it was carried by the following roll call vote to approve
Payroll Warrants 111376-41550 inclusive for the period of

APPROVAL OF VARIANCE APPLICATION
NO. 78-70 (CLARE HOLMES , 700 WALNUT)
Applicant requests variance from front setback requirement to
allow construction of entrance way on property line.
Planning Commission recommended approval subject to curb and
gutter, but not sidewalk, to be installed along the. Spring
Street frontage. ' City Manager recommended approval, with
installation of sidewalk as a condition.
Councilman Hickey made a motion, seconded by Councilman Myers
to approve subject application as recommended by the City
r4anager..
Councilman Hickey withdrew his motion, with the approval of
the second.
Councilman Hickey made a motion, seconded by Mayor Brannon
to approve subject application as recommended by the Planning
Commission.
Applicant spoke on subject matter and presented to Council
a petition with 150 alleged signatures . A letter from the
Blind and Disabled Center was read requesting that the side-
walk area remain as is. Franklin Offel also spoke alleging
the Planning Commission .is not applying the curb, gutter, and
sidewalk requirement uniformly with all applicants .
Mayor Brannon made a motion, seconded by Councilman Simpson
to approve subject application as recommended by the Planning
Commission with the amendment that sidewalk be completed on
the remaining portion of Walnut on which the lot fronts.
The amended motion carried by the following roll call vote :
AYES : Councilmembers Hickey, Simpson, Mayor. Br:annon
NOES: Councilman Myers
ABSENT: Councilwoman Snyder
The motion to adopt Resolution No. 78-109 , "Resolution Granting
