CITY COUNCIL OF THE CITY OF UKIAH
BANK OF AMERICA PUBLIC HEARING CONTINUED
July 19, 1984
The City Council reconvened in regular session at 1:00 p.m. , July 19, 1984, in
the City Council Chambers to continue discussion regarding the Public Hearing
concerning the Bank of America's appeal of the Planning Commission's Denial of
Sign Variance Application No. 84-74.
Mayor Myers and all Councilmembers were present.
The City Attorney reported he had reviewed the Sign Ordinance in its entirety.
He reviewed sections 3233 d) , 3200.55 which provides a definition of the term
sign, and 3200.58 which provides a definition of the term sign structure for
the City Council. He interpreted these sections to mean all signs or sign
structures associated with a business shall be made to conform to the City
Sign Ordinance upon sale or transfer of said business, change of business name
or other situation requiring modification to the face or message of a sign or
sign structure. He stated, in his opinion, the proposed modifications by the
Bank of America would be required to conform in the absence of a variance.
LaVell Lott, Young Electric Sign Company, 1148 South 300 West, Salt Lake City,
Utah requested the City Attorney clarify the meaning of section 3233 d) which
declares if the only change is the sale or transfer of the business, said sign
shall be removed upon the expiration of one year from the date of said sale or
transfer.
The City Attorney responded by explaining if the only change is the sale or
transfer of the business, there is a one year amortization period provided.
Upon the change of name or sale you would be given one year to bring the sign
into conformity; whereas, if you want to change the sign or sign structure you
are not given the amortization period.
M/S: Hickey/Kier to grant Sign Variance Application No. 84-74 based upon the

grounds the sign is intended to serve two streets (Main and State Streets)
from the location which it stands. In that Council would not be granting any
particular favor to Bank of America because other properties have the same
signage and frontage problem. That architectural consideration be given to
the existing sign structure and the directional signs be brought into
conformance.
Discussion was had regarding the existing Sign Ordinance and the procedure for
reviewing and modifying the ordinance.
The motion was defeated by the following roll call vote: AYES: Councilmembers
Kier and Hickey. NOES: Councilmembers Henderson, Kelley and Mayor Myers.
ABSENT: None.
ADJOURNMENT
There being no further business the meeting was adjourned at 1:28 p.m.
