HomeMy WebLinkAbout84-05 RESOLUTION NO. 84-5 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH 1 AUTHORIZING THE MAYOR TO SIGN AMENDMENT NO. 2 TO GRANT AGREEMENT FOR ADAP PROJECT NO. 5-06-0268-023 j 2 (UKIAH MUNICIPAL AIRPORT CLEAR ZONE ACQUISITION) 3 4 The City Council of the City of Ukiah hereby RESOLVES: 5 That the City of Ukiah shall accept Amendment No. 2 to the grant i 6 agreement for ADAP Project No. 5-06-0268-02 with the United States of 7 America increasing the total participation from $170,101 .00 to $173,512.80; 8 and 9 That the Mayor of the City of Ukiah is hereby authorized and directed 10 to sign the Statement of Acceptance of said Amendment No. 2 on behalf of the 11 City of Ukiah, and the City Clerk is hereby authorized and directed 12 to attest the signature of the Mayor and to impress the official seal of the 13 City of Ukiah on the aforesaid Statement of Acceptance; and i 14 A true copy of Amendment No. 2 referred to herein is attached hereto 15 and made a part hereof. 16 PASSED AND ADOPTED this 3rd day of August 1983, by the 17 following roll call vote: i 18 AYES: Councilmembers Feibusch, Dickens , Hickey, Myers, Kelley 19 NOES: None 20 ABSENT: None 21 2` Mayor 23 ATTEST: 24 i 25 26 City Clerk j 27 28 i f I t URIGINAL Page 1 of 2 pages UNITED STATES OF AMERICA FEDERAL AVIATION ADMINISTRATION Contract No. DOT FA77WE-3939 Ukiah Municipal Airport Ukiah, California AMENDMENT NO. 2 TO GRANT AGREEMENT FOR ADAP PROJECT NO. 5-06-0268-02 WHEREAS, the Federal Aviation Administration (hereinafter referred to as the "FAA") , acting for and on behalf of the United States, and the City of Ukiah, California, (hereinafter referred to as the "Sponsor") , on July 20, 1977, entered into a Grant Agreement related to the above numbered project, and WHEREAS, Amendment No. 1 extended Condition 22 which requires the Sponsor to acquire a satisfactory property interest in the clear zones for Runway 15/33 from three (3) years to six (6) years. WHEREAS, the cost for the project has increased and it has been determined necessary and desirable to amend the Grant Agreement to reflect a further increase in the maximum obligation subject to the 10% limitation of Section 19 of the Act. NOW THEREFORE, WITNESSETH: That in consideration of the benefits to accrue to the parties hereto, the FAA, on behalf of the United States on the one part, and the Sponsor, on the other part, do hereby mutually agree as follows: 1. The maximum amount of the obligation of the United States as set forth in paragraph 1 of the terms and conditions of the Grant Agreement between the United States and the Sponsor, accepted by said Sponsor on the 20th day of July 1977, relating to Ukiah Municipal Airport, ADAP Project No. 5-06-0268-02 is hereby revised to read as follows: "1. The maximum obligation of the United States payable under the Offer shall be: (a) $40,500.00 and is hereby decreased by $27,769.00 to $12, 731.00 for the cost to the Sponsor of providing payments and assistance for displaced persons under subparagraph (a) of the foregoing paragraph. (b) $129,510.00 and is hereby increased by $31,271.80 to $160,781.80 for all other allowable project costs."
