RESOLUTION OF THE CITY OF UKIAH COUNCIL DECLARING THE COUNCIL'S INTENTION
TO SUPERVISE AND REGULATE THE DESIGN, CONSTRUCTION, OPERATION,
ENLARGEMENT, REPLACEMENT, AND REMOVAL OF RECYCLED WATER STORAGE AT
THE UKIAH WASTEWATER TREATMENT PLANT
WHEREAS, City of Ukiah ("City") owns and operates the Ukiah Wastewater Treatment Plant
("UWWTP") at 300 Plant Road, Ukiah, which collects and treats wastewater for the City and the
Ukiah Valley Sanitation District; and
WHEREAS, the Ukiah Recycled Water Project ("Project") includes a "Recycled Water Storage
Pond" which is an essential part of the design, construction, operation, and maintenance of the
Project. The Project is necessary for the City to supply sufficient recycled water to users within
the City and the Ukiah Valley; and
WHEREAS, the regulation of dams and reservoirs in the State of California is exclusively by the
State pursuant to Section 6025 of the California Water Code (CWC); and
WHEREAS, the requirements for State regulation and supervision of the safety of dams shall not
be applicable to wastewater treatment and storage pond construction as part of a wastewater
control facility that meets the requirements of Section 6025.5 of the CWC.
NOW, THEREFORE, BE IT RESOLVED by the City Council, as follows:
Section 1. The Council finds and determines that said Recycled Water Storage Pond will be
designed, constructed, and operated to standards adequate to protect life and property, and that
the Council shall supervise and regulate the design, construction, operation, enlargement,
replacement, and removal of the ponds after the effective date of this resolution;
Section 2. The City Council finds and determines that the proposed Recycled Water Storage
Pond shall (1) have a maximum height of 15 feet or less above the existing ground surface level
and a maximum storage capacity of 1,500 acre-feet or less and (2) be designed and constructed
under the supervision of a registered Civil Engineer, and (3) is not across a stream channel or
water course in compliance with Section 6025.5 (c) of the CWC;
Section 3. The declarations contained herein are made solely for the purpose of establishing
compliance with the requirements of Section 6025.5(b) of the CWC. Such findings and
declarations do not bind the Council to make any expenditure, incur any indebtedness, or to
proceed with the Project.
Section 4.This Resolution shall take effect immediately upon its adoption by the City Council and
the Council Minutes shall document and certify the vote adopting this Resolution.
