that Council places conditions on a tentative map, not a final map. On a motion by Councilman Wood, seconded by Councilwoman Snvder it was carried by the following roll call vote to adopt Resolution No. 78-50, " Resolution Of The City Council Of The City Of Ukiah Approving The Final Map For Oak Manor #4 , Phase 2" . AYES: Councilmen Brannon, Wood, Councilwoman Snyder, Mayor Simpson NOES: Councilman Feibusch ABSENT: None CITY ATTORNEY REPORTS OPINION ON ALLEGED CONFLICT OF INTEREST Subject opinion was requested by Councilman Feibusch and con- tained in a memorandum from the City Attorney dated December 6, 1977 . Councilman Feibusch' s letter of request dated November 21, 1977, asked if a conflict of interest existed when Planning COiYmission Chairman participated in Planning Commission decision concerning the extension of Main Street when he holds a deed of trust on property partially along the proposed extension. The City Attorney was of the opinion such action does not con- stitute a conflict of interest. 361 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UXIAH DECEMBER 7, 1977 - PAGE 5 On a motion by Councilman Brannon, seconded by Councilman Wood it was carried by the following roll call vote to accept the City Attorney- Opinion dated December 6, 1977 . AYES: Councilmen Brannon, Wood, Mayor Simpson NOES: Councilman Feibusch ABSENT: None Councilwoman Snyder did not vote since she had been on emergency leave. APPOINTMENT TO ADVISORY COMMITTEE CRIME PREVENTION AND AWARENESS On a motion by Councilwoman Snyder, seconded by Councilman Brannon it was unanimously carried to appoint Darwin Richardson to the Advisory Committee on Crime Prevention and Awareness. NEXT COUNCIL MEETING CANCELLED Council determined there would be no meeting December 21st. Councilman Feibusch will review the Payroll Warrants and pull any not routine. Said warrants will be considered January 4 , 1978 . COUNCILMAN BRANNON Held-Poage Museum - When does the City intend to pick up the firefighting equipment at the museum. The City Manager will take care of the matter. COUNCILMAN WOOD City Parking Lot ' Asked that the report from the Parking Advisory Commission concerning the proposed fees on subject lot on Standley be agendaed for Council consideration the second meeting in January. COUNCILMAN FEIBUSCH Coat Hooks in Council Chambers - A need expressed for coat hooks and question regarding the ones that were in the Council Chambers prior to the remodeling. Flag on City Hall Building - The flag has not flown on the building in several months. City Manager will check into the matter. COUNCILWOMAN SNYDER Request for Litigation Session after meeting. MAYOR SIMPSON Groundbreaking Ceremony-Fire Station - Attended ceremony this week. Crime Prevention Program put on by the Police Department with officer from Attorney General office and District Attorney. Merry Christmas expressed to everyone. ADJOURNMENT Mayor Simpson adjourned the meeting at 10:20 p.m. after which the Council reconvened to Litigation Session. ATTEST: Mayo City Clerk
