CITY COUNCIL MINUTES
ADJOURNED REGULAR MEETING

January 13, 1989
The City Council convened in an adjourned regular session at 8:39 a.m., in
Conference Room 3 at the Civic Center, 300 Seminary Avenue. Roll was taken
and the following Councilmembers were present: Wattenburger, Shoemaker,
Schneiter, Hickey and Mayor Henderson. Staff present: City Manager Payne,
City Attorney Rapport, Public Works Director/City Engineer Pedroncelli, Deputy
Public Works Director Goforth, Fire Chief Mitchell and City Clerk McKay.
Mayor Henderson noted the presence of Ukiah Valley Fire Protection District
Director Lee Howard and Richard Edgar. It was the general consensus of
Council to discuss Item 2b, Discussion of Ukiah Valley Fire Protection
District at this time.
UNFINISHED BUSINESS
2b. Discussion of Ukiah Valley Fire Protection District
The letter of January 11, 1989 from the Ukiah Valley Fire Protection District
to Mayor Henderson was reviewed along with the Ukiah Daily Journal's article
detailing the Ukiah Valley Fire Protection District's meeting on
January 10, 1989.
Councilmember Wattenburger stated the letter from the Ukiah Valley Fire
Protection District outlined the issues of concern discussed at their meeting
on January 10, 1989, and noted Lee Howard and Richard Edgar were appointed to
represent the Ukiah Valley Fire Protection District on an Ad-Hoc Committee for
contract review.
It was the general consensus of Council for Councilmember Schneiter and Hickey
to represent the City on the Ad-Hoc Committee. Councilmember Wattenburger
offered to be an alternate member.
Discussion ensued when all could meet before the requested deadline of
January 17, 1989.
The City Attorney noted staff input may be needed regarding some details and
mentioned the Fire Chief's presence at the Ad-Hoc Committee meeting could be
helpful to answer questions.
M/S Shoemaker/Hickey to discuss the details further in Closed Session, to be
added to the end of this agenda. The motion was carried by a unanimous voice
vote of all Aye.
The City Attorney recommended that Council should go into Closed Session under
the exception to the Brown Act, Section 54956.9, Subsection A, to discuss
Pending Litigation, Ukiah Valley Fire Protection District v. City of Ukiah,
County of Mendocino, Case No. 56505
Councilmembers Shoemaker and Hickey agreed to amend the previous motion to
include the City Attorney's recommendation.
2a. Discussion of Regional Water Control Board Discharge Permit - Basin Plan
The City Manager noted the upcoming North Coast Regional Water Quality Control
Board meeting in March or April of 1989 in which Ukiah's NPDES (National
Pollutant Discharge Elimination System) Permit is scheduled for review.
Mayor Henderson reported the two other members of the Sanitation District
could not attend this meeting due to other obligations.

The Public Works Director outlined the Proposed Implementation Schedule for
Advanced Wastewater Treatment, noting that the project could possibly be
on-line by the end of 1994.
Discussion ensued pertaining to the process of filtration, medium used and
COSTS.
The Public Works Director noted if larger pond capacity is ever required it
would mean acquisition of 200 acres of prime agricultural land, which reflects
the reverse of the City Council's goals to preserve agricultural lands in the
valley and would be a major expense for the City.
The Assistant Public Works Director reported if just Advanced Wastewater
Treatment is implemented the estimated cost would be $4 million. If
additional ponds are required the cost is projected to be $7.7 million.
Discussion ensued pertaining to other City's discharges and treatment plants.
The Public Works Director noted the cost of Advanced ~Wastewater Treatment
would create monthly sewer charge increases of $5.00.
The City Manager commented if the rate increase is implemented before the
expenditure, the project could be paid for in cash, saving the City $3 million
in interest if financed for 10 years.
Discussion ensued pertaining to the future of wastewater treatment for the
Ukiah Valley.
M/S Schneiter/Hickey to proceed to look at a plan that deals with rapid
filtration now with zero discharge into the river to be reviewed in the far
future. The motion was carried by the following roll call vote: AYES:
Councilmembers Wattenburger, Shoemaker, Schneiter, Hickey and Mayor Henderson.
NOES: None.

Council went into Closed Session at 9:30 a.m.
Council reconvened at 10:09 a.m.
