PLEDGE OF ALLEGIANCE Ukiah City Council met at a Regular Meeting on June 6, 2018, having been legally noticed on June 1, 2018. Mayor Doble called the meeting to order at 6:07 p.m. Roll was taken with the following Councilmembers Present: Jim O. Brown, Stephen G. Scalmanini, Douglas F. Crane, Maureen Mulheren, and Kevin Doble. Staff Present: Sage Sangiacomo, City Manager: David Rapport, City Attorney; and Kristine Lawler. City Clerk. MAYOR DOBLE PRESIDING. The Pledge of Allegiance was led by Councilmember Brown. 3. PROCLAMATIONS/INTRODUCTIONS/PRESENTATIONS a. Status Report, Discussion and Possible Action Regarding the Ukiah Valley Sanitation District's Litigation Against the City of Ukiah Related to the Operation of the Sanitary Sewer System. Presenter: Sage Sangiacomo, City Manager and David Rapport, City Attorney. Presentation was received. 4. PETITIONS AND COMMUNICATIONS 5. APPROVAL OF MINUTES a. Approval of the May 16, 2018, Regular Meeting Minutes Motion/Second: Brown/Mulheren to approve Minutes of May 16, 2018, a regular meeting, as submitted. Appeal of Planning Commission Decision to Approve a Major Site Development Permit for the Construction of a 7,500± Square Foot Metal Building to House Support Services for Garton Tractor at 285 Talmage Road. Presenters: Craig Schlatter, Community Development Director and Greg Owen, Airport Management. Appellant Comment: Councilmember Crane. PUBLIC HEARING OPENED AT 6:53 P.M. Public Comment: Ron Hunt. Planning Commissioner; Randy Beckler, Airport Commissioner and Airport Land Use Commissioner, Eric Crane, Airport Commissioner and Airport Land Use Commission Chair, PUBLIC HEARING CLOSED AT 7:34 P.M. Motion by Mulheren, Seconded by Brown to: 1. Adopt motion to amend the Conditions of Approval to include the following: 25. Project will be amended to be reduced in size such that the entire building is located outside the Runway Protection Zone of the Ukiah Municipal Airport; and 2. Adopt the findings in Attachment 2 to support upholding the Planning Commission's October 11, 2017, decision to approve the Major Site Development Permit, with the following two additional findings: • Finding #1 (#8): By reducing the Project's building size such that it is not in the Runway Protection Zone of the Ukiah Municipal Airport, the Project will not create undue hazards to flight as determined by the Federal Aviation Administration; and • Finding #2 (#9): The Project location in the A* zone of the Ukiah Municipal Airport Master Plan compatibility zoning map does not prevent this Project or other projects unless or until the City is in the position to prevent such projects. Councilmember Brown withdrew his second. Motion/Second: Crane/Scalmanini to continue the hearing until the City receives a consistency determination from the Mendocino County Airport Land Use Commission (ALUC) pursuant to staff recommendation number 3 in the Agenda Summary Report and the Planning Commission makes a recommendation to the City Council to approve or disapprove the application. after the Commission considers the ALUC determination and any additional information from staff. The Mayor is authorized and directed to send a letter to the ALUC requesting that it make the consistency determination as soon as possible. Adoption of Resolution Approving a Negative Declaration for the City of Ukiah Wastewater Treatment Plant Land Acquisition Project. Presenter: Craig Schlatter, Community Development Director PUBLIC HEARING OPENED AT 8:25 P.M. No public comment was received. PUBLIC HEARING CLOSED AT 8:28 P.M. Motion/Second: Crane/Brown to adopt resolution (2018-12) approving a negative declaration for the City of Ukiah Wastewater Treatment Plant land acquisition project. Motion carried by the following roll call votes: AYES: Brown. Scalmanini, Crane, Mulheren, and Doble. NOES: None. ABSENT: None. ABSTAIN: None. Motion/Second: Crane/Scalmanini to give final authorization to purchase land for the City of Ukiah Wastewater Treatment Plant. Discussion of Interest in Drafting a Letter to the Mendocino County Airport Land Use Commission Seeking Collaboration for Updating the Mendocino County Airport Comprehensive Land Use Plan, and Consideration of Other Process Related Direction. Presenter: Craig Schlatter, Community Development Director. Public Comment: Eric Crane, Airport Commissioner and Airport Land Use Commission Chair. Council Consensus directs staff to develop a draft letter to the Mendocino County Airport Land Use Commission seeking collaboration for updating the Mendocino County Airport Comprehensive Land Use Plan with a referral to the Ukiah Airport Commission prior to returning to the City Council for final consideration, and to draft a resolution to bring back to Council. b. City Council to Review the User Fee Schedule for the Community Services Department Including Recreation Programs, Sports Fields, Parks, Municipal Pools, Ukiah Valley Conference Center, and the Grace Hudson Museum. Presenters: Tami Bartolomei, Community Services Administrator and Jake Burgess, Recreation Supervisor. Motion/Second: Mulheren/Crane to approve the user fee schedule for the Community Services Department including recreation programs, sports fields, parks, municipal pools, Ukiah Valley Conference Center, and the Grace Hudson Museum. Motion carried by the following roll call votes: AYES: Brown, Scalmanini, Crane, Mulheren, and Doble. NOES: None. ABSENT: None. ABSTAIN: None. c. Adoption of Resolution Calling for the Holding of a General Municipal Election to be Held on November 6, 2018, and to Consolidate and Request the County Clerk to Conduct Said Election with the Statewide General Election. Presenter: Kristine Lawler, City Clerk. Motion/Second: Crane/Scalmanini to adopt the resolution (2018-13) calling for the holding of a General Election November 6, 2018; to consolidate said Election with the Statewide General Election pursuant to Election Code §10403; and request the Board of Supervisors of the County of Mendocino to request the County Clerk to Conduct the Municipal Election of the City of Ukiah on Tuesday, November 6, 2018, pursuant to Election Code §10002. Motion carried by the following roll call votes: AYES: Brown, Scalmanini, Crane, Mulheren, and Doble. NOES: None. ABSENT: None. ABSTAIN: None. d. Receive Updates on City Council Committee and Ad Hoc Assignments. This item was continued to the next Council meeting on June 20, 2018. 12. UNFINISHED BUSINESS a. Consideration and Possible Approval of the Cost Allocation Plan Review, Fiscal Year 2017-18 Presenter: Dan Buffalo, Finance Director. Motion/Second: Brown/Mulheren to approve and authorize the allocation of indirect cost per the Plan for BY 217-18; apply and report on the allocation quarterly; and maintain an allocation that is uniformly applied.
