RESOLUTION NO. 82-3
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF UKIAH AUTHORIZING A PROCEDURE
FOR DESTRUCTION OF POLICE RECORDS
WHEREAS, the City of Ukiah is in need of a police rec-
ords destruction procedure as prescribed by law, and,
WHEREAS, Government Code Section 34090 provides that
the head of a City Department may destroy certain City records,
documents, or instruments under his charge, without duplication,
with the approval of the City Council by resolution and with the
written consent of the City Attorney, and,
WHEREAS, it has been determined that certain records
are no longer required for retention and an accumulation of polic.

NOW, THEREFORE, the City Council of the City of Ukiah
does hereby resolve as follows:
Section 1. The City Council of the City of Ukiah here.
by adopts the following policy with respect to records of the
Ukiah Police Department after the same is no longer needed and is
no longer required by law, without making a copy thereof.
A. The following records will be retained for two
years and subsequently destroyed:
1. Daily log/event report
2. Vacation check forms
3. Daily jail register
4. Officers' daily activity sheets
5. Court transmittals
6. Repossession reports
7. Warrant recall sheets

8. Crime report number sheets
9. Bail receipts
10. Parking citations
11. Deceased arrest files
12. Applicant sheets and fingerprint cards.
B. The following records will be retained for three
years and subsequently destroyed:
1. Expired bicycle licenses.
C. The following records will be retained for five
years and subsequently destroyed:
1. Stored/Impound vehicle reports
2. Non-injury accident reports
3. Injury/Overdose/Attempt suicide reports not
resulting in death
4. Lost and Found reports
5. Missing persons reports which have been cleare~
6. Miscellaneous complaint reports
7. Courtesy report for other agency
8. Moving violation citations
9. Misdemeanor citations
10. Misdemeanor crime reports, providing that:
a. There is no outstanding warrant related to
the report
b. There is no property outstanding in DOJ
(Department of Justice) or NCIC (National Crime Information Cente
c. There is no death connected with the re-
port

d. It is not involved in civil or criminal

e. It does not involve a Ukiah city employee
11. Photos and corresponding index cards relating
to destroyed records.
D. The following records will be retained for seven
years and subsequently destroyed:
1. Injury accident reports
2. Felony crime reports providing that:
a. There is no outstanding warrant related
to the report
b. There is no property outstanding in DOJ
(Department of Justice) or NCIC (National Crime Information Cente
c. There is no death connected with the
report
d. It is not classified under Section 800 &
290PC and 11590H&S.
Section 2. The records specified in Paragraph 1 of th
resolution do not include any documents relating to citizen com-
plaints or investigations in response to citizen complaints relat.

bribery of public officials, reports involving Ukiah city employ-
ees nor any prisoner arrest files and child abuse reports.
Section 3. The City Council finds that the City At-
torney has given his written consent to the destruction of the
records described in Section 1 of this resolution, and the Chief
of Police is authorized to destroy the police records described
in Section 1 of this resolution.
