MINUTES OF THE CITY COUNCIL
OF THE CITY OF UKIAH - October 30, 1996
The City Council convened in a regular adjourned meeting, of which the agenda was legally noticed
and posted, at 5:00 p.m. in the Civic Center Council Chambers, 300 Seminary Avenue, Ukiah,
California. Roll was taken and the following Councilmembers were PRESENT: Councilmembers
Mastin, Malone, Wattenburger, Shoemaker and Mayor Schneiter. ABSENT: None. Staff Present:
Public Utilities Director Bames, Finance Director Elton, Assistant City Manager Harris, City Manager
Horsley, Personnel Officer Revheim, Planning Director Sawyer, Senior Planner Stump, Senior Civil
Engineer Woods, and City Clerk Giuntoli.

3. CONSENT CALENDAR
MIS WattenburgerlShoemaker to approve the Consent Calendar as follows:
a. Received and Filed Report of the Acquisition of Professional Services Related to
Construction Administration for the Alternate Leachate Containment Project
The motion carried by the following roll call vote: AYES: Councilmembers Mastin, Malone,
Wattenburger, Shoemaker, and Mayor Schneiter. NOES: None. ABSTAIN: None. ABSENT:
None.

Adoption of Ordinance Amending the City Zoning Map to Rezone 51 Lots in the
North/Central Area Neighborhood
Mayor Schneiter and Councilmember Wattenburger recused themselves from the meeting at 5:03
p.m.
Senior Planner Stump advised he would, with the concurrence of the Council, dispense with the
staff repod, and answer questions from Council.
MIS Malone/Mastin to adopt Ordinance No. 975 Amending the Official Zoning Map for the City of
Ukiah, CA, rezoning 51 lots in the North/Central Area Neighborhood, carried by the following roll call
vote: AYES: Councilmembers Mastin, Malone, and Shoemaker. NOES: None. ABSTAIN: None.
ABSENT: Councilmember Wattenburger and Mayor Schneiter.

Mayor Schneiter and Councilmember Wattenburger returned to the meeting at 5:04 p.m.
Councilmember Shoemaker recused himself from the meeting at 5:04 p.m.
Senior Planner Stump advised he would dispense with the staff repods on all three ordinances
unless there were questions from Council.

Council informed Councilmember Mastin of their actions at the October 16 meeting regarding
amending the proposed ordinance.

Planned Development, carried by the following roll call vote: AYES: Councilmembers Malone,
Wattenburger, and Mayor Schneiter. NOES: Councilmembers Mastin and Shoemaker. ABSTAIN:
None. ABSENT: None.
NEW BUSINESS
Discussion Re.qardin~ Procedure for City Clerk Appointment, Approval of Jol:
Description for City Clerk Position~ and Authorization of City Manager to Initiate
Recruitment Process
Personnel Officer Revheim advised that since the deadline of October 22 had passed for "write-in"
candidates to file nomination papers for the elected City Clerk position, staff was requesting the
approval of the proposed City Clerk job description and the initiation of the recruitment process and
subsequent appointment. The only other option allowed by State law is to hold a special election
to fill the vacant position.
Discussion followed relative to the recruitment process, wherein it was noted the position would be
advertised via press release to local media and agencies, and that applicants were required to be
residents of the City. It was further noted the person selected will become an elected official, and
that the selection will be made by the Council. Candidates will be informed of the possibility of late
hours of Council meetings and other special duties and responsibilities of the position.
City Manager Horsley advised that the information regarding City Council meetings and regular
office hours will be added to the job description, although the actual designated hours will be
negotiated during the selection process.
MIS Shoemaker/Wattenburger to approve the revised City Clerk Job Description, and authorize the
City Manager to initiate the recruitment process, carried by an all AYE voice vote.
5b.
Ado~)tion of Resolution Confirmin.q City Mana.qer's Appointment of Assistant City
Mana_cler as Parking Citation Administrative Hearinq Examiner
Ms. Horsley advised the California Vehicle Code specifies the requirements for serving as a Hearing
Examiner for appeals of parking citations. Though the Finance Director was assigned this task
several years ago, the statute stipulates that "The Examiner shall be separate and independent from
the citation collection or processing function." It was determined that this function can best be
included in the duties of the Assistant City Manager. The required Parking Hearing Officer training
has already been taken by one of the City employees, and that information will be passed along to
the new Hearing Examiner.
MIS Mastin/Wattenburger to adopt Resolution No. 97-32 Confirming City Manager's Appointment
of Assistant City Manager as the Parking Citation Administrative Hearing Examiner, carried by the
following roll call vote: AYES: Councilmembers Mastin, Malone, Wattenburger, Shoemaker, and
Mayor Schneiter. NOES' None. ABSTAIN: None. ABSENT: None.
At this time, Mayor Schneiter asked the Councilmembers for any reports they wished to make.
Councilmember Mastin had no report.

Councilmember Malone reported he had attended the Northwestern Pacific Railroad meeting, and
felt the situation with the North Coast Railroad Authority was beginning to stabilize under the new
director, Dan Hauser.
Councilmember Wattenburger had no report.
Councilmember Shoemaker reported he had performed the swearing in ceremony for the
AmeriCorps volunteers. Their main emphasis will be working with children, and children's programs.
Mayor Schneiter reported the Mayors/Managers would meet tomorrow in Willits.
City Manager Horsley suggested the date of November 15, at 2:30 p.m., for the swearing in of the
successful candidates for City office by Marsha Young, County Clerk-Recorder. She also requested
the Council look at the Financial Reports, which have been customized for the Council's clarity and
understanding, and offer comments and suggestions. She further explained the code designation
"999" on the report was a computer notation that the item should be examined further.
It was noted there was a conflict with "Leadership Mendocino" on the November 15 date.
Mayor Schneiter reminded the outgoing Councilmembers to complete Form 721 Disclosure of
Economic Interest. '
