UNFINISHED BUSINESS
3a. Receipt of Architect Proposals and Determine Selection Process - Civic
Center
Mayor Myers presented Council with the choice of interviewing applicants or
appointing an interview board.
After discussion by Council it was determined to screen the RFP's for
architectural service at the meeting, then set a date for the entire Council
to interview the remaining applicants.
Due to a prior commitment Councilmember Henderson excused herself from the
meeting at 1:08 p.m.
It was determined that Council would interview the following local applicants:
Robert Schlosser, Michael Leventhal & Associates, Kappeler & Axt and Victor
Lopes. In addition, the following firms will be interviewed by Council:
Raymond Abst & Associates, Lawry Coker & DeSilva and Roland/Miller &
Associates.
Councilmember Henderson returned at 1:17 p.m.
Council set the date of January 10, 1985 at 11:00 a.m., to determine standard
questions and procedures to follow during the interviews. The interviews will
begin at 1:00 p.m., and be 45 minutes in duration with a 30 minute
presentation and 15 minute discussion. Interviews will be conducted at a
special City Council meeting open to the public, which will be announced at
the regular January 2, 1985 meeting.
CLOSED SESSION
Adjourned into Closed Session at 1:30 p.m. to discuss litigation.
ADJOURNMENT
There being no further business the City Council adjourned at 1:40 p.m.

thereof and adding new articles and sections to Division 4, Chapter 2
establishing a new system of sewerage requirements and charges, with the date
of April 1, 1985 as the effective date, carried by the following roll call
vote: AYES: Councilmembers Henderson, Kier, Hickey and Mayor Myers. NOES:
Councilmember Kelley. ABSENT: None.
Councilmember Hickey asked if it was taken into consideration the fact that
the schools would be idle part of the year.
The Director stated that it was, and that the rate structure was fair and
equitable. The fixed costs of the sewerage system means the service is there
whether there is a summer session or not. The Study results falls within the
State's guideline.
The City Attorney stated the basis for charging schools on a 12 month schedule
(as opposed to nine and one half months) is that the system cost is fixed at
12 months, and it is the capacity to meet their needs while in session that
justifies charging those costs year round.
Mayor Myers reminded the Council that Federal funds have not been released to
the City, and will not be until a more fair and equitable way of charging
sewer services is established. This item has been before the City Council
since June of this year and he feels this is a working compromise. If
commercial users are charged less than residential, and more revenue is not
generated, there will be a need to revise the rate. He stated the proposed
rates appear to be fair.
Councilmembers discussed the need to establish a typical winter month for the
School District; whether reviews should be completed before, not after, the
ordinance is passed; and whether "typical winter month" applies to the Ukiah
Unified School District only, or to all the schools in service.
ii. Adoption of Resolution No. 85-42 Showing Change of Effective Date
M/S: Hickey/Henderson moved adoption of Resolution No. 85-42 establishing a
Sewer Service Charge and repealing former Resolution No. 85-35 with the
effective date of April 1, 1985, carried by the following roll call vote:
AYES: Councilmembers Henderson, Kier, Hickey and Mayor Myers. NOES:
Councilmember Kelley. ABSENT: None.
iii. Matter of Reviewing
M/S: Henderson/Hickey to approve a review of actual charges based on increment
use rather than on the rounding basis on July 1, 1985, carried by the
following roll call vote: AYES: Councilmembers Henderson, Kier, Hickey,
Kelley and Mayor Myers. NOES: None. ABSENT: None.
iv. Matter of Schools Typical Winter Month of Water Usage
The Public Works Director informed the Council that the School District is in
a commercial category; however, there is flexibility in the ordinance making
it possible for staff to work with schools on a "typical winter month", and an
appeals process is written into the ordinance. Mayor Myers pointed out the
intent of the Sanitary District Board was to include the Community College in
the review of a typical winter month of water usage.
There was discussion whether "Schools" included the Community College District
and other schools in the area; if schools were being shown special interest,
and that staff would determine what a typical winter month is to be.
M/S: Henderson/Kelley to approve the meeting of Staff and the School District
to establish an appropriate winter month of water usage for their facilities,
carried by unanimous voice vote.
Friendly Amendment
With the approval of the maker of the motion, the word "District" was made
plural and changed to "District's".

SPECIAL MEETING
December 12, 1984
The City Council convened in special session at 12:05 p.m. in the City Council
Chambers. Roll was taken and the following Councilmembers were present:
Henderson, Kier, Hickey, Kelley and Mayor Myers. Staff present: Rapport,
Goforth, Harris, Pedroncelli, Stamelos and Acting Recording Secretary Johnson.
PUBLIC HEARING
2a. Matter of Sewer Service Charges
i. Adoption of Ordinance No. 845 - Establishing a New System of
Sewerage Requirements and Charges
Mayor Myers reported that the Sanitation District Board, at the meeting held
December 12, 1984, at 9:00 a.m., accepted and introduced District Ordinance
No. 12, establishing a new system of sewerage requirements and charges. The
only change in the ordinance was the effective date for the charges which will
be April 1, 1985. The Board approved the ordinance as written with the
condition that the upward rounding off of water usage and its effect on
renewal be reviewed through computer analysis for review once again in July.
The Director of Public Works reviewed the steps to be taken in order to adopt
the Sewer Ordinance.
1. Change effective date of the ordinance to April 1, 1985 (instead of "30
days after its passage").
2. Approve Resolution No. 85-42, which shows April 1, 1985 as the effective
date, and repeals Resolution No. 85-35.

Staff to review, and report to the City Council by July 1, 1985, on a
re-examination of actual water usage by commercial customers as relates
to the rounding effect now contained in Section 3707.4 of the proposed
Ordinance.
PUBLIC HEARING OPENED: 12:14 p.m.
William Brown, representing the Community College District, stated there was a
resolution passed by the Sanitation Board that directed staff to work with the
school districts for the applicable months average, rather than November.
Jack Daniels, representing the Ukiah Unified School District, stated that as
part of the review process the nine and one half months versus twelve months
usage should be addressed, and that usage should be based on demand. He
stated he felt that the School District did not have enough time to review the
ordinance.
PUBLIC HEARING CLOSED: 12:17 p.m.
Mayor Myers gave a brief report on the Sanitation Board meeting stating that
there will be a total of three public hearings by the Sanitation District
Board and in his view, this provides adequate review time. The District Board
chose April 1, 1985, as the effective date for the Ordinance to go into
effect.
M/S: Henderson/Hickey to adopt Ordinance No. 845 by title only, carried by a
unanimous voice vote.
M/S: Hickey/Henderson to adopt Ordinance No. 845 of the City of Ukiah
repealing portions of Articles 1 through 8, Division 4, Chapter 2 of the Ukiah
Municipal Code, repealing and/or renumbering portions of Sections 3700-3779
