1 RESOLUTION NO. 84-56
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH
2 DECLARING WEEDS AND RUBBLE UPON PRIVATE PROPERTY TO
BE PUBLIC NUISANCE AND ORDERING ABATEMENT OF SAME

4 WHEREAS, the continued growth and accumulation of weeds upon private
5 property within this City constitutes a continual public nuisance and fire
6 menace during the dry season; and
7 WHEREAS, continued accumulations of rubbish, refuse, and dirt upon
S certain private property within this City constitutes an unsightly public
9 nuisance as well as hazard to efficient fire control methods; and
10 WHEREAS, the Government Code of the State of California prescribes
11 procedure for the abatement of such weeds, rubbish, refuse, and dirt, which
12 procedure requires that the property owner remove such material and if he
13 fails that the City shall do so and assess the costs to the property owner.
14 NOW, THEREFORE, the City Council of the City of Ukiah does hereby
15 RESOLVE:
16 That all weeds, as defined in Section 39560 of the Government Code of
17 California, which are growing upon the private property, or the streets or
18 sidewalks fronting on such private property, hereinafter described, and all
19 rubbish, refuse, and dirt accumulated on such property, are, pursuant to the
20 authority of Article 2, Chapter 13, Part 2, Division 3, Title 4 of the
21 Government Code of California, hereby declared to be public nuisances and are
22 hereby ordered to be abated as such. The City Council does hereby find that
23 the properties upon which or in front of which the nuisances exist are as set
24 forth in the attached list, which list is incorporated by reference herein
25 and made a part of this Resolution as if set forth in full herein.
26 The owner or owners of each such property are hereby directed to remove
27 such weeds, rubbish, refuse, and dirt as indicated from, upon, or in front of
28 such property, and that upon the failure to so remove such weeds, rubbish,

3 refuse, and dirt, the nuisance will be abated and the weeds, rubbish, refuse,
4 and dirt removed by the City and the cost of removal will be assessed upon
5 the land from or in front of which the materials are removed and will consti-
6 tute a lien upon such land until paid.
7 BE IT FURTHER RESOLVED, that Wednesday, May 16, 1984 at 7:30 p.m. or as
8 soon thereafter as the same may be heard, in the Council Chambers, City Hall,
9 Ukiah, California, is hereby fixed as the time and place for hearing any
10 property owners having any objections to the proposed removal of weeds,
11 rubbish, refuse, and dirt.
12 The City Clerk is hereby directed to prepare and mail a written notice
13 as required by law to each person owning such described property as shown on
14 the records of the Assessor of Mendocino County. The Director of Public
15 Works of the City of Ukiah is hereby directed to post such notice or notices
16 upon such of the properties described as he may deem necessary to give
17 additional notice to property owners. The posted notices shall be for the
18 convenience and information of the public and are not intended to supplant
19 the official legal notices given by the City Clerk.
