HomeMy WebLinkAbout92-48! 4 5 RESOLUTION NO. 92-48 ., , RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH ADOPTING MEMORANDUMS OF UNDERSTANDING BETWEEN THE CITY OF UKIAH AND THE UKIAH MANAGEMENT, MISCELLANEOUS, AND ELECTRICAL UNITS WHEREAS, the Employee/Employer Relations Officer has met and conferred in good faith with representatives of the Ukiah Management Unit, Miscellaneous Unit, and Electrical Unit; and WHEREAS, Memorandums of Understanding have been arrived at; and WHEREAS, said Memorandums of Understanding have been presented to the 10 City Council for its consideration. 11 12 13 NOW, THEREFORE, BE IT RESOLVED that these Memorandums of Understanding are hereby adopted and the Employee/Employer Relations Officer is authorized to enter into these Agreements for the fiscal 14 15 year 1992-94. Henderson, Mayor 28 MEMORANDUM OF UNDERSTANDING 1992-94 This Memorandum of Understanding is entered into pursuant to the Meyers-Millias-Brown Act (California Government Code Section 3500 et. seq.) and applicable ordinances and resolutions of the City of Ukiah between the City of Ukiah (hereinafter City) and the Operating Engineers Local Union #3, Electrical Association Unit (AFL/CIO) (hereinafter Union). As a result of meet and confer sessions, the City and Unit have agreed to the following understandings: Term The term of this agreement shall be two years, effective July 5, 1992 through June 30, 1994. First Year (7/5/92 - 6/30/93) 1. Health and Welfare/Income Supplement Effective July 4, 1992 $50.00 per month will be allocated to each employee of this Unit. The $50.00 may be used towards the monthly health and welfare benefit premium payments or taken as a cash income supplement. Allocation of the $50.00 must be designated on a City designation form. Employees may change their designation in the first pay period of July of each year. 2. Miscellaneous The City agrees to discuss with the Unit and Department, the three policy issues itemized in the Units request before July 1, 1992. Second Year (7/4/93 - 6/30/94) · 2% at 55 Program for the Public Employees Retirement System (PERS) The City and Unit agree to enter a contract with PERS to amend the Miscellaneous, Electric and Management Units retirement contract to a 2% at 55 program. The City will adopt an ordinance to this effect in order to meet the July 1, 1992, deadline required by PERS. The employer contribution increase will be effective as of July 1, 1993. The City and Unit agree to adopt the 18 year plan which would be an increase to the City's PERS contribution of 4.263% for the next 18 years, and then 2.283% as a permanent increase after the 18 years. 2. Second-Year Negotiations The City and Unit agree that they will meet in good faith in March, 1993, to discuss negotiation issues (salary, benefits, etc.), taking into account City funds available, other demands on the City's budget, and the overall financial standing and solvency of the City. The City is committed to discussing options of further negotiated benefits dependant on these factors. Also taken into consideration will be the fact that the Unit, realizing the economic conditions facing the City for Fiscal Year 1992-93, negotiated in extremely good faith with the City by negotiating for a 6.6% initial package over a two-year period. The response and attitude of the Unit to these conditions are recognized and appreciated and have lead to a commitment by the City for this scheduled renegotiation of the second year. . Continuation The City and Unit agree that all conditions of employment established by City policy or previous agreement of the parties, including all conditions affecting wages, hours, and working conditions that are not specifically addressed in this Memorandum of Understanding shall continue in effect and will not be affected by the terms of this Memorandum of Understanding. R:Employ Mou Elec MEMORANDUM OF UNDERSTANDING 1992-94 This Memorandum of Understanding is entered into pursuant to the Meyers-Millias-Brown Act (California Government Code Section 3500 et. seq.) and applicable ordinances and resolutions of the City of Ukiah between the City of Ukiah (hereinafter City) and the Ukiah Management Unit (hereinafter Unit). As a result of meet and confer sessions, the City and Unit have agreed to the following understandings: Term The term of this agreement shall be two years, effective July 5, 1992 through June 30, 1994. First Year (7/5/92 - 6/30/93) 1. Flex Plan The City and Unit agree to allocate an additional 2% of base salary towards the Flex plan. 2. PERS Effective July 5, 1992, the City agrees to pay an additional 3% (for a total of 10%) of monthly salary to PERS on behalf of such Public Safety members in the Management Unit. The Public Safety employee has the option to convert the 10% City-paid employee portion of PERS fringe benefit into their base salary during the last year of employment before retirement. It is recommended that this option be designated to Payroll at least one year before retirement as PERS does not allow for retroactivity.
