RESOLUTION NO. 82-7
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
UKIAH AUTHORIZING MAYOR AND CLERK TO SIGN
COMMUNITY RECREATION AGREEMENT (HIGH SCHOOL
PROPERTY)
WHEREAS, the City has applied for funds under the Land and Water
Conservation Fund Program for the development of recreation facilities
at the Ukiah High School site,
NOW, THEREFORE, IT IS HEREBY RESOLVED that the Mayor and Clerk are
authorized to sign the agreement between the Ukiah Unified School
District and the City for the use of the High School site for development
of community recreation facilities.
PASSED AND ADOPTED this 19th day of August , 1981, by the
following roll call vote:
AYES: Councilmembers Hickey, Feibusch, Riley, Myers

a municipal corporation, hereinafter referred to as "City" and
the~ Ukiah Unified School District, a body politic, hereinafter
referred to as "District".
W I TNE S SETH.
WHEREAS, the parties, on September 13, 1967, entered into
a continuing agreement for the use of District property' for a
program o.f community recreation pursuant to Section 16651 to
16665 inclusive of the California Education Code, (now section
10900 thru 10916);
WHEREAS, in the furtherance of the objectives of said.Agree-
ment, City has applied for funds under the Land and Water Con-
servation Fund Program for the development of recreation facili-
·
ties at the Ukiah High School Site.
NOW THEREFORE, in consideration of their mutual covenants
initially given, the parties hereto agree as follows.
1. District hereby gives to City permission to construct
on Ukiah High School grounds those improvements for recreational
use requested to be partially funded under the Land and Water
Conservation Fund Program. These improvements consist of a
restroom/dressing room and related areas adjacent to the swimming
pool.
2. District hereby agrees that the uses previously described,
including the swimming pool, shall be allowed to continue for a
period of at least twenty-five years and shall be available for
public use at.all normal operating times not in conflict with
regular school activities.
3. District shall maintain the facilities constructed under
this agreement.
