INVOCATION & PLEDGE OF ALLEGIANCE Mayor Simpson gave the Invocation and Councilman Brannon led in -. the Pledge of Allegiance. PAYROLL WARRANTS On a motion by Councilman Feibusch, seconded by Councilwoman Snyder it was carried by the following roll call vote to approve Payroll Warrants #101 to #252 inclusive in the total amount of $84 ,953. 84 for the period of December 25, 1977 to • January 7, 1978, inclusive. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None ' GENERAL WARRANTS On a motion by Councilwoman Snyder, seconded by Councilman Brannon it was carried by the following roll call vote to approve General Warrants #7472 to #7571 inclusive in the total amount of $118,923.68. AYES: Councilmen Brannon,Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None' APPROVAL OF MINUTES ' .On a motion by Councilman Wood, seconded by Councilwoman Snyder it was carried by the following roil call vote to approve the Minutes of the regular meeting of January 18, 1978 as submitted by- the Clerk. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: Nora CONSENT CALENDAR On a motion by Councilman Feibusch, seconded by Councilwoman Snyder it was carried by the following roll call vote to approve Consent Calendar Items #1 to #5 inclusive as follows: 1.� Set February 15, 1978, as public hearing date-*f©r elimination Of C-M zoning (Zone Change Application No. 78-50) . 2) Adopt Resolution No. 78-60, "Resolution Of The City Council Of The City Of Uriah Authorizing Mayor To Sign OCJP Grant Application And Award" . 3) Adopt Resolution No. 78-61, "Res6lution Of The City Council Of The City Of Ukiah Appointing Members To Cultural Arts -- ' Commission". 4) Adopt Resolution No. 78-62, "Resolution Of The City Council Of The City Of Ukiah Appointing Election Officers" . 3) Adopt Resolution No. 78-63, - "Resolution Of The City Council Of The City Of Ukiah Authorizing California Department Of General Services To Purchase Vehicles". . ---- ----:-AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson -DOES: None ABSENT: None ` _ 4 ; r7 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH FEBRUARY 1, 1978 - PAGE 2 RESOLUTION NO. 78-64 AUTHORIZING LAND RENTAL AGREEMENT UKIAH FLYING SERVICE, INC. . Councilwoman Snyder made a motion, seconded by Councilman Wood to adopt Resolution No. 78-64 , Resolution Of The City Council Of The City Of Ukiah Authorizing Mayor And Clerk To Sign Land Rental Agreement (Ukiah Flying Service, Inc.) " . Councilman Feibusch stated the $2 fee referred to in the agreement is not sufficient in his opinion. Mr. Dick Sarber, Ukiah Flying Service was present in the audience and stated an increase in subject fee would not give enough profit to warrant having the business. Councilman Feibusch amended the motion, seconded by Councilwoman Snyder to include submitting to the City a gross revenue report for the following year. The motion carried by the following roll call vote: AYES: Councilmen Brannon, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: Councilman Wood ABSENT: None The motion to approve as amended carried by the following roll call vote: AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Simpson, Mayor Simpson NOES: None ABSENT: None BUDGET TRANSFER AUTHORIZATION RAINCOATS FOR, CROSSING GUARDS On a motion by Councilman Feibusch, seconded by Councilman Brannon it was carried by the following roll call vote to approve Budget Transfer Authorization as requested by the Director of the Volunteer Bureau as follows: From Account- 100 1990 $100 to Account 100 1990 690 $100 AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder Mayor Simpson NOES: None ABSENT: None APPROVAL OF WORK AUTHORIZATION POWER PLANT AT COYOTE DAM TUDOR ENGINEERS On a motion by Councilman Wood, seconded by Councilman Brannon it was carried by the following roll call vote to approve work authorization to Tudor Engineers for preparation of preliminary application for license to develop power at Coyote Dam for a total fee not to exceed $2500 plus a filing cost fee of $1300- $1980 to be provided to the Division of Water Rights. AYES: Councilmen Brannon, Wood; Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None AL KRUTH APPOINTED TO SOLID WASTE STEERING COMMITTEE On a motion by Councilman Feibusch, seconded by Councilman Brannon it was unanimously carried to appoint the Director of Public Works to the 12 member Solid Waste Steering Committee and the Deputy Director of Public Works to be appointed as the Alternate to this committee. 37.6 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF.•UKIAH FEBRUARY 1, 1978 - PAGE 3 ADOPTION OF ORDINANCE NO. 705 AMENDING CODE BY REZONING PROPERTY FROM C-2 TO C-1 (ZONE CHANGE APPL. NOS . 78-37 & 78-47) On a motion by Councilman Simpson, seconded by Councilman Brannon it was carried by the following roll call vote to adopt subject ordinance by title only. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None On a motion by Councilman Brannon, seconded by Councilman Wood it was carried by the following roll call vote to adopt Ordinance No. 705, "Ordinance Of The City Council Of The City Of Ukiah Amending Chapter 2 , Division 9 Of The Ukiah City Code By Rezoning Property From Existing C-2 Zone, To C-1 (Zone Change Application Nos. 78-37 and 78-47) AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None INTRODUCTION OF ORDINANCE NO. 706 CULTURAL ARTS COIUIISSION On a motion by Councilman Wood, seconded by Councilwoman Snyder it was carried by the following roll call vote to introduce Ordinance No. 706 by title only. AYES: Councilmen Brannon, Wood., Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None On a motion by Councilman Wood, seconded by Councilwoman Snyder it was carried by the following roll call vote to introduce Ordinance No. 706 , "An Ordinance Of The City Council Of The City Of Ukiah Amending Sections 1021 and 1022 Of The Ukiah City Code- Cultural Arts Commission" . AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None PRESENTATION BY BLIND/DISABLED ACTION CENTER A slide presentation was shown by the Blind/Disabled Action Center. The hazards these citizens encounter each day were presented and related to ramps at intersections, parking spaces for the physically handicapped being used by those other than handicapped, and trees and signs placed in the middle of sidewalk areas all of which create problems to the blind and disabled. Bob Kuder, the director for subject center asked for Council rep- resentation on the Center's board to look at some of these problems in further detail. • Councilman Brannon made a motion, -seconded by Councilman Wood to - direct the City Manager to designate an individual from the appropriate department to serve on subject committee. Councilman Feibusch amended the motion, with the consent of the maker to have someone from the private sector and a representative from the public sector to serve on subject committee. The motion as amended carried by the following roll call vote: AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH FEBRUARY 1 , 1978 - PAGE 4 PRESENTATION BY UKIAH VALLEY TEEN CENTER ' Allanya Guenther was present in the audience to thank Council for help provided in the past and to advise how the program is going. Two additional CETA positions are available and the request was for the City to provide payroll services to begin in two weeks M_ and run through June of this year. Nancy Heeley, Director for the Teenage Center was also present in the audience and summarized a report which had been provided Council showing how more interest has been generated and enroll- ment increased. On a motion by Councilman Brannon, seconded by Councilman Feibusch it was unanimously carried to payroll two CETA positions through June 1978. PRESENTATION BY LEAGUE OF WOMEN VOTERS RE PUBLIC TRANSPORTATION IN MEMDOCINO COUNTY Mrs. Nancy Verville, President of the League of Women Voters of Ukiah presented a study its members participated in for a period of two years reaching a consensus to support the continua- tion of the public -transportation system in Mendocino County. MAYOR SIMPSON DECLARED A RECESS AT THIS TIME - 8:55 p.m. RESOLUTION NO. 78-65 AMENDING - PERSONNEL POLICIES (VACATION LEAVE) Council had asked for additional information on subject matter. ^.n__.. City Manager explained background conditions of the existing policy. Councilman Wood made a motion, seconded by Councilman Brannon to adopt Resolution No. 78-65. Councilman Feibusch stated a major review of the Personnel Policies was in order. City Manager indicated the intent is to review said policies after the city election- next month. Questions were asked how the meet and confer sessions are conducted with Union representatives. City Manager indicated he would expect Council direction prior to negotiations with the union representatives. The motion to adopt Resolution No. 78-65 carried by the following roll call vote: AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson .NOES: None ABSENT: None TPA APPLICATION FOR SB325 FUNDS TO MAIN STREET PROJECT On a motion by Councilman Brannon, seconded by Councilwoman Snyder it was carried by the following roll call vote to approve a revised application for SB 325 funds in the amount of $11,158.47 for the Main Street project. Said amount represents the amount of accrued interest on previously allocated funds. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None _ABSENT: None 91r MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH FEBRUARY 1, 1978 - PAGE 6 REVIEW OF WATER RATES Councilwoman Snyder requested subject matter be scheduled for review. Councilwoman Snyder made a motion to consider revising the water rates by decreasing to the previous rate which should increase water use and revenue as well. The motion died for lack of a second. PROPOSED SELF-INSURED RETENTION PROGRAM City Manager reported the insurance broker has been attempting to place above named coverage. The proposed program was out- lined for Council consideration. On a motion by Councilman Wood, seconded by Councilman Brannon it was unanimously carried to place on the agenda consideration of the City' s liability insurance program. On a motion by Councilman Brannon, seconded by Councilman Wood it was carried by the following roll call vote to accept the proposed self-insured retention program submitted by Stocklmeir Insurance in the total amount of $88 ,721 dated January 31, 1978, AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None BUDGET TRANSFER AUTHORIZATION SELF-INSURED RETENTION PROGRAM On a motion by Councilman Feibusch, seconded by Councilman Brannon, it was carried by the following roll call vote to authorize the following budget transfer: From Acct. General Fund $47,000 To Account 100 1990 154 $47,000. AYES: Councilmen Brannon, Wood, Feibusch, Councilwoman Snyder, Mayor Simpson NOES: None ABSENT: None MAYOR SIMPSON Redwood Empire League of California Cities - Subject meeting was held in Healdsburg and Mayor Simpson gave a report. MTA - Meeting will be held to discuss the structure of the MTA Board in the future. A new JPA will be coming to Council at a later date. ADJOURNMENT Mayor Simpson adjourned the meeting at 10:40 p.m. and reconvened in Personnel Session. After the Personnel Session, Council again reconvened in open session and took the following action. SETTLEMENT OF CLAIMS - JOSEPH ZIRBES On a motion by Councilman Brannon, seconded by Councilman Wood it was unanimously carried to offer $7 ,000.00 as settlement of claims of Joseph Zirbes. y 7 ATTEST: 'Mayor City C1 r
