HomeMy WebLinkAbout84-09 RESOLUTION NO. 84-9 RESOLUTION OF THE CITY OF UKIAH - GRANTING VARIANCE APPLICANTION NO. 83-95 , MADDEN, CLARA AVENUE, ENCROACHMENT IN REAR YARD SETBACK AND FINDINGS IN SUPPORT THEREOF WHEREAS, H.A. Madden made timely application for a variance under City Code sections 9231 and 9232, from the rear yard set back requirements of City Code section 9100 (b) on his lot located at 200 Clara Avenue, and WHEREAS, the City Council has found after the legally required public notice and hearing based on the evidence presented that: a. practical difficulties, unnecessary hardships and results inconsistent with the general practice of Division 9, Chapter 2 of the City Code would be imposed upon the applicant if the application were denied; b. granting the variance will not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated; C. because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of this chapter will deprive the subject under identical zone classifications, and d. the granting of such application will not, under the circumstances of this particular case, materially or adversely affect the health or safety of persons residing or working in the neighborhood, be materially detrimental to the public welfare or injourious to property or improvements in the neighborhood. NOW, THEREFORE, IT IS HEREBY RESOLVED that the variance application No. 83-95 shall be and the same is hereby granted. PASSED AND ADOPTED this 3rd day of August, 1982 by the following roll call vote: AYES: Councilmembers Hickey, Myers NOES: Councilmembers Dickens, Kelley ABSENT: Councilmember Feibusch MAYOR ATTEST: CITY CLERK
