HomeMy WebLinkAbout81-32 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO, 81-32 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH APPROVING AGREEMENT FOR FUNDING OF TRANSIT SERVICES BE IT RESOLVED that certain Agreement For Funding Of Transit Services attached hereto and made a part hereof is hereby approved and the Mayor and Clerk are authorized to execute same on behalf of the City. PASSED AND ADOPTED this 19thday of November by the following roll call vote' AYES: Councilmembers Riley, Feibusch, Snyder, Myers, Hickey NOES: None ABSENT: None , 1980, ATTEST: City C1 erk Mayor AGREEMENT FOR FUNDING OF TRANSIT SERVICES WHEREAS, MCOG has the responsibility for allocating TDA funds; and WHEREAS, in order to avoid possible duplication and to encourage cooperation, MCOG has allocated funds for Ukiah Dial-a-Ride through MTA; and WHEREAS, responsibility for policy, administration and operation of the Ukiah Dial-a-Ride is with the Ukiah City Council, NOW, THEREFORE, it is agreed as follows: 1) MTA shall pay to City a total amount not to exceed $78,963.00 to reimburse City for the actual costs of operation of the Dial-a-Ride during fiscal 1980-81. Claims sha~l be submitted by City on a monthly basis and shall be promptly forwarded by MTA to Mendocino County Auditor Controller for issuance of a warrant to City. 2) Indemnification. City shall hold MTA harmless from any and all claims or suits arising from damages to persons or property which may result from City's operation of the Ukiah Dial-a-Ride. City shall provide MTA with a certificate of -1- of insurance giving evidence of coverages main- tained by City. Said certificate shall provide for not less than 30 days written notice to MTA in the event of any material change in insurance coverage. 3) Audit. Ail City records related to the Dial-a-Ride operation shall be open to inspection and audit by MTA throughout the life of this agreement. 4) Compliance with State and Federal law. City shall comply with State law applicable to use of TDA funds and with any other state or federal regulations applicable. 5) In order to meet the purposes of MCOG and to foster cooperation, City and MTA staff shall meet monthly to exchange information service, reducing costs, sharing staff, or other cost saving operational changes.
