RESOLUTION OF THE CITY OF UKIAH CITY COUNCIL
APPROVING USE PEP$.IIT NO. 79- 25 , LAS CASAS
SUBD IV I S I ON
I~-~RFAS, the land encompassed by the Las Casas Subdivision is the subject
of a proposed annexation known as the Las Casas/Vineyard Vi,:eF Annexation, and
~RFAS, said territory has been prezoned PD, Planned Development in
anticipation of the annexation, and
WHERFAS, the "PD", Planned Development zone requires a use permit to be
reviewed and approved by the Planning Commission and the City Council prior
to any development taking place within that zone, and
~REAS, on August 8, 1979 the Planning Commission approved the use permit
subject to 27 conditions, and
~tEREAS, the focused Environmental Impact Report for subject property was
found adequate and complete by the Planning Commission and by the City
Council on September 5, 1979,
NOW THEREFORE BE IT RESOLVED, that Use Permit No. 79-25 is approved subject
to the following conditions:
1. A specific density of seven dwelling units per acre, net, be allowed.
2. In-lieu fees for park acreage, equivalent to 4.5 acres, shall be paid by
developer; per acre amount of funds to be determined at time of tentative
subdivision map submittal.
3. The developer shall dedicate easements for the purpose of assuring that
each parcel or unit in the subdivision shall have solar access for
reasonably placed solar energy systems. Planning Commission shall adopt
such regulations as may be necessary to guide approval of such easements
to insure no solar collector is shaded between 9:00 a.m. and 3:00 p.m. on
December 21.
4. All major residential streets shall be laid out in an east/west direction in
accordance with AB3250. Lot configurations shall provide for private yard
space to the south of the dwelling whenever possible. Ail zero lot line
units shall be designed and constructed to provide equal solar access for
both units. Any units which do not conform to these specifications shall
be furnished with external shading devices on all west facing windows. Ail
units in the subdivision shall be constructed with overhangs that shade 75%
of the south facing walls on June 21.
5. No setback requirements should be exercised which would prevent the use
of reasonably placed solar systems. All setback requirements should
! remain flexible enough to allow for active or passive solar access,
2 energy conservation or innovative design.
3 6. Subdivision map to be filed for the entire property.
4 7. Site development permit to be required on all development including single
5 family attached units except single family detached structures.
6 8. Hours of construction be limited to 7:00 a.m. - dark, Monday through
7 Saturday.
8 Alternate routes for construction traffic be used to avoid residential areas
9 and Low Gap Road. Said routes to be approved by the Planning and Public
10 Works Directors prior to commencement of construction.
11 10. Initial construction of Las Casas shall 'be phased in the following manner:
12 First phase- Empire Drive from Carrigan Lane east to project boundary,
13 including lots taking access from Empire; Second phase- Bush from boundary
14 of Vineyard View southerly to project boundary at Frank Zeek School,
15 including lots taking access from Bush Street.
16 11. Dust control measures to be instituted during construction.
17 12. All standards applicable to development within the City of Ukiah shall be
18 complied with.
19 13. The developer shall be responsible for the dedication and improvement of
20 the full widths of all streets within the development.
21 14. Ail. "0" lot line attached units shall have a minimum open sideyard setback
22 of 7 feet.
23 15. Carrigan Lane right-of-way be 60' through the subdivision.
~4 16. Number of units per lot shall be as noted on the map made part of this
25 use permit.
26 17. Ail "0" lot iine attached units shall be constructed with two one-hour
27 firewalls as the common wall and conform to the Uniform Building Code as it
28 relates to noise attenuation.
29 18. "0" lot 1. ine lots, designated "2" on Las Casas map, be clearly defined as
individual lots.
9. Bicycle lanes be constructed on Despina Drive, Low Gap to project northerly
boundary, and on Bush Street from Low Gap to Empire Drive.

20. Proposed "0" lot line lots along Despina Drive be changed to standard
single family detached lots and the proposed single family detached
lots on the North side of Empire Drive be changed to "0" lot line lots.
21. Single family detached units shall meet R-1 site requirements; fourplexes
shall meet R-3 requirements. Both single family detached units and
four plexes are exempt from front setbacks of their respective zone.
22. The City of Ukiah shall provide the water service to this subdivision.
23. Development plan map, Exhibit A, attachedhereto, is made part of this
resolution and approved use permit.
24. Developer to construct low-income housing in the Las Casas project
with the number of units to be worked out with the local representative
of Farmers Home Administration;funding guarantee and paperwork to be
completed by Farmers Home Administration in conjunction with Developer
no later than 24 calendar months from November 7, 1979; if not
completed within that time this condition is void and of no force or
effect.
17 '! 25. Off-street parking requirements for the Farmers Home Administration

PASSED AND ADOPTED this 7th day of November, 1979, by the following
roll call vote:
AYES: Councilmembers Hickey, Myers, Simpson, Mayor Snyder.
NOES: None
ABSENT: Councilman Brannon.
