HomeMy WebLinkAbout84-18 CITY COUNCIL OF THE CITY OF UKIAH RESOLUTION NO. 84-18 A RESOLUTION APPROVING THE ISSUANCE OF REVENUE BONDS - WHEREAS, the City of Ukiah (the "City" ) has undertaken the proposed issuance of revenue bonds in an amount not to exceed $18, 000, 000, and designated as City of Ukiah Electric Revenue Bonds, Series A (the "Bonds" ) pursuant to the Revenue Bond Law of 1941, being Chapter 6, Part 11 Division 2, Title 5 of the Government Code of the State of California, as supplemented and amended, to finance the acquisition and construction of hydroelectric generating facilities located at Coyote Dam on Lake Mendocino in Mendocino County, including related transmission facilities (the "Project" ) .to be used by the City; and WHEREAS, notice of a public hearing with respect to the proposed issuance of the Bonds was published on g119/S_1 , 1983, in the Ukiah Daily Journal, a newspaper of general circulation in the County of Mendocino; and WHEREAS, on Sept. 1 , 1983, said public hearing was held before a designated representative of this City Council, and an opportunity was provided for interested persons to present arguments for and against the issuance of the Bonds and the nature and location of the Project; and WHEREAS, the interest on such bonds may qualify for tax exemption under Section 103 (b) of the Internal Revenue Code of 1954, as amended (the "Code" ) , only if such bonds are approved in accordance with Section 103 (k) of the Code; and WHEREAS, the Project is located wholly within the geographic jurisdiction of the County of Mendocino, but partly outside the geographic jurisdiction of the City; and WHEREAS, this City Council is the elected legislative body of the City of Ukiah, and is the applicable elected representative required to approve the issuance of the Bonds pursuant to Section 103(k) (2) (A) (i) of the Code; NOW, THEREFORE, the City Council of the City of Ukiah does resolve as follows: Section 1. Each of the foregoing recitals is correct and is certified to be a representation of the City Council. Section 2 . The City Council hereby approves the issuance of the Bonds to finance costs of the Project. It is the purpose and intent of this City Council that this Resolution constitute the approval of the Bonds by the appropriate applicable elected representative in accordance with Section 103 (k) (2 ) (A) (i ) of the Code. Section 3 .
