POLICY RESOLUTION NO. 26
RESOLUTION OF INTENT OF THE CITY COUNCIL OF THE CITY
OF UKIAH TO MODIFY THE METHOD OF ASSESSING BUSINESSES
IN THE PARKING AND IMPROVEMENT DISTRICT AND BENEFIT ZONE
WHEREAS, the City Council intends to modify the method of assessing
businesses in the Parking and Improvement District and Benefit Zone
("the District") as described in Ukiah City Code Section 2605; and
WHEREAS, the City Council is committed, through its Downtown
Revitalization Master Plan and its many associated Programs, to
encourage the economic recovery and revitalization of our downtown; and
NOW, THEREFORE, THE CITY COUNCIL HEREBY RESOLVES AS FOLLOWS:
1. The proposed method and basis of levying the assessment will
be changed as follows:
a. Under existing Section 2602, the annual assessment
imposed upon each business located in the District is
equal to one hundred percent (100%) of the business
license fee for that business.
b. Under the proposed change, Section 2602 would be amended
to establish a maximum assessment fee of $250 for any
business located in the District.
2. Businesses will not be exempt from the levy of the assessment.
3. The City Council shall hold a public hearing on the proposed
change in assessing businesses at the Ukiah Civic Center Council
Chambers on October 7, 1992, at 7:00 p.m. or as soon thereafter as the
matter may be heard.
4. The City Council will hear and consider at the hearing the
testimony of all interested persons for or against the modification.

Any business affected by this change may file a protest with the City
Council before the hearing date. If protests representing 50% of the
assessments are filed, the City Council shall take no further action to
change the assessment and shall not consider the change again for a
period of one year.
5. This Notice of Intention shall be published once in the Ukiah
Daily Journal at least seven (7) days prior to the hearing and shall be
mailed by first-class mail to each business owner of a business located
in the District within seven (7) days of adopting this Resolution of
Intention.
NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby
approves the Resolution of Intention.
PASSED AND ADOPTED this 16th day of September, 1992, by the
following roll call vote:
