RESOLUTION NO. 82-63
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
APPROVING THE FINAL MAP FOR PEAR TREE BUSINESS PARK
WHEREAS, the Planning Commission has considered and recommended approval
of the Final Map for Pear Tree Business Park as being consistent with the
adopted Tentative Map, and
WHEREAS, the Director of Public Works reports that the City of Ukiah has
sufficient wastewater treatment capacity to handle wastewater from this project
without violation of the Water Quality Control Board Standards.
NOW, THEREFORE, IT IS HEREBY RESOLVED that the Final Map for the aforesaid
project is approved subject to the conditions noted in this Resolution and on
the map, and the Mayor and City Clerk are authorized to sign said map at such
time as Subdivider signs and fulfills all the requirements of an Agreement for

City of Ukiah. The Mayor and City Clerk are hereby authorized to sign said
agreement. Conditions for development include:
1) An overall landscaping plan for Hospital Drive be provided when
the first Site Development Permit is heard and implementation
required of each developer.

AGREEMENT FOR
SUBDIVISION IMPROVEMENTS
THIS AGREEMENT is made and entered into by and between the City of Ukiah,
California, hereinafter referred to as "City" and Alex R. Thomas and
Gabrielle A. Thomas
hereinafter referred to as "Subdivider," both of whom understand as follows:
RECITALS:
Subdivider has presented to City for approval a final subdivision map
.(hereinafter called "Map") entitled "Pear Tree Business Park Subdivision."
The map has been filed with the City Clerk of City for presentation to the
City Council of the City for its approval, which map is hereby referred to and
incorporated herein;
Subdivider has requested approval of the map prior to the construction
and completion of public electrical utilitY facilities which are a part of, or
appurtenant to, the subdivision (hereinafter called "subdivision") designated
in the map, all as required by, the City Engineer of City:

offered, or some thereof, on condition that Subdivider first enter into and execute
this Agreement with City, and meet the requirements of said Resolution; and
This Agreement is executed pursuant to the provisions of the Subdivision
Map Act of the State of California and Chapter 1 of Division 9, Ukiah City Code.
,~. , The Subdivider has completed all required street improvements for Pear
Tree Business Park Subdivision with the exception of the Electrical and Street
Lighting Systems and, whereas, the ultimate developed use of the lots within
the Subdivision can not be determined at this time, it is mutually beneficial
to the City and the Subdivider to delay the construction of the Electrical
and Street Lighting facilities until specific uses are known which will
determine the locations and sizes required for the systems.
NOW THEREFORE, for and in consideration of the approval of the Map of the
acceptance of the dedications of some thereof, there~n offered, and in order to
insure satisfactory performance by Subdivider of Subdivider's obligations under
said Subdivision Map Act and said code, the parties agree as follows:
1. PERFORMANCE OF WORK.
Subdivider will do and perform, or cause to be done and performed, at
Subdivider's own expense, in a good and workmanlike manner, and furnish
all required materials, all under the direction and to the satisfaction of
the City Engineer of City, all of the following work and improvements
within (and/or without) the Subdivision, to wit:
Construct and install all necessary street lights and underground electrical
conduit and conductors within the street right of way to provide service
for each lot and street light required along the frontage of such lot, at
such time as a permit to develop any such lot is approved by the City, and
Subdivider shall also do all work and furnish all materials necessary
in the opinion of the City Engineer, and on his order, to complete the improve-
ments in accordance with the plans and specifications on file as hereinbefore
specified, or with any changes required or ordered by said Engineer,
which in his opinion are necessary or required to complete the work.
2. WORK; PLACES AND GRADES TO BE FIXED BY ENGINEER.
All of said work is to be done at the places, of the materials, in the manner,
and at the grades, satisfactory to the City Engineer.
3. WORK; TIME FOR PERFORMANCE.
Subdivider agrees that at such time as one-third of the lots within said
Subdivision are developed, the remaining electrical facilities shall be
completed prior to additional lot development, if so required by the City
Engineer. Subdivider shall notify City Engineer in writing to the date
fixed by Subdivider for commencement thereof, so that City Engineer shall be
able to provide services of inspection.

City the actual cost of such repairs plus fifteen (15) percent.
SUBDIVIDER NOT AGENT OF CITY.
Neither Subdivider nor any of Subdivider's agents or contractors are, or
shall be considered to be, agents of City in connection with the perfomance
of Subdivider's obligations under this agreement.

All notices herein required shall be in writing and delivered in person
or sent by certified mail, postage prepaid.
