HomeMy WebLinkAbout85-68 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 85-68 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH ORDERING THE NORTH FIRE STATION - OLD TREATMENT PLANT REORGANIZATION (ANNEXATION) WHEREAS, the Mendocino County Local Agency Formation Commission on April 1, 1985 approved the "North Fire Station-Old Treatment Plant Reorganization" by Resolution No. 85-4, and WHEREAS, said Commission designated the City of Ukiah City Council to be the conducting authority for subsequent proceedings, and WHEREAS, the proceedings were authorized to be held without notice, hearing or election pursuant to Government Code Section 56439 et seq., and WHEREAS, the subject properties, North Fire Station (Assessor Parcel Number 170-050-13) and Old Treatment Plant (Assessor Parcel Numbers 180-010-08 and 10) were prezoned from Mendocino County "C-3:SP" and "A-i" respectively to City of Ukiah "PF" by Ordinance No. 758, effective December 21, 1984, and WHEREAS, the properties are owned by the City and "uninhabited", and WHEREAS, the conducting authority is to act upon the subject reorga- nization (annexation) within 30 days of the Commissions action, and WHEREAS, pursuant to the California Environmental Quality Act (CEQA) Guidelines (Section 15319) annexation of existing facilities is categorically exempt from environmental evaluation, Categorical Exemption Class 19. NOW, THEREFORE, IT IS HEREBY RESOLVED that the North Fire Station-Old Treatment Plan Reorganization as depicted on attached Exhibits A (map) and B (legal descriptions) is ordered, with subject properties annexed to the City of Ukiah and detached from the Ukiah Valley Fire Protection District. BE IT FURTHER RESOLVED that the City Clerk pursuant to Government Code - 1 - November 27, 1984 NORTH FIRE STATION REORGANIZATION DESCRIPTION Beginning at the point of intersection of the Easterly line of U.S. Highway 101 with the Northerly line of that tract of land, Mayfield to the City of Ukiah, as recorded June 29, 1977 in Official Records of Mendocino County in Book 1096, Page 167; thence leaving said point of beginning along the Northerly line of said tract, S 76°08'14'' E 257.50 feet to the intersection of the Northerly line of said tract with the Westerly line of State Street; thence leaving the Northerly line of said tract along the Westerly line of State Street with the following courses; thence curving to the left with a radius of 1,547 feet, from a tangent which bears S 11°00'15'' W, through an arc of 05~36'06'', for a distance of 151.24 feet; thence S 13~51'46'' W 8.65 feet to the intersection of the Westerly line of State Street with the Southerly line of said tract; thence leaving the Westerly line of State Street along the Southerly line of said tract, S 79~56'46'' W 211.07 feet to the intersection of the Southerly line of said tract with the Easterly line of U.S. Highway 101; thence leaving the Southerly line of said tract along the Easterly line of U.S. Highway 101 with the follow- ing courses; thence curving to the~ right with a radius of 1,385 feet, from a tangent which bears N 10~16'59'' W, through an arc of 09°26'12'', for a distance of 228.11 feet; thence N 06°49'08'' E 30.00 feet to the point of beginning and containing 1 acre of land more or less. NOvember 30, 1984 OLD TREATMENT PLANT REORGANIZATION DESCRIPTION Being a portion of Lot 30, Yokayo Rancho as shown on Healey's Survey and Map of Yokayo Rancho filed in the office of the County Recorder of Mendocino County and more particularly described as follows: Beginning at a point on the Northerly line of Lot 30 of Healey's Survey and Map of Yokayo Rancho, from which point the Northeasterly corner of that tract of land conveyed by W.K. Dillingham to Louise Stedham, recorded September 2, 1893 in Book 62 of Deeds, Page 7, Mendocino County Records, bears S 81°15'00'' W 5.98 chains (394.68 feet) distant; thence leaving the point of beginning S 09°00'00'' E 10.06 chains (663.96 feet) to a point on the Northerly line of the lands formerly owned by Robert McKindley; thence N 81~15'00'' E 4 chains (264.00 feet); thence S 05~15'00'' W 3.67 chains (242.22 feet); thence S 32~15'00' W 3.05 chains (201.30 feet); thence S 42~00'00'' W 2.74 chains (180.84) feet); thence S 50°30'00'' W 77 links (50.82 feet); thence S 12~45'00'' W 2.70 chains (178.20 feet); thence S 65~25'00'' E 14.10 chains (930.60 feet) more or less, to a point in the center of the channel of the Russian River, said center of channel also being the Easterly line of said Lot 30 of Healey's Survey and Map of Yokayo Rancho; thence Northerly up the center of said channel and along said Easterly line of Lot 30 to the Northeasterly corner of said Lot 30; thence S 18~15'00'' W 16.40 chains (1,082.40 feet) more or less along the Northerly line of said Lot 30 to the point of beginning and containing 39 acres of land more or less. Ail according to that certain Decree Quieting Title, No. 18731, Dept. No. 2, Superior Court of the State of California in and for the County of Mendocino, as filed in the Mendocino County Clerk's Office in Judgments Book 28, Page 293, entered June 15, 1954. Said Decree is also of record in Book 372 of Mendocino County Official Records at Page 557 et seq, filed June 16, 1954.
