HomeMy WebLinkAbout82-712 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 82-71 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH CALLING FOR CHANGES IN LAFCO VOTING PROCEDURES WHEREAS, City representatives serving on the Local Agency Formation Commission (LAFCO) are disqualified from voting when LAFCO is considering a proposal to annex territory to the City in which the city representative is a City Council member; and, WHEREAS, in being disqualified from voting, the City representative is often prohibited from participating in action on a proposal about which he may have the best understanding of its issues and merits; and, WHEREAS, all annexations and reorganizations not only affect the tax base of and provision of services by the affected city, but also affect the County unincorporated area tax base and services, yet County LAFCO members are not disqualified from voting; and, WHEREAS, public objection to the disqualification of City representatives has been expressed by both city residents and unincorporated area residents~ and, WHEREAS, AB2004, which has been introduced, which would remove the automatic disqualification provision from state law; and, WHEREAS, current Mendocino County Local Agency Formation Commission bylaws provide for the automatic disqualification of City LAFCO representatives from voting when LAFCO is considering any proposal (annexation, reorganization, sphere of influence, etc.) which affects the city in which the city representative is a City Council member. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Ukiah calls upon the Mendocino County Local Agency Formation Commission to change its bylaws to eliminate the automatic disqualification of city representatives from voting on matters affecting the city in which the city representative is a City Council ~ember; and, BE IT FURTHER RESOLVED, that the Ukiah representative to LAFCO is hereby instructed to vote for the above indicated change in the bylaws of the Mendocino County Local Agency Formation Commission; and, 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 BE IT FURTHER RESOLVED, that the City Council supports the adoption of AB2004 and hereby instructs the Mayor to address a letter to our representatives in the state legislature urging their support of this bill.
