Mayor Myers stated he feels this project would be an asset to the City of Ukiah and for the monetary investment a fail-safe project. The motion carried by the following roll call vote: AYES: Councilmembers Henderson, Kier, Hickey, Kelley and Mayor Myers. NOES: None ABSENT: None M/S: Henderson/Kier to adopt Resolution No. 85-34 of the City Council of the City of Ukiah authorizing the City of Ukiah to enter into an agreement estab- lishing the Transmission Agency of Northern California (TANC), a Joint Powers Agency. The motion carried by the following roll call vote: AYES: Councilmembers Henderson, Kier, Hickey, Kelley and Mayor Myers. NOES: None ABSENT: None. MATTER OF CITY CLERK Mayor Myers stated the matter of City Clerk is being brought up for discussion only so issues concerning the office can be reviewed and, if necessary, give direction to staff prior to the COuncil meeting of December 5. He gave a brief summary as to what has happened to the office since the resignation of the prior City Clerk, Hattie Tillotson, i.e., the appointment of the City Manager as City Clerk; the voters wanting an elected City Clerk; no one applying for the office; low salary; appointment and resignation of Faye McAfee; the present City Manager's Secretary not living in the City and unable to run for office. Some of the issues that he feels should be reviewed are salary, job descrip- tion, and whether the office should be appointed or elective. He stated that he had asked the City Attorney to review two points: Could the appointment be for a two year term rather than for the four year term. The conclusion was that it could not. The second: Could the City Clerk and the City Treasurer's office be combined. The conclusion was yes, if there was no incompatibility of assignments. Acting City Attorney Marston felt there would not be any problems with this arrangement. Discussion continued regarding how much time is invested in the City Clerks duties, what those duties are, the purpose and intent of the office, or will it be a figurehead position with a deputy performing the work. Hazel Byrd, 980 Dominican Way stated she had voted no when the Measure of City Clerk was placed before the voters at the June election, as she thought it an insult to offer anyone $40 a month. She felt the position should be structured, should be an independent position and should be put up for public election. After further discussion by Council it was the general consensus that the office of City Clerk should be filled by election. A decision to call a special election or appointing to the office must be made 30 days after the November 6, election. The City Attorney's office was directed to explore all requirements necessary to hold an election and have that information available for the Council meeting of December 5. Councilmembers Henderson and Kier will work together to prepare a draft of job requirements that Council will feel comfortable with and bring them back to Council at the next meeting. No further action was taken. Church Street Ukiah, CA 95482 SPECIAL MEETING November 19, 1984 The City Council convened in special session at 12:00 noon in the City Council Chambers. Roll was taken and the following Councilmembers were present: Henderson, Kier, Hickey, Kelley and Mayor Myers. Absent: None. Staff present: Payne, Roper, Marston, Stamelos and Titlow as Acting Recording Secretary. The City Council met in Special Session to discuss a resolution to authorize the City of Ukiah's participation in a Joint Powers Agency and to review the matter of the office of City Clerk. The City Manager gave a brief report regarding the Joint Powers Agency. He stated that in August of 1984 the Federal Congress passed a law authorizing the Secretary of Energy to construct a new Intertie between California and the Pacific Northwest. The Secretary of Energy must report back to Congress within 120 days after passage of the law and he has determined that the JPA be in place at the time of his report. The City Manager feels having access to this relatively inexpensive Pacific Northwest Energy would be a significant act for the City of Ukiah and will pay substantial rewards in the future. The participation in the Joint Powers Agreement will create the Transmission Agency of Northern California (TANC). The agreement has been executed by SMUD, Santa Clara, Redding, Modesto Irrigation District, Turlock Irrigation District, and now needs to be executed by the ten inter-connected NCPA cities. The NCPA cities share will be 10.7%, Ukiah's share is now established at .469% and will allow Ukiah 2.1 to 3.3 megawatts of transmission. The maximum obligation under the JPA agreement per year would be less than $250. Other costs may incur if NCPA is hired to study certain aspects of transmission. He stated the potential rewards for the City outway any risks by becoming a participant in the JPA. Ail agencies are protected, as any additional expend- itures above the JPA amounts will be required to be reviewed and approved by the participating members governing body before approval. There was lengthy discussion held by Council regarding the percentage Ukiah would obtain, megawatts available, financing, total cost, etc. Councilmember Kelley stated that he felt the project was a good one. He wanted some clarification on the percentage the City would have. This was explained by the use of exhibits. Councilmember Kier stated that the Northwest has cheaper energy, and an abundance, and by securing access through the JPA the City is still maintain- ing transmission. The question of other agencies tieing into Ukiah's trans- mission line was brought up. It was stated that all agencies will be owners of the transmission line, including PG&E. Mayor Myers requested clarification on NCPA's role in the Joint Power Agree- ment, stating that a Joint Power Agency cannot be a member of another Joint Power Agency. The City Manager stated each agency will have specific rights and specifically a JPA could not join a JPA. At some point NCPA could represent the City, but the City would still be a member of JPA. However, he recommended that Ukiah be individually represented even though we have only less than a half a percent. There is the possibility in the future that NCPA could handle the dispatching, and be paid for it, or the City can seek the cheapest available power in the Northwest and make purchases. The Resolution was reviewed by Mayor Myers and discussion was had on the individual that would represent the City for the JPA.
