SPECIAL MEETING
January 10, 1985
The City Council convened in special session at 11:00 a.m., in the City
Council Chambers. Roll was taken and the following Councilmembers were
present: Henderson, Kier, Hickey, Kelley and Mayor Myers. Staff present:
Payne, Rapport, Harris, Stamelos and Acting Recording Secretary Titlow.
Mayor Myers stated the meeting is being held for the review of architectural
proposals and the interviewing of architects for the Yokayo site.
At 11:05 a.m. Mayor Myers called for a closed session. He stated two topics
would be discussed: 1) land acquisition of the Yokayo site, and 2) litiga-
tion, City of Ukiah vs. the County of Mendocino.
The meeting reconvened at 1:07 p.m.
REVIEW OF PENDING LITIGATION
M/S: Hickey/Kelley to authorize Mayor Myers to send a letter to the County
Planning Department in response to their request for funds for a gravel study
inquiry, containing the following points:
The City Attorney stated the letter will be in response to a letter from the
County Planning Department requesting that the City contribute financially
toward a gravel study. This is the second request made by the County.
The letter would point out that the City has expended approximately $10,000 in
legal fees, litigation expenses and expert witness fees on litigation current-
ly pending. The City is willing to contribute an additional $10,000 toward a
gravel study, making the City's total contribution $20,000. As there is
litigation between the City and County it would be to the advantage of both
parties to do this study in a timely manner as additional legal costs may
reduce the amount of cash contribution.
The letter would suggest alternative forms of payment, i.e., that the County
consider imposing a surcharge on gravel permits based on the cubic yards of
gravel authorized for extraction. The City would point out that by us using
and paying for gravel we would in addition to the $10,000 already spent, be
indirectly paying toward the gravel study. The City Attorney went on to point
out that the City's position and interest in this matter is as a water company
or a provider of water and by acting in this capacity it is representing its
water customers.
Mayor Myers emphasized the additional $10,000 meets the County's request of
20% for cost sharing for the gravel study.
Motion carried by the following roll call vote: AYES: Councilmembers
Henderson, Kier, Hickey, Kelley and Mayor Myers. NOES: None. ABSENT: None.
LAND ACQUISITION
Mayor Myers reported the Council discussed negotiations for the purchase of
the Yokayo site from the Ukiah Unified School District. He stated the Ukiah
City Council has received a counter offer from the Ukiah Unified School
District in regards to the purchase of the Yokayo Site and a response will be
made to the Ukiah Unified School District Board. It was the consensus of
Council that they allow the School District Board the opportunity to review
and respond to the City's response prior to disclosing the content.

PUBLIC SESSION:
Judy Pruden, 304 S. Hortense, ask if she could question the architects that
are to be interviewed.
Mayor Myers stated that the Council would ask questions of the architects but
was open to Ms. Pruden's suggestions. He reviewed questions that would be
asked of the applicants and commented that the interviews would be as flexible
and open as possible.
Ms. Pruden commented on items she would like addressed by Council.
Councilmember Henderson asked about fees on the project and if negotiations
would be done at a later date.
The City Manager explained that in the past Council chose the architectural
firm and then directed staff to negotiate the contract and the contract was
then brought back to Council for approval. He pointed out that the firm
chosen should be willing to establish their fees based on project phases.
The City Attorney ask to be excused and left the meeting at 1:23 p.m. The
Deputy City Clerk and Recording Secretary were excused at 1:25 p.m.
Interviews proceeded with the following architectural firms:
1. Raymond Abst & Associates
2. Lawry, Cober & DeSilva
3. Roland/Miller & Associates
4. Kappeler & Axt
5. Schlosser, Leventhal & Associates
6. Victor Lopes
Discussion was held by Council regarding the interviews.
M/S: Kelley/Hickey to authorize the City ~fanager to negotiate a contract with
Victor Lopes for architectural services pending acquisition of the Yokayo
property, carried by the following roll call vote: AYES: Councilmembers
Henderson, Kier, Hickey, Kelley and Mayor Myers. NOES: None. ABSENT: None.
CLOSED SESSION
Adjourned into closed session at 6:14 p.m.
ADJOURNMENT
There being no further business the meeting was adjourned at 6:30 p.m.
