In appreciation for over 33 years of dedicated service to the City of Ukiah
Since joining the City Of Ukiah Fire Department as a Volunteer Firefighter
in August, 1963, you have demonstrated a consistently high degree of devotion,
dedication, and commitment to the delivery of service to our citizens. Your
performance, attitude, and considerable personal skills and talents have always
been directed in support of the vital mission of the Fire Department. Your e.~forts
of the four Fire Chiefs with whom you have served: Albert Bechtot; Kenneth
Donahue; Leland Mitchell, and Fred Keplin§er. They observed in you something
very special and of great value. They made decisions to appoint you to the full
time career position of Firefighter in 1966, to promote you to Engineer in 1968,
and to promote you to Captain in 1989.

required a high degree of accountability, and modeled a very strong work ethw ~
for your subordinates. Consistently, you stood firm in support of,w_hat, w.as the~
best course of action for the Fire Department to accomplish it s rn~ss~on, o.~ ~L
service. Your fellow firefighters knew you were first, last, and_alway_s a ~ru~e
profe-_~_~ional firefighter. They knew they could count on you to keep them sqle
duri-n-g the worst emergency situations. You were very 'salty'.

A regular meeting of the Ukiah City Council, the agenda for which was legally noticed and
posted, convened at 6:30 p.m. in the Civic Center Council Chambers, 300 Seminary

Public Works Director Kennedy noted, in order for the City of Ukiah Landfill to receive
waste from Willits and Fort Bragg, an indemnification agreement is required to indemnify
those cities against any claim or liability for hazardous or toxic waste contamination related
to the deposit of that waste.
Mayor Malone asked for audience comments. No one came forward.

7a. Consideration of Herbicide S_Drayinq by Caltran,~.
City Manager Horsley noted at the April 2, 1997 meeting, the Council requested a public
hearing be scheduled to discuss herbicide spraying of the freeway rights of way within the
City limits.
Rick Knapp, District Director of Caltrans District 1, outlined the Caltrans Vegetation
Management Program, emphasizing the focus of the program is primarily for safety, both
for the motorist and from a fire hazard perspective. Caltrans has reviewed many
alternatives to herbicide spraying, and has a goal to reduce such spraying, even though
now minimal, by 80 percent by 2012.
Mayor Malone opened the Public Hearing at 7:47 p.m.

In response to questioning, Public Works Director'Kenne~: noted the City uses only five
gallons of herbicide per year throughout the City.-.:. -.

plan, and for City staff to report back on the cUrrent use and methods of spraying
herbicides within the City, together With a prOPosal toi.reduce the spraying to the point of

Community serVices Director DeKnoblough outlined the operating deficit incurred at
the Golf Coorse since the purchase of the back eight holes from the County of Mendocino
in fiscal year 1993/94.' The Golf Course Committee has recommended fees increases on
a one-yea~:basiS, While staff recommends a five-year fee adjustment program.

Larry Steppe, 9745 West Road, Redwood Valley, spoke against the fee increases.
ElSie:Nielson,::gS0 St. Francis Way, member of the Golf Course Committee, felt the
10creases Were unfair to Senior Citizens, and preferred any increase to be for one year.
Jay Ferfigan, 1477 Deerwood Drive, felt the proposed increases targeted seniors, and
would like to see more City effort to promote the Golf Course outside the area.
Bob Maloney, spoke against raising the rates of Senior Citizens.
Mark King, 588 Hazel Avenue, spoke against raising the rates.
Don Rones, 717 Live Oak Avenue, member of the Golf Course Committee, supported the
Committee's recommendations on a one year basis.

Fay Hefte, 641 Chablis Court, member of the Golf Course Committee, preferred the
Committee's recommendations over those of staff.
Perry Ramsey, Chair of the Golf Course Committee, asked for the increase to be on a
yearly basis, not for five years as staff recommended.
Roland Nielson, 980 St. Francis Way, knew increases were necessary, but not as
proposed. He felt the matter should be referred back to the Golf Course Committee.
The Public Hearing was closed at 9:52 p.m.
City Manager Horsley emphasized the appreciation of the City for the volunteer
contributions from the Community on behalf of the Golf Course; however, the lack of
reserves in the Golf Course fund, and the severe deficit the City faces in its budget,
necessitate an increase in fees. Staff was attempting to plan ahead with this five-year
projection of fees.

Northern California Power Association (NCPA).
Director Bames responded NCPA may be interested in bidding on this proposal.

9d. Approval of Covenant with Mendocino ~;olid Waste Management Authority
Councilmembers noted they received letters from Patrick McAIlister and the Mendocino
County Employers Council.
City Attorney Rapport noted the Covenant would obligate the City's waste stream to be
delivered to the Solid Waste Systems Transfer Station on North State Street for 20 years
from the time of closing of our landfill. He asked for an amendment to the proposed
Resolution which would specify the time for closure of the Ukiah Landfill at 1.7 years after
closure of the Willits Landfill. To meet closure costs of the Ukiah Landfill, it is necessary
to collect revenues for this amount of time.
Mike Sweeney, General Manager, Mendocino Solid Waste Management Authority
(MSWMA), outlined the steps taken to arrive at this point in the development of the
Transfer Station. ..~

C0'Uncilmember Kelly reported on upcoming Sun House Guild events, mentioned the
proposed Skateboard Park Committee was looking into a site on City property at Low Gap
Park, and noted the Arts and Recreation Center Site Selection Committee had looked at
the Montgomery Wards site for its location.
Councilmember Mastin noted he was erroneously listed as a member of the Investment
Oversight Committee on the list of Terms of City of Ukiah Board and Commission
Members. He believes Councilmember Ashiku is the Council's designee.
City Manager Horsley agreed and noted the error will be corrected.

Mayor Malone reported a reception is scheduled for May 23, 1997 at Assemblywoman
Virginia Strom-Martin's Ukiah office. He attended a celebration of Buddha's birthday at the
City of Ten Thousand Buddhas, and also attended a Train Station Committee meeting and
a Northwestern Pacific Railroad Authority meeting in Fortuna.
11. CITY MANAGER/DEPARTMENT HEAD REPORT~
City Manager Horsley asked the Council to schedule a Goal Setting Session for the
Council the first week in June. The date of Tuesday, June 3, 1997, to begin between 8:00
and 8:30 a.m., was established for this session.

The claim from Lucy Pacini was received by the City of Ukiah on May 14, 1997 and alleges
damages related to material in the Babcock Lane public right of way on May 13, 1997.
Pursuant to City policy it is recommended the City Council deny the claim as stated and
refer it to Redwood Empire Municipal Insurance Fund (REMIF), the City of Ukiah's insurance
carrier.

AWARD OF BID FOR USED TRACTOR/LOADER IN THE AMOUNT OF
$21,450 TO LAMPSON TRACTOR AND EQUIPMENT
REPORT: The Wastewater Treatment Plant has been processing and storing biosolids
(sewer sludge) since the plant was commissioned in 1958. As part of our loan
agreement with the State Water Resources Control Board for the Advanced Waste
Treatment Facility, the City must have a biosolids disposal plan in place in order to
obtain plant certification. Staff has been working with the our regulatory agency, the
Regional Water Quality Control Board (RWQCB), in developing this biosolids disposal
plan. In the spirit of recycling and the best management practices for the disposal of
biosolids, RWQCB wishes that this material be put to beneficial use rather than land
filled with other garbage. Land application, for farming or vegetative cover at a
landfill, is the direction RWQCB has wished that we go. This material would be air
dried during the hot summer months and trucked to a site for application in the early
fall. Several locations have been selected as possible sites for this material.
Processing this waste will require the purchase of a medium sized tractor/loader for
management of the material at the Wastewater Treatment Plant. The City Manager
was consulted and authorized staff to request quotations for a good used tractor
using unused funds from the current budget. Requests for quotations through the
formal bidding process were sent to ten suppliers of used tractors. Four responses
were received and opened by the City Clerk on May 20, 1997. Lampson Tractor and
Equipment submitted the lowest bid of $21,450. Funds to purchase this machine
will come from Account 612-3580-800. The dump truck authorized for purchase
this year will be deferred and a portion of the $50,000 allocated for it's purchase will
be used to purchase the used tractor/loader.
RECOMMENDED ACTION' Award the bid for the used Tractor/Loader to Lampson
Tractor and Equipment.

SUBJECT: APPLICATION TO DEMOLISH A STRUCTURE OVER 50 YEARS OLD
LOCATED AT 1141 SOUTH DORA STREET
SUMMARY: Pursuant to Ukiah Municipal Code [}3016, the City Council must review
Demolition Permit applications of structures over 50 years old to determine if the structure to
be demolished has historical, architectural, or cultural significance. If a determination of
significance is made, the permit shall not be issued; if not, the permit shall be issued in a
manner consistent with Uniform Building Code {}3303.9.
To assist the Council in making this determination, the Demolition Permit Review Committee
(DPRC) met on May 29, 1997; discussed the potential historical significance of the single-
story structure located at 1141 S. Dora Street; and, finding no apparent historical
significance, unanimously voted to recommend Council approval of the Demolition Permit.
This determination was based, in part, on the attached historical profile provided by DPRC

RECOMMENDED ACTION: Find the structure located at 1141 South Dora Street to not be
historically significant, thereby implicitly authorizing its demolition.

architecturally, or culturally significant.
While the DPRC did not find any historical significance associated with 1141 S. Dora, two
other site-related issues were discussed. First, the subject structure underwent a partial
remodel in recent years, and, while the remodel was never completed, the structure contains
new construction materials (studs, wiring, plumbing, and siding) worthy of salvage.
Accordingly, the Committee directed staff to write the property owner a letter which suggests
that the material be salvaged, or, if possible, explore the option of moving the structure, in
order to conserve building materials. The Committee recognized that the City has no legal
authority to require the property owner to pursue either of these options, but thought it would
be prudent to pass the suggestion or recommendation on to the applicant nevertheless.
Second, a vintage Oak tree is located in front of the house, yet in the public right-of-way
(sidewalk area), and not on private property. Nonetheless, concern was expressed that the
demolition activities could possibly and inadvertently affect the tree, and that precautions
should be taken in order to avoid the tree. Accordingly, this issue will be addressed in the
aforementioned letter to the applicant, and, more importantly, the City Engineer indicated that
a staff member could be present during demolition, thereby overseeing the preservation of
the tree.

1141 So. Dora is a vacant structure that was formerly a single family residence.
Tax records indicate the structure was built in 1932. The building has been entirely gutted
to its wall, floor and ceiling structural members. The only indicators of age are the exposed
exterior roof rafters and sheathing which are of the typical construction style used in Ukiah
in the 1920's and 1930's.
Review of the 1941 Ukiah aerial map shows that this structure was not built at this site.
The biographical history and deed records indicate that Collin Y. Campbell and his family
moved to Ukiah in 1946 and purchased land at 1141 So. Dora. They either moved or
reconstructed an older building on their lot and added a small garage building at the back
of the property.
Collin Y. Campbell was a janitor for Ukiah Unified School District for over 20 years. He and
his wife raised four children at 1141 So. Dora. Mr. Campbell died in 1987. The home was
probably sold at this time.
In 1990 an extensive remodeling was begun but not completed. Nearly all the original
building materials have been replaced.
There is no historical or architectural significance in this structure to the City of Ukiah.
There are only two further issues which should be noted in this evaluation. The first is that
this structure is like a new building. It seems very extravagant to demolish it. The building
is structurally reconditioned and should be moved to another location. Secondly, the
demolition of the structure may cause damage to a City street tree, a vintage oak. The
Public Works Department should condition demolition to protect this tree.

at 2:39 p.m. in Conference Room 3, Ukiah Civic Center, 300 Seminary Avenue, Ukiah, California. Roll
was taken with the results listed above.

ON A MOTION by Member Shepard, seconded by Member Parducci, it was carried by an all AYE voice
vote to approve the minutes of April 22, 1997 as submitted. Member Kennedy abstained from the vote.

Chairman Pruden advised there was no history on this property other than the fact that it was a family
home for 50 years.
Member Parducci asked how the applicant planned to demolish the structure.
Chairman Pruden replied she did not know, and had hoped the applicant would be present to answer
that type of question. Operations Chief Sandelin had advised the demolition would not be used for a
practice burn since it was too close in proximity to other buildings.
Discussion followed relative to moving the building in lieu of a demolition, wherein it was suggested
that the applicant be contacted regarding placing a classified advertisement in the newspaper inquiring
whether there were any parties interested in that option.
Further discussion followed relative to the vintage Oak located on the site in the public right-of-way,
and classified as a City street tree. It was acknowledged that the Demolition Review Committee
retains no power to condition a demolition permit; however, it was the Committee consensus to take

whatever measures were possible to preserve the tree. Therefore, it was recommended that Planning
Director Sawyer contact the applicant, in writing, and encourage her to either consider salvage of the
demolition or place an advertisement in the newspaper regarding moving the building to another
location. In addition, she should also be informed that the Oak is a City tree, that it is significant, and
that the City does not want to see it damaged during the demolition process.
Member Sawyer advised he would send City Manager Horsley a copy of his letter so that she would
be aware of the Committee's concern relative to the tree. He further advised that he would include that
concern in his staff report to the City Council for consideration as a Consent Calendar item at their
June 4, 1997 regular meeting.
Member Kennedy advised that the Engineering Department could be present if they are notified when
the demolition is to occur, thereby overseeing the preservation of the tree.
ON A MOTION by Member Parducci, seconded by Member Shepard, it was carried by the following roll
call vote, to recommend to the City Council approval of the Demolition Permit for 1141 South Dora,
Assessor's Parcel No. 003-130-11, based upon the evaluation presented by Chairman Pruden, site
observation, and the lack of significant historical or architectural value.

SUBJECT: AUTHORIZATION OF SURPLUS PROPERTY APPRAISALS AND APPROVAL OF
BUDGET AMENDMENT
At their May 7, 1997 meeting the City Council identified properties to be considered surplus
and directed staff to proceed with the tasks necessary to appropriately dispose of them. The
initial step is to conduct appraisals. Quotations through the informal bidding process were
received from qualified firms for appraisals of the North Fire Station and Low Gap Road
properties, with a total estimated cost of $3,700. Since this matter was not included in the 1996-
97 adopted budget, a budget amendment is required to appropriate the necessary funds.
The funds are to come from the General Fund fund balance and be applied to contractual
services line item within the Miscellaneous General Government Department. Adequate funds
are available to meet this expense.
The appraisals are requisite to the sale of the properties at realistic levels. Staff
recommends that the Council authorize the appraisals and approve the budget amendment to
account for the costs.
RECOMMENDED ACTION:
Authorize appraisals of the North Fire Station and Low Gap
Road properties and approve budget amendment of $3,700
from General Fund fund balance to Miscellaneous General
Government Contractual Services (100.1990.250.000).

DECLARATION OF SELF CONTAINED BREATHING APPARATUS
(SCBA) AS SURPLUS PROPERTY AND APPROVAL OF SALE
The Ukiah Fire Department has five surplus self contained breathing apparatus (SCBA). This
equipment is older, heavier, and more difficult to maintain than the newer styles currently used.
The Mendocino Solid Waste Management Authority (MSWMA) has a need for and has been loaned
two SCBAs. This has allowed the County's Household Hazardous Waste Program to operate within
the guidelines established for employee safety, and provide a very important service not only to
county occupants, but also to residents of the City of Ukiah.
It is the wish of the Fire Department to declare these five SCBAs surplus and sell two of them to the
Mendocino Solid Waste Management Authority and three to any other interested party. Mendocino
Solid Waste Management Authority has offered to purchase the SCBAs, at fair market value, which
is $150 each (established price based on an evaluation of the equipment by the original supplier,
Vallen Safety Supply Co.).
The City of Ukiah Standard Asset numbers for these SCBAs are 001034, 001035, 001037, 001038
and 001039. Funds from the sale of these SCBA's would be routed to Account 100-0800-625
(General Fund-Sale of Property).
RECOMMENDED ACTION: City Council declare the SCBAs to be surplus property and allow
the sale as is, with no warranty, written or implied, of two to Mendocino Solid Waste Management
Authority for $150 each.

SUBJECT: VEHICLE ABATEMENT- 495 FORD STREET, UKIAH
In response to complaints from neighbors in the area of Ford, Myron and Sidney
Streets, the Police Department initiated a vehicle abatement program. Numerous
vehicles were identified as being either abandoned, non-operable or dismantled.
On April 12, 1997, a "Letter to Residents" was hand delivered to residents in the area
(attached). In response to this letter, many of the identified vehicles were voluntarily
moved by the owners. Some owners were unable to move a vehicle belonging to
them in the time allotted but worked with the Police Department to ensure the vehicles
would be moved in a timely manner.
On May 3, 1997, residents which had made no effort to move or otherwise care for
their vehicles were hand delivered a "Notice of Intent to Abate" letter (attached). Per
Ukiah City Code, Section: 7610, the owner of the vehicle or land upon which it is
parked may request a public hearing regarding the abatement.
The owner of a vehicle being abated at 495 Ford Street has requested a public
hearing.
RECOMMENDED ACTION:
Allow the abatement process to continue until the vehicle is either removed by the
owner or towed by the Police Department.

§7601: NUISANCE: In addition to and in accordance with the determination made
and the authority granted by the State of California under Section 22660 of
the Vehicle Code to remove abandoned, wrecked, dismantled or inoperative vehicles or
parts thereof as public nuisances, the City Council hereby makes the following findings

vehicles or parts thereof on private or public property, not including highways, is
hereby found to create a condition tending to reduce the value of private property, to
promote blight and deterioration, to invite plundering, to create fire hazards, to
constitute an attractive nuisance creating a hazard to the health and safety of minors,
to create a harborage for rodents and insects an to be injurious to the health, safety
and general welfare. Therefore, the presence of an abandoned, wrecked, dismantled or
inoperative vehicle or parts thereof, on private or public property not including
highways, except as expressly hereinafter permitted, is hereby declared to constitute a
public nuisance which may be abated as such in accordance with the provisions of this

remove the vehicle, or parts thereof, as a public nuisance shall be mailed
by registered mail to the owner of the land and to the owner of the vehicle unless the
vehicle is in such condition that identification numbers are not available to determine
ownership. The notice of intention shall be in substantially the following forms:

§7610: REQUEST FOR HEARING; HEARING UNNECESSARY: Upon request by
the owner of the vehicle or owner of the land received by the City Clerk or
her designated representative within ten (10) days after the mailing of the notices of
intention to abate and remove, a public hearing shall be held by the City Council on
the question of abatement and removal of the vehicle or parts thereof as an
abandoned, wrecked, dismantled or inoperative vehicle, and the assessment of the
administrative costs and the cost of removal of the vehicle or parts thereof against the
property on which it is located.
If the owner of the land submits a sworn written statement denying responsibility for
the presence of the vehicle on his land within such ten (10) day period, said statement
shall be construed as a request for a hearing which does not require his presence.
Notice of the hearing shall be mailed, by registered mail, at least ten (10) days before
the hearing to the owner of the land and to the owner of the vehicle, unless the
vehicle is in such condition that identification numbers are not available to determine
ownership. If such a request for hearing is not received within said ten (10) days after
mailing of the notice of intention to abate and remove, the City shall have the authority
to abate and remove the vehicle or parts thereof as a public nuisance without holding

HEARING: All hearings under this ordinance shall be held before the City
Council which shall bear all facts and testimony it deems pertinent. Said

facts and testimony may include testimony on the condition of the vehicle or parts
thereof and the circumstances concerning its location on the said private property or
public property. The City Council shall not be limited by the technical rules of
evidence. The owner of the land may appear in person at the hearing or present a
sworn written statement in time for consideration at the hearing, and deny
responsibility for the presence of the vehicle on the land, with his reasons for such
denial.
The City Council may impose such conditions and take such other action as it deems
appropriate under the circumstances to carry out the purpose of this Municipal Code
Chapter. It may delay the time for removal of the vehicle or parts thereof if, in its
opinion, the circumstances justify it. At the conclusion of the public hearing, the City
Council may find that a vehicle or parts thereof has been abandoned, wrecked,
dismantled or is inoperative on private or public property and order the same removed
from the property as a public nuisance and disposed of as hereinafter provided and
determine the administrative costs and the cost of removal to be charged against the
owner of the land. The order requiring removal shall include a description of the
vehicle or parts thereof and the correct identification number and license number of the
vehicle, if available at the site.
If it is determined at the hearing that the vehicle was placed on the land without the
consent of the owner of the land and that he has not subsequently acquiesced in its
presence, the City Council shall not assess the costs of administration or removal of
the vehicle against the property upon which the vehicle is located or otherwise attempt
to collect such costs from such owner of the land. If the owner of the land submits a
sworn written statement denying responsibility for the presence of the vehicle on his
land but does not appear, or if an interested party makes a written presentation to the
City Council but does not appear, he shall be notified, in writing, of the decision. (Ord.

§7612- REMOVAL; TIME LIMITS: Five (5) days after ad;3ption of the order
declaring the vehicle or parts thereof to be a public nuisance, five (5) days
from the date of mailing of notice of the decision if such notice is required by §7611,
or fifteen (15) days after such action of the governing body authorizing removal
following appeal, the vehicle or parts thereof may be disposed of by removal to a
scrap yard or automobile dismantler's yard. After a vehicle has been removed it shall
not thereafter be reconstructed or made operable. (Ord. 617, §1, adopted 1971)

REQUIRED DEPARTMENT OF MOTOR VEHICLE NOTICES: Within five
(5) days after the date of removal of the vehicle or parts thereof, notice

shall be given to the Department of Motor Vehicles identifying the vehicle or parts
thereof removed. At the same time there shall be transmitted to the Department of
Motor Vehicles any evidence of registration available, including registration certificates,

§7614: I.,[EN: If the administrative costs and the cost of removal which are charged
against the owner of a parcel of land pursuant to §7611 are not paid within
thirty (30) days of the date of the order, such costs shall be assessed against the

The Ukiah Police Department has recently received complaints
reGardinG abandoned, wrecked, dismantled or inoperable
vehicles parked on the streets and on private property in
your area.
Vehicles found on public or private property in this
condition are subject to abatement pursuant to City Ordinance
and the California Vehicle Code.
The Ukiah Police Department has identified at least 25
vehicles that may be considered abandoned, wrecked,
dismantled or inoperable parked on public and private
property on Sidnie Ct., Myron Pl., and Ford St.
If you own or maintain one of these vehicles, the Ukiah
Police Department is asking that you take steps to remove or
dispose of the vehicle or vehicles during this Grace period
endinG May I, 1997.
If after May 1, 1997, vehicles in this condition are located
in the area, abatement proceedings will be commenced and the
vehicles will be removed at the expense of the owner, if on
the street, or the owner of the property where it is
located, if on private property.

SUBJECT: ADOPTION OF RESOLUTION RELATIVE TO EMPLOYEE RETIREMENT
As the Council is aware, Staff has been researching various options
to reduce expenditures in the General Fund. As part of the cost-
saving measures to avoid employee lay-offs, staff is recommending
that the City offer an early retirement ("golden handshake") to one
employee.
Under PERS regulations, there are various eligibility requirements
which must be met, such as the employee must be at least 50 years
of age and have at least 10 years of service credit. We are
currently proposing that a golden handshake be offered to the
classification of Building Official. There is only one employee in
this classification and he would be eligible for an early
retirement. We can save significantly in the General Fund by
offering a golden handshake to the Building Official, eliminating
the two positions of Building Official and Code Compliance
0fficer/Plan Checker, and reclassifying the positions to one
modified position.

The early retirement offer would increase the employee's years of
service by two years. We have discussed the early retirement
program with the eligible employee and he has indicated that he
would accept the offer. In order to be eligible to receive the two
years of additional service credit, the employee must retire prior
to July 1, 1997.
The estimated annual savings by allowing this employee to retire
early and consolidating two positions into one position would
amount to $64,807. The City's estimated one-time cost to PERS for
the additional years of service credit would be $27,794.
To comply with Government Code Section 7507, we provided the
estimated costs of the proposed golden handshake to the public at
your last public meeting. The estimated cost analysis prepared by
the Finance Director is again attached for your review and
consideration.
Staff recommends adoption of the attached resolution authorizing
two years of service credit to be granted to the designated
employee for retirement purposes. Staff also recommends that the
City Council authorize the Mayor to sign the attached Certification
of Compliance and Agreement to Requirements for Section 20903.5 of
the California Government Code. This document is required by PERS
regulations to ensure that the City of Ukiah will comply with all
of the requirements for allowing an early retirement. In addition,
Staff recommends approval of the proposed Building Inspector Job
Description which is attached for your review and consideration.

RESOLUTION NO.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OFUKIAH
GRANTING ONE TO FOUR YEARS ADDITIONAL SERVICE
CREDIT FOR RETIREMENT PURPOSES
WHEREAS, the City of Ukiah is a contracting Public Agency of
the Public Employees' Retirement System; and
WHEREAS, California Government Code Section 20903.5 provides
that when the governing body of a contracting agency determines
that because of an impending curtailment of, or change in the
manner of performing service, the best interests of the agency
would be served by encouraging the retirement of local members, the
governing body may adopt a resolution to grant eligible employees
one to four years additional service credit when certain conditions
specified in said Section exist; and
WHEREAS, said Section requires the governing body to specify
the number of whole years of additional service credit being
granted and to determine a period in which eligible members, who
meet the conditions, must retire to be entitled to receive said
credit; and
WHEREAS, said period may begin as early as one day following,
and end not more than 120 days following, the governing body's
adoption of the resolution; and
WHEREAS, said Section requires the governing body to designate
the categories of eligible members and allows for eligibility to be
limited to members employed in specific departments, programs,
and/or position classifications within said Agency;
NOW, THEREFORE, BE IT RESOLVED, that the City Council, as the
governing body of the City of Ukiah has determined that because of

an impending curtailment of service, or change in the manner of
performing service, the best interests of the public Agency would
be served by encouraging the retirement of local members and
desires to provide two (2) years additional service credit pursuant
to Section 20903.5 for eligible local Miscellaneous members.
BE IT FURTHER RESOLVED, that said governing body determines
that the period in which eligible members, who meet the conditions,
must retire to be entitled to the additional credit shall begin on
June 5, 1997, and end on June 30, 1997, and that to be entitled to
the additional credit, eligible members, who meet the conditions,
must be employed in the position classification of Building
Official of the City of Ukiah on the date of adoption of this
Resolution.

TO REQUIREMENTS FOR SECTION 20903.5
The City Council of the City of Ukiah hereby certifies and agrees
as follows-

The annual salaries (including benefits) for the two positions
of Building Official and Code Enforcement 0fficer/Plan Checker
which will be eliminated total $110,017. The salary
(including benefits) of the position of Building Inspector
which will replace the two eliminated positions totals
$45,209. The total annual savings for this restructuring is
$64.807. The estimated one-time cost to provide two
additional years of service credit to one employee totals
$27,794.

The position of Building Official will be eliminated and the
Code Enforcement Officer/Plan Checker position will be
reclassified to the position of Building Inspector. This will
amount to an annual savings of $64,807.

Sufficient positions have been deleted with a total cost which
exceeds the lump-sum actuarial cost of the additional service
credit granted.
The City of Ukiah agrees to transmit to the retirement fund an
amount determined by the Board to equal the actuarial
equivalent of the difference between the allowance the member
receives after receipt of the additional service credit and
the amount the member would have received without the
additional service credit. The City of Ukiah agrees to
transmit to the retirement fund applicable administrative
costs.

The City of Ukiah shall maintain records for the worker
retiring pursuant to this section (name, social security
number, retirement effective date, and cost of additional
service credit).

The City of Ukiah shall provide verification of its
certifications through independent review if the Board so
requires.

The City of Ukiah will certify to CalPERS that the eligible
employee does not receive unemployment insurance payments any
time within two years of the governing body's adoption of the
Resolution granting the additional service, due to employment
with any employer participating in the CalPERS retirement
program.

The City of Ukiah will certify the amount of actual savings
and the measures taken to achieve the savings at such time the
governing body has achieved savings that are more than
adequate to meet necessary payments to the Board.

BUILDING INSPECTOR
DEFINITION:
Under general direction of the Director of Planning, coordinates the application and
enforcement of all local ordinances and State codes pertaining to building in the City;
performs building plans examination on all Building Permit applications (excluding
structural engineering); functions as a code enforcement officer for all local ordinances
pertaining to zoning, planning, and building; and performs other related duties as
assigned.

complaints, issuing violation notices, and effectively abating zoning and planning code
violations throughout the City. (E)
- Integrates the duties, responsibilities, and field work of the building inspection and
zoning code enforcement functions, thereby maintaining the highest degree of
efficiency and productivity in both areas.
- Provides field inspection services on projects approved by the Zoning Administrator,
Planning Commission, and/or City Council, and ensures that 'conditions of approval'
are satisfied.
- Represents the City at community meetings and public hearings, as required, and
assists the Director of Planning in establishing Building Division goals, policies,
priorities, and budget computations and information. (E)

QUALIFICATIONS
Knowledge of:
- Title 24 of the California Code of Regulations ('California Building Code'), and all
applicable local ordinances related to building.
- Construction methods and materials, engineering principles and practices, and building
safety standards.
Local ordinances pertaining to planning and zoning, and ability to enforce their
provisions in a professional, tactful, and efficient manner.
Ability to:
- Read and interpret building specifications, codes, and regulations, and provide plan
check services to a local agency.
- Communicate building permit requirements and building plan deficiencies to builders
in a professional, articulate, and courteous manner.
- Establish and maintain effective and cooperative working relationships with builders,
contractors, the general public, and City officials and employees.
- Communicate clearly and concisely, orally and in writing.
- Perform field inspections on new construction and remodel projects, which will include
mobility in 'hard hat' areas, and tight or high places.
Compute building permit fees, as derived from the Uniform Administrative Code and
Building Valuation data.
EXPERIENCE
- Three years of plan check/review and building inspection experience is required.
(ICBO certification as a Plans Examiner may substitute for one year of required plan
check experience.)
- One year as a construction worker in any standard building trade.
EDUCATION AND CERTIFICATIONS
- Equivalent to graduation from high school, and supplemental specialized training in
plan check/review and building inspection.
Required ICBO certifications: Building Inspector, Electrical Inspector, Plumbing
Inspector, and Mechanical Inspector.
ICBO Plans Examiner certification must be acquired within one year of appointment.
SPECIAL REQUIREMENT
Possession of a valid Class C California Driver's License.
PROBATIONARY PERIOD
Employees serve a six-month probationary period. If performance is not satisfactory, an
employee may be terminated without cause or recourse during this period.
