The City Council convened in a regular adjourned meeting at 8:04 a.m. and the following Councilmembers were present: McMichael, Wattenburger, Shoemaker, Schneiter and Mayor Henderson. Staff present: City Clerk McKay, City Manager Rough, City Attorney Rapport, Public Works Director Goforth and Public Works Administrative Analyst Goodrich. NEW BUSINESS 2a. Consideration of Solid Waste Systems, Inc., Garbago Collection and Recycling Services Contract with the City of Ukiah The Public Works Director reported that the proposed contract consolidates the garbage collection contract with the recycling contract. He noted the current garbage collection contract has a term of fifteen years, which ends December 15, 1995, and the current recycling contract which has a term of seven years, expires at the end of February 1997. He reported that ongoing negotiations with James Ratto, the new owner since January 1991, have resulted in the proposed draft contract. Councilmember Schneiter commented that if the hauler does not provide curbside recyclable pick up on holidays, they should be required to notify the public. The Public Works Director noted that the hauler has previously put public notices in the local newspaper if they would not be providing service on the regular pick up day He indicated the hauler has been providing service on holidays for the last few years. Mayor Henderson questioned when plastics will be picked up. The City Manager noted that plastics, including milk jugs, will be picked up in our curbside recycling program, starting April 1, 1992. Councilmember McMichael expressed concern regarding some deterioration of the recycling bins and noted if they are defective the customers should not have to pay for them. The Public Works Administrative Analyst answered that the garbage hauler has been replacing them at no charge. Councilmember Shoemaker proposed some suggested wording to Council for consideration. Discussion ensued regarding proposed wording, off-setting costs for commercial recycling, yearly evaluation by Council of the garbage hauler's financial audit, yardwaste cans, and reference to AB 939 requirements. After discussion with staff, it was the general consensus of Council to add the wording changes to Page 5, paragraph 2(b), add the sentence "After the audit the City Council shall evaluate the possibility of whether to use the income from commercial recycling to offset the cost of commercial recycling containers."; Page 4, paragraph 8.(i), second line, strike the words "individual can" after the word "commercial", and Page 6, Item 8E, second line, after the words "with the" add the wording "developing and implementing plans". 248 Mr. James Ratto, owner of Solid Wastes Systems, Inc., indicated he approves the proposed wording changes. M/S Shoemaker/Schneiter to approve the amended consolidated contract for collection, transportation and disposal of garbage, refuse and rubbish and recycling of recyclable materials from within the City of Ukiah. The motion was carried by the following roll call vote: AYES: Councilmembers McMichael, Wattenburger, Shoemaker, Schneiter and Mayor Henderson. NOES: None.
