HomeMy WebLinkAbout82-41 ! 2 4 5 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 2~ 24 25 26 27 28 RESOLUTION NO. 82-41 RESOLUTION OF ~ CITY OF COUNCIL OF THE CITY OF UKIAH INITIATING PROCEEDINGS FOR T~ MUNSON-HASTINGS REORGANIZATION NO. 81-6 I.~tEREAS, Government Code Section 56292 requires that a conducting authority adopt a resolution initiating Reorganization proceedings after formal action by the Local Agency Formation Commission on any proposed reorganization, and ~REAS, Government Code Section 56310 stipulates the contents of such resolution, and I~[EREAS, the Mendocino County Local Agency Formation Commission on December 7, 1981 adopted Resolution No. 81-14 approving Reorganization No. 81-6 for the blunson-Hastings Reorganization and the City of Ukiah has received a certified copy of said resolution mailed by the Executive Director designating the City as the conducting authority. NOlq ~-~REFOP~ BE IT RESOL\~D: a) The City of Ukiah on April 1, 1981 commenced preliminary proceedings for subject reorganization by adopting Resolution No. 81-65, a resolution of application made pursuant to Government Code Section 56195 to the Local Agency Formation Commission including a plan for providing services; and b) The short term designation of this reorganization is "Munson-Hastings Reorganization" bounded on the east by U. S. 101 Freeway and }lastings Road and on the north, south and west by existing City boundaries and Hastings Road. c) The territory proposed to be reorganized is inhabited as determined by the Local Agency Formation Commission in its Resolution No. 81-14 making determinations; and d) The reason for the proposed reorganization is to include the subject land within the City of Lrkiah for provision of urban services to existing and proposed development; and e) Resolution No. 81-14 of the }.lendocino County Local Agency Formation ! 2 4 5 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 24 25 26 27 28 Commission stipulates that the reoganization include annexation to the City of Ukiah, detachment from the Ukiah Valley Fire Protection District and extension of boundary to include Hastings and Frontage Road from Talmage Road to Hastings Avenue; and £) February 3, 1982, 7:00 P.M., the City Council Chambers, 111 W. Church Street is the date, time and place set for a public hearing by the City Council to consider the reorganization and receive any protests against it; and g) The City Clerk is directed to notice said hearing pursuant to Government Code Sections 563ii'and 56312 including published notice in the newspaper, posted notice on the property and mailed notice to all property owners and registered voters within the reorganization boundaries, no later than 15 days prior to the hearing date; and h) Since the territory to be annexed is declared inhabited, any owner of land within the affected territory or registered voter may file a written protest against the reorganization ~ursuant to Government Code Section 56317 with the City Clerk prior to the commencement of the City Council hearing regarding Reorganization No. 81-6.
