RECORDER No Fee RESOLUTION NO. 84-50 RESOLUTION OF THE CITY OF UKIAH ABANDONING PUBLIC SERVICE EASEMENT WHEREFORE, the City of Ukiah has authority under Chapter 4, Part 3, Division 9 of the Streets and Highway Code (commencing with section 8300) to vacate a right-of-way, easement, or use restriction acquired for public use; and WHEREAS, the City has acquired easements across property commonly known as 5 Highland Drive South within the City of Ukiah, more particularly described hereafter; and WHEREAS, for more than the five (5) years immediately preceeding the date of this resolution the easements described herein have not been used for the installation, maintenance and repair of water, gas, sewer and underground electrical conduit pipes and lines, which were the purposes for which the easements were acquired by the City, and, in fact, said easements have never been used for these purposes since they were acquired in 1939; and WHEREAS, the City has agreed to abandon said easements on condition the owners of the property convey certain alternative easements to the City; NOW, THEREFORE, BE IT RESOLVED that: 1. Pursuant to Streets and Highways Code sections 8300 et seq. , the City of Ukiah abandons and vacates the following described easements : The underground portion of those 5 foot wide easements lying in Lots 13 and 14, Block 5, as shown on the map entitled "Map of Yokayo Heights Subdivision" filed in Map Case 1 , Drawer 6, Page 96, Mendocino County Records, more particularly described as follows: That 5 foot wide easement lying Northerly of, parallel with, and adjacent to the Southerly line of said Lot 14 and that portion of said Lot 13 lying Westerly of Highland Drive as presently extended. Also that 5 foot wide easement lying 2 1/2 feet on each side of the lot line common to said Lots 13 and 14. The City of Ukiah hereby retains the overhead (aerial) portion of said easements as accepted on said map. al.41447 w062 2. From and after the recordation of a certified copy of this Resolution in the official records of Mendocino County said easements are vacated as provided herein.
