HomeMy WebLinkAboutMin 10-20-93492 MINUTES OF THE CITY COUNCIL OF THE CITY OF UKIAH - October 20, 1993 The City Council convened in a regular meeting, of which the agenda was legally noticed and posted, at 6:32 p.m., in the Council Chamber of the Civic Center, 300 Seminary Avenue. Roll was taken and the following Councilmembers were present: Malone, Wattenburger, Shoemaker and Mayor Schneiter. Absent: Councilmember Mastin. Staff present: City Clerk McKay, City Manager Rough, City Attorney Rapport, Public Works Director/City Engineer Kennedy, Public Works Administrator Goodrick, Police Captain Budrow, Community Development Director Harris, Public Utility Director Barnes, Finance Director Burt, Assistant City Manager Horsley, Redevelopment/Economic Development Coordinator DeKnoblough, and Acting Police Chief Williams. INVOCATION/PLEDGE OF ALLEGIANCE The Community Development Director delivered the Invocation and Mayor Schneiter led the Pledge of Allegiance. PROCLAMATIONS 4a. Declarinq October 17-23, 1993, as Safe Schools Week Mayor Schneiter read and presented the Proclamation to Ukiah Unified School Superintendent Charles Myers, who reported on the schools, local law enforcement agencies, and the Committee for Safe Schools efforts to address school problems, and thanked the City for it's assistance and the Proclamation. 5. INTRODUCTION OF NEW EMPLOYEES Acting Fire Chief Sandelin introduced Mike Rains and Terry Israel, Firefighter/EMTII's and provided a brief biography of each for Council. The Acting Police Chief introduced Police Officer Karen Baxman, and provided Council with a brief biography. 6. Approval/Correction of Minutes Councilmember Malone made a correction to Page 5, last paragraph, 2nd line, to change the word "planting" to "saving". M/S Wattenburger/Malone to approve the minutes of the regular meeting of October 6, 1993, as amended. The motion was carried by the following roll call vote: AYES: Councilmembers Malone, Wattenburger, Shoemaker and Mayor Schneiter. NOES: None. Absent: Councilmember Mastin. RIGHT TO APPEAL DECISION Mayor Schneiter reviewed Section 1094.6 of the California Code of Civil procedures regarding the appeal process. CONSENT CALENDAR The City Manager requested Item Sh. Resurfacinq of Municipal Pool at Todd Grove Park, Spec. No. 93-18 be pulled from the Consent Calendar and placed as New Business Item llb. Council concurred with the request from the City Manager. M/S Malone/Wattenburger to approve the Consent Calendar as follows: Sa. Received and approved the report of disbursements made during the month of September 1993. 493 8b. Adopted Ordinance No. 942, amending Chapter 7 of Division 5 of the Ukiah City Code, regulating smoking in various locations within the City of Ukiah. 8c. Adopted Resolution No. 94-18, authorizing and directing the execution of certain lease financing documents, authorizing the preparation and distribution of a preliminary official statement in connection with the offering and sale of certificates of participation relating thereto, and authorizing and directing certain actions with respect thereto; for purchase of the back eight holes of the golf course. Sd. Approved the policy changes for the senior rate and Twilight League rates as recommended by Staff and the Golf Course Committee. Se. Authorized the City Manager to enter into a contract with Reuser, Inc. for the removal of greenwaste and woodwaste at the Ukiah Municipal Landfill facility at $3.00 per cubic yard of waste material, for a total amount not to exceed $15,000. Sf. Adopted Resolution No. 94-19, appointing Cultural Arts Advisory Board Education representative, Bard Zensen, and Public Member Alfred Chad Ramirez, for three year terms which expire October 1996. 8g. Awarded the base bid for Asphalt Overlay project for 1992-1994 fiscal years, Specification No. 93-13a, to Ghilotti Construction, in the amount of $228,162.00. 8i. Adopted Resolution No. 94-20 authorizing execution of agreement with the California Highway Patrol for use of the City of Ukiah firing range for a three-year term. The motion was carried by the following roll call vote: AYES: Councilmembers Malone, Wattenburger, Shoemaker and Mayor Schneiter. NOES: None. Absent: Councilmember Mastin. Mayor Schneiter noted for audience information the Smoking Ordinance was adopted on the Consent Calendar and will become effective in 30 days. 9. Audience Comments on Non-Aqenda Items No one came forward. NEW BUSINESS llb. Award of Bid for Resurfacinq of Municipal Pool at Todd Grove, Spec. No. 93-18, as per bid openinq October 18, 1993 The City Manager reported only one bid was received for a fiberglass liner and it is staff's recommendation to reject the bid due to insufficient number of alternatives provided and authorize staff to readvertise the project. He explained there is a resurfacing process available that staff will evaluate that provides a 25-year warranty. M/S Malone/Wattenburger to reject the one bid submitted and authorized staff to reevaluate and readvertise. The motion was carried by the following roll call vote: AYES: Councilmembers Malone, Wattenburger, Shoemaker and Mayor Schneiter. NOES: None. Absent: Councilmember Mastin. CITY COUNCIL REPORTS Mayor Schneiter noted as it is not yet 7:00 p.m., which is the time scheduled for the Public Hearings, Council reports will be the next item of business. Reg. Mtg. October 20, 1993 Page 2 494 Councilmember Malone Reported the Greater Ukiah Chamber of Commerce Executive Director Elizabeth Christian tendered her resignation effective December 10, 1993, and noted how in such a brief period of time she had made an invaluable contribution to Ukiah. Councilmember Wattenburqer None. Councilmember Shoemaker Reported on the Mendocino Solid Waste Authority meeting he attended today, and noted the Annual League of California Cities Conference held this week in San Francisco, was much better this year It was the consensus of Council to agendize the subject of City of Ukiah policy regarding the future direction of solid waste policy and issues surrounding garbage. Mayor Schneiter Reported on the NCPA meeting he attended, reminded Council of the joint Public Hearing with the Ukiah Valley Sanitation District on October 27, 1993, at 5:30 p.m., to be held at the Todd Grove Room in the Municipal Clubhouse. CITY MANAGER/DEPARTMENT HEAD REPORTS The City Manager reported there will be a Mayors/Managers meeting and luncheon on October 27, 1993 and noted he and staff will be attending the telecommunications conference at the College on October 29, 1993. PUBLIC HEARING - 7:00 p.m. 10a. Adoption of the Final Draft Source Reduction and Rec¥clinq Element (SRRE) and Household Hazardous Waste Element (HHWE) Dated April 1993 as Prepared in Consultation with the Mendocino Solid Waste Local Task Force by Keep Mendocino Beautiful, Inc. for the Mendocino Solid Waste Manaqement Authority as Mandated by California Inteqrated Waste Manaqement Act of 1989 (AB 939) The City Manager reported this public hearing has been noticed for 30 days, during which time the report and negative declaration has been available for public review. He noted only one letter was received from Erik Gjesteby, P.O. Box 363, Potter Valley, primarily expressing concerns regarding commercial composting by Mendocino Solid Waste Management Authority. The City Manager outlined the development and review of the final draft by other jurisdictions in the County and explained a Public Hearing is required for public input prior to final approval by all agencies. The Public Works Administrator reported on the status report for the City of Ukiah that was distributed to Council. Mike Sweeney, Project Manager for Mendocino Solid Waste Management Authority, reported the revisions to the draft SRRE have been reviewed by each agency in the County, the Mendocino County AB 939 Task Force, and the City of Ukiah Recycling Task Force. Councilmember Shoemaker requested that the letter from Mr. Gjesteby be attached in the Final SRRE. Councilmember Malone requested that staff prepare a letter of response to Mr. Gjesteby, in which his points are addressed. Reg. Mtg. October 20, 1993 Page 3 4'95 Mr. Sweeney noted the issue of private versus government composting will be responded to by letter. PUBLIC HEARING OPENED - 7:18 p.m. No one came forward. PUBLIC HEARING CLOSED - 7:19 p.m. Councilmember Shoemaker noted this final document has been developed through an 18-month process with other agencies in our County, involving four or five Public Hearings with many amendments. The City Attorney proposed some wording reorganization of the proposed resolution. M/S Malone/Shoemaker to adopt Resolution no. 94-21, adopting the Final Draft Source Reduction and Recycling Element and Household Hazardous Waste Element as the City's Solid Waste Management Plan, as amended by the City Attorney. The motion was carried by the following roll call vote: AYES: Councilmembers Malone, Wattenburger, Shoemaker and Mayor Schneiter. NOES: None. Absent: Councilmember Mastin. 10b. Consideration of Resolution Approvinq Adjustment of Parkinq Enforcement Fees The Finance Director reported AB 408, which became effective July 1, 1993, decriminalized parking violations in order to streamline the justice system. This State legislation made parking enforcement an administrative function of the agency issuing the citation. She outlined the previous and new citation administration procedures and the previous and proposed new rates which only reflect in increase in four categories out of the total 23 State mandated vehicle codes section. Discussion ensued regarding dispute resolution process. The City Manager noted that staff will develop a recommendation for Council regarding the appointment of the Hearing Officer. The City Attorney noted there have been several changes to State legislation in the past five years regarding this matter. PUBLIC HEARING OPENED - 7:32 p.m. No one came forward. PUBLIC HEARING CLOSED - 7:33 p.m. M/S Wattenburger/Shoemaker to adopt Resolution No. 94-22 establishing parking enforcement fees. The motion was carried by the following roll call vote: AYES: Councilmembers Malone, Wattenburger, Shoemaker and Mayor Schneiter. NOES: None. Absent: Councilmember Mastin. 10c. Consideration of Resolution Approvinq Policy ana Adjustment of Rates and Rental Fees for Parks and Civic Center Council Chambers The Community Service Director/Assistant City Manager reported on the proposed adjustment of rates and rental fees for City facilities, involving the rental of the Civic Center Council Chambers by non-profit agencies and reservations for rental of facilities at the parks, as per Exhibits A and B. She explained the demand for these facilities is increasing with additional demand on City staff and an increased need for defined rental agreement policies. Reg. Mtg. October 20, 1993 Page 4 496 Councilmember Malone noted that reserved facilities could use some sort of notification to prohibit the general public from taking the facility prior to the reserved time. He indicated concern regarding potential disputes between citizens. He also noted he has received complaints that Vinewood Park bathrooms are closed. The Community Services Director noted one side of these bathrooms are open, with the other side closed due to vandalism. Discussion ensued regarding staff procedures, enforcement process, posting reserved signs, possible additional barbecues, and rental rates for tables and chairs. PUBLIC HEARING OPENED - 7:43 p.m. No one came forward. PUBLIC HEARING CLOSED - 7:44 p.m. M/S Shoemaker/Wattenburger to adopt Resolution No 94-24, amending rental rates for use of City facilities in the Parks and the Civic Center Council Chambers. The motion was carried by the following roll call vote: AYES: Councilmembers Malone, Wattenburger, Shoemaker and Mayor Schneiter. NOES: None. Absent: Councilmember Mastin. 14. Closed Session The City Attorney announced a meeting in Closed Session is requested to discuss personnel and employee negotiations before action is taken on Agenda Item lla. Recess to the Ukiah Redevelopment Agency - 8:46 p.m. Reconvened as the Ukiah City Council at 8:55 p.m. Council entered Closed Session at 8:56 p.m. Council came out of Closed Session at 9:04 p.m. lla. Adoption of Resolution Approvinq Memorandums of Understandinq for Manaqement, Miscellaneous, Electric, Police, Fire and Director Employee Units M/S Wattenburger/Schneiter to adopt Resolution No. 94-24, adopting addendum's to the memoranda of understanding between the City of Ukiah and the employee units. The motion was carried by an unanimous voice vote of all AYE.
