HomeMy WebLinkAbout82-57 1 2 4 5 6 7 8 9 10 11 12 15 14 15 16 17 18 19 20 21 22 2~ 24 25 26 2q 28 RESOLUTION NO. 82-57 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH INITIATING PROCEEDINGS FOR THE AIRPORT-SOUTtt STATE STREET REORGANIZATION NO. 81-10 ?~ERF~S, Government Code Section 56292 requires that a conducting authority adopt a resolution initiating Reorganization proceedings after formal action the Local Agency Formation Commission on any proposed reorganization, and WHEREAS, Government Code Section 56310 stipulates the contents of such resolution, and ;~HERF~S, the Mendocino County Local Agency Formation Commission on April 5, 1982 adopted Resolution No. 82-2 approving Reorganization No. 81-10 for the Airport-South State Street Reorganization and the City of Ukiah has received a certified copy of said resolution from the Executive Director designating the City as the conducting authority. NOW THEREFORE BE IT RESOLVED: a) The City of Ukiah on June 17, 1981 commenced preliminary proceedings for subject reorganization by adopting Resolution No. 81-80, a resolution of application made pursuant to Government Code Section 56195 to the Local Agency Formation Commission including a plan for providing services; and b) The short term designation of this reorganization is "Airport-South State Street Reorganization" bounded on the west by South State Street, on the north and east by existing City boundaries and U.S. 101 Freeway, and on the south by properties fronting on the south side of Norgard Lane, and c) The territory proposed to be reorganized is inhabited as determined by the Local Agency Formation Commission in its Resolution No. 82-2 making determinations; and d) The reason for the proposed reorganization is to include the subject land wi. thin the City of Ukiah for provision of urban services to existing and proposed development; and e) Resolution No. 82-2 of the Mendocino County Local Agency Formation -1- 1 2 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 2~ 24 25 26 27 28 Commission stipulates that the reorganization include annexation to the City of Ukiah, detachment from the Ukiah Valley Fire Protection District and" ... the condition that even though the area proposed for annexation is detached from the Willow County Water District (~C~), the WCWD operations, within the subject area to all existing customers shall continue at the present level until the expiration of current WCWD bonded indebtedness and until formal agreement be- tween the City of Ukiah and I~C~ regarding long-'termplans for water service provision is reached. Water services to any new development in the area shall not be approved by the City of Ukiah without, prior consultation with ¥'~D. Termination of such agreement by a subsequent agreement shall not mean automatic removal of the District from serving existing customers, yet does not imply a right to continue to serve existing customers in the Airport-South State Street annexation area beyond the expiration of bonded indebtedness. An agreement(s) between the City o£Ukiah and the WCWD reflecting in concept this condition, shall be completed no later than 120 days follows I~FCO con- ditional approval through this resolution." f) June 16, 1982, 7:00 P.M., the City Council Chambers, 111 W. Church Street is the date, time and place set for a public hearing by the City Council to consider the reorganization and receive any protests against it; and g) The City Clerk is directed to notice said hearing pursuant to Government Code Sections 56311 and 56312 including published notice in the newspaper, posted notice on the property and mailed notice to all property owners and registered voters within the reorganization boundaries, no later than 15 days prior to the hearing date; and h) Since the territory to be annexed is declared inhabited, any owner of land~thin the affected territory or registered voter may file a written protest ~§~$tthe reorganization pursuant to Government Code Section 56317 with the City Clerk prior to the commencement of the City Council hearing 1 2 4 6 7 8 9 10 11 12 14 15 16 17 18 19 20 21 22 2~ 24 26 27 regarding Reorganization No. 81-10.
