13) Resolution directing abatement Public hearing opened - 7 : 45 p.m.
of weeds, rubbish, refuse & dirt Ray Jordon, 474 N. Oak registered
on parcels of land a complaint regarding the property
at 487 N. Oak which was grown up
with weeds alleging it to be a
fire hazard. It was explained
that City is aware of this particular nuisance and it will be high
on the priority list to abate.
Vivian Young asked why parcels can' t be cleaned while the weeds are
green. It was explained to her that the responsibility is that of
the owners and that time element is a factor in this process.

Russell Clarke letter (cont'd. ) Mr. Clarke feels this condition
is unreasonable and asks Council
to delete it from the conditions
set by the Planning Commission.
Bill Beard, Assistant Director of Public Works reviewed the history
of the proposal and stated it is consistent with requirements made
of other businesses on Talmage Road.
Mr. Clarke spoke and stated he had requested a use permit at a prior
time for an addition to the existing Bottle Shop and at that time a
right of way dedication was to be placed on the use permit. He
objected to giving land to the City as a pre-requisite for a use
permit and considered this extortion. He stated it appears that the
City has no definite plans to widen Talmage. It could be years before
the street is widened. He stated when street widening negotiations
with the State begin is the time to deal with the right of way matter.
Council pointed out the proposed dedication requirement would not in
any way deprive Mr. Clarke use of the land as it pertains to ingress,
egress and parking. It was also pointed out that the City will pro-
vide curb, gutter and sidewalk at such time as the street is widened.
Council has become more sensitive to traffic flow problems and proper
arterial streets are a necessity and plans must be made to prepare for
such eventuality in a way that is most equitable for all.
City Manager pointed out it is important that Council determine a
policy with respect to new developments from this time on. If it
is determined that the City will buy right of ways, then should money
be, reimbursed to those property owners who have given right of way
to the City?
M/S: Brannon/Hickey to require the dedication of property from
Mr. Clarke as recommended by the Planning Commission and at the time
Talmage Road is widened, the City will provide curb, gutter, and
sidewalk. In the interim, an encroachment permit will be issued to
Mr. Clarke to cross subject area. Carried by roll call vote:

Councilman Hickey Drilling has started on the RFL
site for NCPA in Lake County.
Should be first steam well
developed within the next 2-21-2-
months.
Councilman Myers Will be out of town at the Jul
18th meeting. y
Councilman Brannon Where do we stand on purchase of
the Smith property? This will be
covered in Litigation Session at
the end of the meeting.
Several months ago Council determined that matters within the Parking
District should be passed through the Parking Advisory Commission.
Has the parking variance for the Telephone- Company been calendared
- - before the Parking Advisory Commission?
ayor Snyder It has been brought to my attention
by Planning Commission members
that the Planning Comrission does
not have a set of procedures. Would it be advisable to provide the
Commission with a copy of Council procedures which may provide a means
to shorten the length of their meetings. Each commission should set
its own procedures, but if they are not effective, Council could give
suggestions.
Council determined the next budget hearings would be 6-21, 6-25, 6-26
at 4: 00 p.m. each date.

Ted Feibusch Asked if he could attend the Liti-
gation Session since he and Clyde
Oakes had been a part of the nego-
tiations on the Smith property. City Attorney advised Council may
invite who they choose.
M/S: Brannon/Hickey that inasmuch as Ted Feibusch is a member of the
Parking Advisory Commission, he may participate in the Litigation
Session as it relates to the Smith property. Carried unanimously.
