HomeMy WebLinkAbout82-51 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 82-51 RESOLUTION OF THE CITY COUNCIL OF TIlE CITY OF UKIAH OF INTENT TO ESTABLISH A PARKING AND BUSINESS IMPROVEMENT DISTRICT AND BENEFIT ZONE WHEREAS, interest has been evidenced to the City Council of the City of Ukiah in the establishment of an assessment district for the improvement of the downtown business area, and, WHEREAS, the establishment of such an area is permitted by the provisions of Part 6, Division 18 (Sections 36500, et seq.) of the Streets and ttighways Code of the State of California entitled "Parking and Business Improvement Area Law of 1979", and, ~HEREAS, the City Council tentatively approves of establishing such area subject to final decision after appropriate legal notices are given and public hearings are held as hereafter set forth, NOW, THEREFORE, BE IT RESOLVED' The City Council does hereby express its intent to establish a parking and improvement area pursuant to Sections 36500, et seq., of the Streets and Highways Code of the State of California in the downtown area of Ukiah as follows' a. A description of the proposed area is as follows- Boundaries' On the North' Center line of Henry Street On the South' Center line of Clay Street On the I~est' Center line of Oak Street On the East' Center line of Main, Street " as more specifically described by the metes and bounds description attached hereto as Attachment "A", which by reference is made a part hereof, and as depicted on the map attached hereto as -1- 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 Attachment "B", which by reference is made a part hereof. b. The time and place of hearing to be held to consider establishment of such area is: Date: March 17, 1982 Place: City Hall, 203 South School St., Ukiah, CA. Time: 7:30 P.M. c. The proposed uses to which the proposed revenue shall be put are as follows: 1. Decoration of any public place in the area; 2. Promotion of public events which are to take place on or in public places in the area; 3. The general promotion of business activities in the area. d. A description of the system of assessments or charges which will be used and the businesses upon which the levy will be made are as follows: 1. An assessment shall be made upon the annual business license tax normally imposed upon each business in the area and shall be in the amount of 100% of each business license; 2. It is not contemplated that a classification system is to be used in making assessments or charges. e. There should be just one benefit zone, the boundaries of which are co-terminous with the described boundaries of the area. PASSED AND ADOPTED this 3rd day of March, 1982, by the following roll call vote: AYES: NOES: ABSENT: Councilmember Hickey, Feibusch, Riley, Myers None Councilmember Snyder ATTEST: City C1 erk Mayor , CITY OF UKIAH PARKING AND BUSINESS IMPROVEMENT DISTRICT BOUNDARY DESCRIPTION Beginning at the intersection of the centerline of Oak Street with the centerline of Henry Street; thence Easterly along the centerline of Henry Street and the Easterly extension of said centerline to its intersection with the Easterly line of State Street; thence Southerly along the Easterly line of State Street to an iron pin designated as "J" as shown on map of a portion of Block 6 in the Town of Ukiah City, made by R.E. Donohue and recorded March 6, 1908 in the Office of the Recorder of Mendocino County in Book 2 of Maps and Surveys, Page 2, Mendocino Records; said iron pin "J" being a point in the Easterly extension of the Southerly line of Henry Street; thence Easterly along said Easterly extension of said Southerly line of Henry Street to a point in the centerline of Main Street; thence Southerly along the centerline of Main Street to its intersection with the centerline of Clay Street; thence Westerly along the centerline of Clay Street to its intersection with the centerline of Oak Street; thence Northerly along the centerline of Oak Street to its intersection with the centerline of Henry Street, and the point of beginning.
