CITY COUNCIL MINUTES
SPECIAL MEETING
March 7, 1988
The City Council convened in a special meeting at 9:00 a.m., in the Council
Chambers at the Civic Center, 300 Seminary Avenue, Ukiah, California. Roll
was taken and the following Councilmembers were present: Shoemaker, Myers,
Hickey, Schneiter, and Mayor Henderson. Staff present: City Manager Payne,
City Attorney Rapport, Fire Chief Mitchell, and City Clerk Hayes.
UNFINISHED BUSINESS
2a. Matter of Contract Discussions - Ukiah Valley Fire Protection District
(UVFPD)
The Mayor discussed the disputed issues.
The City Manager explained the fire protection contracted for over the years.
The Fire Department's budget is 1.2 million dollars, the fee for contract
should take into consideration the population in the district which is greater
than the cities population, the square miles in the district which are
approximately ten times more than the City, and the assessed property values
which are approximately equal. Because of those factors the UVFPD's fee
should be 50% of the Fire Department's budget, six hundred thousand dollars.
Councilmember Schneiter reviewed the Ad-Hoc Committee's meetings.
disputed issues were addressed by the following:

The $48,500 be credited to the UVFPD's first year payment.
There be a flat fee for service.
The fourth year's fee be an assessed value that could be 2% more
than the third year's fee but annexations could have occurred and
those detachments could lower the fee.
The ownership of Fire Station #2 was discussed and noted that due to the City
Attorney's opinion, the City remains steadfast that the UVFPD has no interest
of ownership in such. The City's representatives were looking for a long term
contract with an equable fee schedule throughout the negotiations. Further,
the representatives proposed that a review board be established, to meet on a
regular basis and discuss issues of concern. The last offer presented was a
flat fee for service and no ownership in the North Fire Station #2.
1st. year - $285,000
2nd. year - $310,000
3rd. year - $335,000
4th. year - an assessed valuation could be 2% more than the third year
but if annexations had occurred, fee could be lower.
Councilmember Schneiter explained that the offer has been rejected by the
UVFPD. He believes the board is making the decisions for their level instead
of representing the best interest of the district as a whole. Further the
administrative issues still remain disputed. The representatives suggested
that those be postponed and discussed throughout the coming year; that was not
accepted.
Discussion ensued regarding how the City has tried to continue the
negotiations, offered a one-year contract extension, and is willing to talk if
the Fire District wishes.
The Fire Chief commented on the administrative issues· He noted how necessary
it is for the Fire Department to do on site inspections, review plans of
buildings, provide public information and education on fire matters, and
monitor and provide fire permits in the district. If fire protection and code
enforcement were done by another agency it would be to a disadvantage to the
Fire Department.

The City Manager stated he believes it would be putting the City in a defense
mode on all district fires if the Fire Department had to fight fires with a
lack of knowledge of building contents, etc.
Discussion ensued and Council all believed the representatives and the Fire
Department have done an outstanding job in trying to negotiate and provide
fire protection to the district. It was noted how the citizens in the
district will be the loosers in the coming situation and that the Fire
Department's level of service to its citizens will not change.
Councilmember Shoemaker noted frustration with the District Board's comments
of the City and explained why he thinks the offer presented to them to be too
low. Further, he noted he would do all he could to see that firefighters did
not lose their jobs, but it could be that they would have to accept other
positions within the City.
Council noted the impasse.
Council cancelled the adjourned meeting of Wednesday, March 9, 1988 at Noon,
due to lack of a quorum.
ADJOURNMENT
There being no further business, the meeting was adjourned at 9:57 a.m.
