MINUTES OF THE CITY COUNCIL OF THE
CITY OF UKIAH - December 1, 1993
The City Council convened in a regular meeting, of which the
agenda was legally noticed and posted, at 6:30 p.m., in the
Council Chamber of the Civic Center, 300 Seminary Avenue.
Roll was taken and the following Councilmembers were
present: Mastin, Malone, Wattenburger, and Mayor Schneiter.
Absent at roll call: Councilmember Shoemaker. Staff present:
City Clerk McKay, City Manager Rough, City Attorney Rapport,
Community Development Director Harris, City Engineer/Public
Works Director Kennedy, Assistant City Manager Horsley,
Deputy Fire Chief Sandelin, Finance Director Burt,
Redevelopment/Economic Coordinator DeKnoblough, Public
Utility Director Barnes, and Airport Manager Bua.
INVOCATION/PLEDGE OF ALLEGIANCE
Councilmember Mastin delivered the Invocation
Councilmember Wattenburger led the Pledge of Allegiance.

M/S Malone/Mastin to approve the minutes of the regular
adjourned meeting of November 17, 1993, as submitted. The
motion was carried by the following roll call vote: AYES:
Councilmembers Mastin, Malone, and Mayor Schneiter. Abstain:
Councilmember Wattenburger. Absent: Councilmember Shoemaker.
Noes: None.
4b. Regular Meeting of November 17, 1993
M/S Malone/Mastin to approve the minutes of the regular
meeting of November 17, 1993, as submitted. The motion was
carried by the following roll call vote: AYES:
Councilmembers Mastin, Malone, and Mayor Schneiter. Abstain:
Councilmember Wattenburger. Absent: Councilmember Shoemaker.
Noes: None.
Councilmember Shoemaker entered the meeting at this time.
RIGHT TO APPEAL DECISION
Mayor Schneiter reviewed Section 1094.6 of the California
Code of Civil procedures regarding the appeal process.
CONSENT CALENDAR
The City Manager requested Item 6f. Adoption of Resolution
Establishinq a Preferential Parking Space for the Disabled
at 225 Arlington Drive be pulled from the Consent Calendar
for further staff review. The City Manager distributed
corrected bid tabulations for Item 6b.
Councilmember Mastin requested Item 6b. Rejection of Bids
Received for Taxiwa¥ Lighting and Improvements at the Ukiah
Municipal Airport be pulled from the Consent Calendar. It
was the consensus of Council to move this matter of business
to New Business Item 8c.
Councilmember Shoemaker questioned

typographical error and the correct amount should be $9,585.
M/S Shoemaker/Malone to approve the Consent Calendar as
follows:
6a. Denied the claims of Francisco and Maricruz Alvarez,
Patsy J. Allen, Julie Herbert, and Jacqueline M. Woods, and
referred them to the City insurance carrier, R.E.M.I.F.

6c. Adopted Ordinance No. 946, amending Chapter 2, Division
9, of the Ukiah City Code by rezoning property (Zone Change
No 93-25, Carlile)
6d. Adopted Ordinance No. 947, amending Chapter 2, Division
9 of the Ukiah City Code by rezoning property (Zone Change
No. 93-16, Baltins)
6e. Accepted the work of American Asphalt, Inc., as complete
and approved the Notice of Completion for Slurry Seal on
City Streets, Spec. No. 93-14, and directed the City Clerk
to file the Notice of Completion.
6g. Awarded the bid to Aquatic Commercial Industries for
Resurfacing the Municipal Pool at Todd Grove Park, Spec. No.
93-18a, in the amount of $50,585, including a 15 year
warranty and a 50 year life expectancy.
The motion was carried by the following roll call vote:
AYES: Councilmembers Mastin, Malone, Wattenburger, Shoemaker
and Mayor Schneiter. NOES: None. Absent: None.
7. AUDIENCE COMMENTS ON NON-AGENDA ITEMS
No one came forward.
NEW BUSINESS
Sa. Consideration of Cancellation of Fire Protectior
Aqreement with Vich¥ Sprinqs Subdivision
M/S Schneiter/Wattenburger instructed staff to serve the
three year termination notice to all parties involved in
this contract. The motion was carried by the following roll
call vote: AYES: Councilmembers Mastin, Malone,
Wattenburger, Shoemaker and Mayor Schneiter. NOES: None.
Absent: None.
Bb. Approval of Extension and Amendment for Professional
Services Aqreement with Melinda Tone¥ for Ambulance Billin9
Services
Councilmember Malone noted a typographical error in the
first line, Item 4a., which should be $10,000, not $120,000.
The Finance Director concurred.
M/S Shoemaker/Wattenburger authorized the City Manager to
execute the amended extension of Ambulance Billing agreement
with Melinda Toney,, effective September 19 1993 to
September 19, 1994. '
8c. Rejection of Bids Received for Taxiwa¥ Liqhtinq and
Improvements at the Ukiah Municipal Airport
The City Engineer/Public Works Director and Airport Manager
reported on the bid tabulation corrections, specifics
concerning the project, and staff's reasoning to reject the
bids due to budget constraints, which has been approved by
the Federal Aviation Administration.
M/S Schneiter/Mastin to reject all bids due to the amounts
exceeding budgeted funds and directed staff to re-evaluate
the project, reduce the scope-or-work and re-advertise for
bids as soon as possible. The motion was carried by the
following roll call vote: AYES: Councilmembers Mastin,
Malone, Wattenburger, Shoemaker and Mayor Schneiter. NOES:
None. Absent: None.
CITY COUNCIL REPORTS
Councilmember Malone
Reminded the Council of the Ukiah Chamber of Commerce
Christmas Tree lighting ceremonies this coming Saturday.

Councilmember Wattenburqer
Reported on the Southern California fires he was sent to for
18 days, resulting in his absence at the past two Council
meetings.
Councilmember Shoemaker
Reported on the Solid Waste facility tour in Sacramento he
attended with City staff.
Mayor Schneiter
Reported on the NCPA meeting he attended, a meeting he
attended with the City Manager and the West Company, and
reminded Council of the upcoming events.
CITY MANAGER/DEPARTMENT HEAD REPORTS
None.
CLOSED SESSION
The City Attorney announced the need to go into Closed
Session as allowed by Government Code Section 54956.98
regarding real estate negotiations concerning Assessors
Parcel #178-210-01, referred to as the Franchesci property.
Council entered Closed Session at 7:55 p.m.
Council came out of Closed Session at 8:32 p.m.
The City Attorney noted no action had been taken.
