HomeMy WebLinkAboutMin 06-10-95 CITY OF UKIAH CITY COUNCIL MINUTES Reqular &djourned Meeting Ukiah Valley General Plan Review ~une LO, 1995 8:00 a.m. The meeting was called to order at 8:05 a.m. with the following Councilmembers present: Mastin, Malone, Wattenburger, Shoemaker and Mayor Schneiter. Staff present: City Clerk McKay, City Manager Rough, City Attorney Rapport, Planning Director Sawyer, and General Plan Consultant Eric Jay Toll. Mendocino County Planner Pam Townsend was also present. PUBLIC HEARING (Cont. From May 17, 1995) 3a. Review of the Ukiah Valley General Plan Update and Environmental Impact Report (EIR) as filed by the City of Ukiah Planning Department, which will guide the growth and development of the Ukiah Valley for the next 20 years, and which specifically consists of 14 elements The continued public hearing from May 17, 1995 was called to order at 8:05 a.m. with the following Councilmembers present: Mastin, Malone, Wattenburger, Shoemaker and Mayor Schneiter. Council reviewed previous discussions and the area lsat considered in the review of general plan. Staff distributed a complete update as to State requirements for a certifiable Housing element. Discussion ensued regarding HCD requiring mandatory housing in certain years with certain expenditures and the legally of this mandated State requirement that is unfunded. It was noted that the housing element that was written in this proposed general plan is a viable plan for the next five years, but is now being rewritten by the State. Mayor Schneiter outlined this hearing procedures. 4. COMMENTS FROM THE AUDIENCE Carre Brown, Administrator of the Farm Bureau, expressed concern of the sphere of influence in the area by the highway and the River, specifically the McCarty property. Mayor Schneiter noted no action has been taken regarding any changes at this time and noted there may be further discussion at the time of review of the maps. Gary Akerstrom, 455 Talmage Road, encouraged Council to address Bike lanes potential risk of impacts with automobile. He distributed statistics regarding motorcycle and bicycle accidents with cars in California, and noted the amounts are equal. Members of the audience left phone numbers with the City Clerk to be called at the time when Council reviews the land use maps. Housing Element Discussion ensued regarding issues surrounding a certifiable housing element which has not been developed by the Growth Management Steering Committee process and Planning Commission and the State requirements which are not suitable to Council. Council commenced the review of the current Housing element with discussion regarding projected populations based on annexations and no annexations, modified wording on Page 3 regarding a passive annexation policy by the City to conform element wording; corrected typographical errors, agreed to strike the evaluation portion of Item 19. on Page 11; discussion ensued regarding the parcel list compilation dates modified wording; data and information required by the State Housing Community Development not conforming to actual Ukiah information; removal of McCarty Manor and the Jack Simpson Senior Complex required by the State with consensus to retitle Table VI.l-14; with consensus to add additional wording on Page 30 259 Reg. June 10, 1995 Page 1 260 that reflects the actual factual figures existing in Ukiah; discussion ensued regarding commercial use allowed with mixed use residential, modified prices numbers on page 40 to reflect actual current real estate figures. Judy Pruden, expressed there is no tracking process for demolition of housing units less than 50 years old, citing the Redwood Apartments recently demolished losing 12 housing units. She encouraged Council to consider implementation of an internal staff tracking process. Council continued with the review of the Housing Element implementation measures, requested staff to attempt to amend wording regarding housing and units; discussed wording which may constrain future Council and budgets bing required by the State Housing Community Department; added clarified wording in implementation measures in Home ownership opportunities; and discussed the summary of major findings in construction of affordable housing required by the HCD. Recess - 10:28 a.m. Reconvened - 10:45 a.m. Council commenced their review of the Historic and Archeological Resources Element. It was the consensus to move to the Community Design Element first, to address issues that will affect the Historic Architectural element. Council discussed and reviewed community design and the Downtown Master plan Committee becoming a design review committee as an advisory body to the Planning Commission, with clarified wording, a Design review and Planning Commission process, with modified wording regarding the Design Review Committee under the Redevelopment Agency; reviewed goals and implementation measures with minor modified wording; remove the word duplex throughout this section. Council reviewed the Community Design section pertaining to the Ukiah Valley Setting, with some minor wording modifications, and discussed wording pertaining to the gateways, agricultural and scenic area character, residential neighborhoods with discussion regarding the historic criteria for the specified areas; it was the consensus of Council to pull CD-11.2 wording in its entirety; and continued review of the section pertaining to signs with consensus to change sign design review for homes and duplexes; with consensus to delete CD-13-2 policy and implementation measure; amended wording pertaining to underground utilities; reviewed Section regarding sound walls and public places; with consensus to delete IMCD-15.1a, b, and c, and replace with "new developments subject to design review shall be subject to underground review"; consensus to delete "plazas" wording; and agreed to strike CD17.2b and c, and 2.08 in entirety. Recess - 12:28 p.m. Reconvened - 12:45 p.m. Council reviewed the Historic and Archeological Resources element. Judy Pruden, 304 South Hortense, reported on the need for a certifiable local government, which requires a separate committee and ordinance. If there is no committee this means we can't get any grants or programs from the State. She expressed concern that there may not be the expertise required for Historic architectural on the Design Review committee. She indicated no historic or architectural properties will not be able to get on the national register without a certified local government. She expressed the need for resources to the community for architectural or historic assistance from the State. The State requires certification. She indicated this element was completed faster than any of the other elements, which indicates there is little community controversy. Discussion ensued regarding design review historic/architectural resource committee responsibility. and Eric Larson, suggested a Historic architectural subcommittee of the Design Review Committee. Reg. Adj. Mtg. June 10, 1995 Page 2 Mayor Schneiter stated he is uncomfortable with adding another layer of bureaucracy. Discussion continued regarding alternatives and Council agreed to review this element reserving action for the end of the review. Council began their review of the Historic and Archeological resources with amended wording in summary and findings, a Historic Architectural committee which will first develop goals and priorities which will be Council, consensus of Council to delete IMHA 1.4b in entirety; amend wording in IMHA 2.2a, delete IMHA 2.2b, amended wording in HA-3.3a, delete IMHA-4.1a; with general consensus of Council to delete in entirety IMHA-7.1a and IMHA-7.5a; delete the words"City Council uniform" in IMHA7.5b; modify wording in IMHA7.5d; and refer the 3.05 community education policy and implementation measures other than 8.1, be referred to a Historic Architectural committee, which Council agreed to implement. Recess - 2:25 p.m. Reconvened - 2: 34 p.m. Mayor Schneiter stated this is the last step before final approval, and it is at this time that Council will review the land use patterns and maps. Land Use Designations and Classifications Russ Tow, referred to the information he submitted on May 24, 1995 (Exhibit J) and distributed a memo from the Ukiah Valley Fire Protection District changing policy in which they will look at each subdivision on its merits, instead of an entire prohibition. He requested Council readdress the land designation of RRX which precludes any development out on Redemeyer corridor. Staff explained the reasons for the designation of RRX is lack of emergency and secondary traffic access to this area, in which maintaining current level of access requires restriction of additional development until these issues are resolved. It was noted there are no schools, fire stations, police stations for this area. Council queried staff regarding City and County zoning consistencies and possible modifications, reasons for the eastern hills restrictions, current County zoning, Mr. Toll stipulated and identified a map line adjustment to reflect correct agriculture designations. Jack Cox, 555 Pomo Lane, referred to York Estates 32 lots being re-designated non-conforming. He explained that it was approved as Ri with restriction to not develop into 3 lots. He requested review of his property located next to this development. Mr. Toll recommended this parcel be designated Rural residential which is more appropriate that a residential designation next to an agriculture zone. Discussion ensued regarding an appropriate land designation. Mr. Cox stated he is satisfied with the recommended change by Mr. Toll and County Planner Townsend. He outlined two other properties he owns that have been designated remote residential outside the City limits but adjacent to the City limits, that he is not satisfied with. Discussion ensued regarding prior considerations by the steering committee regarding the Helen Avenue area, potential development, rural residential versus remote residential parameters. Mr. Cox also expressed concern regarding the intersection between Lorraine and Betty Streets, on north side of Talmage Road, he owns 16 apartment units, where this property is zoned commercial and own two homes there. He requested these homes be zoned commercial. Mr. Toll stated if these lots remain separate they will be designated non conforming residential as they are homes on a 261 Reg. Adj. Mtg. June 10, 1995 Page 3 262 residential streets. He explained if these parcels were combined, then they would meet the criteria for commercial zoned. Jo Ann Henrie, 555 Doolan Canyon Drive, distributed two letters to Council regarding her property on Dora Avenue and also Dolan Canyon. She indicated the zoning map appears to be incorrect in regards to her 11 acres on Doolan Canyon, as to the lines, and requested residential zoning. Discussion ensued regarding LDR which is one dwelling per 6,000 sq. feet and RMR which is one unit per 20 acres and RR which is unit one per acre. Gary Akerstrom, noted it should be the intent to reduce pressure on potential development on agriculture, that residential development should be allowed in the Redemeyer corridor. He outlined the history of development of that area. He feels it is inappropriate to rezone from R-1 to rural residential. He also expressed concern regarding the Airport Business Park zoning as designated on these maps which should be zoned as Master Plan. The Planning Director referred to a memo distributed to Council. Carre Brown, read a letter from the Mendocino County Farm Bureau (Exhibit O), recommending that the Council adopt the sphere of influence as proposed by the GMSC with no changes, which was extensively addressed by the agriculture community and many other citizens. The recommended sphere of influence protects the agriculture corridor and restricts encroachment. Councilmember Malone questioned the agriculture community's feelings regarding the McCarty property request to be included in the City. Bill Johnson, explained he farms property along Babcock Lane, feels the change from agriculture on this property with County and City review would make farming difficult in this area. He indicated farmers are impacted by surrounding development and encourages keeping agriculture protected from encroachment. He stated the McCarty property could be potentially viable agriculture land, if properly managed as orchard, vineyard, or pasture. Pam Townsend, County Planner, identified the County position regarding the designation of agriculture for the McCarty partial. Councilmember Wattenburger stated he would like to leave this property zoned as is, although he feels that 20 years ago we should have never crossed over the freeway. John Prince, noted he has the listing for the sale of the McCarty property. He noted that the City has the opportunity to annex this property in order to control its future development. No others came forward to speak. Councilmembers Wattenburger, Malone, Mastin and Mayor Schneiter indicated'they do not wish to change the agriculture designation of the McCarty property. M/S Wattenburger/Malone to solidify this situation once and for all and leave the property commonly known as the McCarty property zoned as Agriculture. The motion was carried by a unanimous voice vote of all AYE. Councilmember Shoemaker stated he supports the GMST and PC designations of Industrial and Commercial for the Redwood Business Park. The Planning Director explained the problems with some of these identifications. He explained the AIP Master Plan does not change anything that is in existence which was adopted by Ordinance, other than implementing development standards. He further expalined currently zoned PD respective to the designation of Master Plan. Reg. Adj. Mtg. The The motion was carried by the following voice vote: AYES: Councilmembers Malone, Wattenburger,and Mayor Schneiter. NOES: Councilmember Shoemaker. Absent: None. Abstain: None. M/S Shoemaker/Malone to keep the zoning designation of RRX on the Redemeyer Road properties. The motion was carried by the following voice vote: AYES: Councilmembers Malone, Mastin, Wattenburger, Shoemaker and Mayor Schneiter. NOES: None. Absent: None. Abstain: None. M/S Malone /Shoemaker to make the Helen Avenue properties zoned as RR. The motion was carried by the following voice vote: AYES: Councilmembers Malone, Mastin Wattenburger, and Shoemaker. NOES: Mayor Schneiter. Absent: None. Abstain: None. It was determined that Mrs. Henrie's request to leave Dora Avenue as Commercial would still allow mixed use including residential. M/S Schneiter/Mastin to take no action on the Henrie request for Dora Avenue. The motion was carried by the following voice vote: AYES: Councilmembers Mastin, Malone, Wattenburger, Shoemaker and Mayor Schneiter. NOES: None. Absent: None. Abstain: None. It was the consensus of Council to approve the staff recommendation for Jack Cox's property near York Estates. 3b. Certify Ukiah Valley General Plan Integrated Environmental Impact Report M/S Wattenburger /Mastin to adopt Resolution No. 95-49, certifying the Final EIR for the Ukiah Valley General Plan. The motion was carried by the following roll call vote: AYES: Councilmembers Mastin, Malone, Wattenburger, Shoemaker and Mayor Schneiter. NOES: None. Absent: None. Abstain: None. M/S Malone/Mastin to approve the draft Ukiah Valley General Plan in concept. The motion was carried by the following roll call vote: AYES: Councilmembers Mastin, Malone, Wattenburger, Shoemaker and Mayor Schneiter. NOES: None. Absent: None. Abstain: None. It was the consensus of Council to reset the date and times for Fiscal Year 1995/96 Budget Hearings for July 10, 11, and 12, 1995. Councilmember Wattenburger stated he will not be available for the regular June 21, 1995 meeting. 3c. Adoption of Resolution&pproving and Adopting the Ukiah Valley General Plan No action was taken at this time as the final version of the Ukiah Valley General Plan will be forwarded to Council for formal approval in approximately three weeks. 263 5.
