MINUTES OF THE UKIAH CITY COUNCIL
Regular Meeting - October 15, 1997
A regular meeting of the Ukiah City Council, the agenda for which was legally noticed and posted,
convened at 6:30 p.m. in the Ukiah Civic Center Council Chambers, 300 Seminary Avenue, Ukiah,
California. Roll was taken and the following Councilmembers were present: Councilmembers
Ashiku, Kelly, Mastin, and Mayor Malone. Absent: Councilmember Chavez. Staff present:
Customer Service Supervisor Archibald, Public Utility Director Barnes, Community Services Director
DeKnoblough, Finance Director Elton, Assistant City Manager Harris, City Manager Horsley, Public
Works Director Kennedy, City Attorney Rapport, Fire Operations Chief Sandelin, Planning Director
Sawyer, Police Operations Captain Williams, Senior Civil Engineer Woods, Executive Assistant
Yoast, and City Clerk Henderson.
2. Pledge of Allegiance
Councilmember Ashiku led the Pledge of Allegiance.

Special Order of Business
Introduction of New Employee - Josie Castanon
Since Josie Castanon had not yet arrived, this item was postponed.

Approval/Correction of Minutes
Minutes of October 1, 1997
Councilmember Mastin asked the minutes be amended as follows:
Under item 9b, add the following to the paragraph referring to the Press Democrat article, "Director
DeKnoblough pointed out the article dealt with pesticides, not herbicides." He reviewed the article
and this was the case.
Under item 9c, note in Jim Salyers opening remarks, "He indicated the fuel escalator would be
deleted," and add to the fourth paragraph on page 4, regarding Councilmember Mastin's statement
on the length of the contract, "He did not feel it was good business or good public policy to not go
out to the market in a 20-year period."
MIS AshikulMastin to approve the Minutes of October 1, 1997, as amended, carried by the following
roll call vote: AYES: Councilmembers Ashiku, Kelly, Mastin, and Mayor Malone. NOES: None.
ABSTAIN: None. ABSENT: Councilmember Chavez.
5. RIGHT TO APPEAL DECISION
Mayor Malone reviewed the appeal process.
6. CONSENT CALENDAR

Approved Disbursements for the Month of September 1997;
Awarded contract to Ferranti Construction in the amount of $16,490 for the construction of
traffic calming measures on Clara Avenue and Ford Street - Specification No. 97-05;
Adopted Ordinance No. 996, Amending Division 9, Chapter 2 (Zoning) of the Ukiah City
Code;
Adopted Resolution No. 98-14, Establishing the Schedule of Fees and Rates for Garbage
and Recycling Collection Services for the 1997/98 Fiscal Year;
Authorized the City Manager to execute an agreement with Thomas Consulting to prepare
state mandated cost reimbursement claims;
Approved Budget Amendment for Fire Department;
Approved amendment to Service Agreement for Juvenile Work Program at Ukiah Solid
Waste Disposal Site; and
Approved Budget Amendment for Purchasing Department.
The motion carried by the following roll call vote: AYES: Councilmembers, Ashiku, Kelly, Mastin, and
Mayor Malone. NOES: None. ABSTAIN: None. ABSENT Councilmember Chavez.

3a. Introduction of New Employee - Josie Castanon
Executive Assistant Yoast introduced new Receptionist/Typist Clerk Josie Castanon.

PETITIONS AND COMMUNICATIONR
Susan Wertheimer and Arlington Neighborhood Group
City Manager Horsley noted she met with Susan Wertheimer and a group of concerned citizens
from Arlington Drive, Councilmember Mastin, Mayor Malone, and representatives from the Police
Department regarding Ms. Wertheimer's complaint of police harassment during a recent police
action in the Arlington Drive neighborhood. Even though the City Manager had provided additional
information regarding that police activity, as well as the Community Oriented Policing Services
(COPS) program to Ms. Wertheimer for clarification, Ms. Wertheimer felt it necessary to address
the Council directly.
Susan Wertheimer, 272 Arlington Drive, stated she appreciated the difficult tasks police officers
face, and noted she was in agreement with the philosophy of the COPS program, however she felt
the police action/raid was a vendetta by one police officer on a parolee associated with the
neighborhood. She strongly noted her displeasure, as well as the neighborhood's anger, over the
manner in which this raid was carried out.
Robert McDonald, 241 Arlington Drive, stated his family had been involved in this action, his
grandchild traumatized by the police action, and noted his displeasure in not receiving a copy of the
City Manager's response to Ms. Wertheimer following the neighborhood meeting.
Susan Wertheimer read a prepared statement from Charlee Ray, an Arlington Drive neighbor,
stating her concerns regarding the police action.
Discussion took place between the Council and the neighbors regarding the police action. The
Arlington Drive representatives reiterated their concerns. The Council was receptive to their
concerns.
City Manager Horsley apologized to the group for only sending her response to Susan Wertheimer.
She would be glad to send copies of that letter to the other neighbors involved.
Councilmember Kelly asked Mr. McDonald what could be done to rectify the trauma felt by his
grandson.
Police Operations Captain Williams thinks there are numerous things that could be done to mend
relationships between the Arlington Drive neighbors and the Police Department. He noted the
uniqueness of this particular police action, due primarily to the close proximity of the three houses
involved. He expressed his willingness to meet again with the concerned neighbors.
Mr. McDonald asked, if and when he thought of a way his grandson would benefit from further police
contact, might he contact Councilmember Kelly directly. She agreed he may.

Possible Adoption of Resolution Making Airport Park Boulevard or Portions Thereof
Part of the City of Ukiah Street System
This matter was discussed in Closed Session. No action was taken.
10. CITY COUNCIL/REPORTS
Councilmember Ashiku had nothing to report.
Councilmember Kelly distributed a brochure describing the new exhibit at the Grace Hudson
Museum, Mexican Folk Art Tradition in Celebration. The Sun House Guild, at it's 1996 fundraising
event, had auctioned a dinner for 6 people to be held in the Sun House. She noted the success of
that dinner held last Friday night. This year's fundraising event, An Evening with Grace and John,
is scheduled for next Saturday at the Ukiah Conference Center. She also mentioned the enjoyable
time she had at the recent League of California Cities Annual Conference in San Francisco.
Councilmember Mastin mentioned he had been out of town for the past several weeks, was in San
Francisco for the League of California Cities Annual Conference on Monday and Tuesday, and noted
Ukiah's position on the proposed League Resolutions was always with the majority.

Mayor Malone mentioned approximately 50 interested citizens attended the recent Railroad Steering
Committee public information forum. He attended a Northern California Railroad Authority Board
meeting at which the Board endorsed the prospect of the City of Ukiah starting the process with the
Public Utilities Commission to obtain an at-grade crossing on Clay Street. He noted his attendance
at the League of California Cities Annual Conference and his appreciation of the League as a
lobbying body on behalf of cities. He further noted the Redwood Empire Division of the League met
at the Annual Conference.
11. CITY MANAGER/DEPARTMENT HEAD REPORTS
City Manager Horsley inquired if any of the Councilmembers would be willing to serve on the
Courthouse Facilities Planning Committee as she had outlined in her recent memo to Council.
Councilmember Ashiku volunteered to serve on this committee.

At 7:25 p.m. the Council recessed its meeting to adjourned as the Ukiah Redevelopment Agency
and then to convene in Closed Session to discuss the above-referenced matters.
At approximately 9:09 p.m., the Council adjourned from Closed Session. No action was taken.
