HomeMy WebLinkAboutPR - 09 newspaper rack pub rightofway1 2 3 4 POLICY RESOLUTION NO. 9 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH ESTABLISHING STANDARDS AND CONDITIONS FOR NEWSPAPER RACKS IN PUBLIC RIGHT OF WAY WHEREAS, the City Council of the City of Ukiah has determined that the sale of newspapers for the dissemination of information is an important public ~ service; and 6 WHEREAS, various newspapers have requested approval to install newspaper ? racks within the public right of way or public sidewalk areas in specific 8 locations; and 9 WHEREAS, encroachment into the public right of way requires the approval 10 of the City Engineer, except as specifically authorized by the City of Ukiah 11 ! Municipal Code. 12 NOW, THEREFORE, BE IT RESOLVED that it is the policy of the City Council 13 ~ of the City of Ukiah to allow the placing of newspaper racks within the public 14 right of way upon sidewalk areas in accordance with and subject to the 15 following' 16 1. The City Engineer will receive, review requests, and may approve and 17 issue encroachment permits for the placement of newspaper racks at specific 15 locations. 19 2. The issuance of an encroachment permit for an approved location will , ~ ' be made to the initial applicant for that location. All subsequent requests 21 22 23 24 25 26 27 owner. 2~ by vendors, if approved, will be added to the permits for approved locations. 3. All applicants for a location shall furnish the following information and documents: a. Specific locations. b. Existing or proposed size of racks (number of vendors). c. Letters of consent from abutting property owner and business d. Insurance certificate naming City of Ukiah as additionally insured. - 1 - 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e. Initial applicant shall state the charge to other vendors of the rack. 4. The initial applicant to whom a permit is issued for a specific location shall be responsible for the installation and maintenance of that rack as may be required by the City Engineer. 5. All racks shall be modular type and be pedestal mounted. 6. Vendor boxes, rack and pedestal shall be painted Safeway Tan. 7. All existing newspaper racks located within the public right of way or sidewalks for which permits are not issued by September 1, 1983, shall be removed by City Forces and disposed of. Prior to removal by City, the owner will be notified of intent. 8. The City of Ukiah reserves the right to rescind approval of any permit upon ten (10) days written notice to vendors.
