HomeMy WebLinkAbout85-04 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 85-4 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH APPROVING USE PERMIT NO. 84-71, UKIAH GREEN WHEREAS, the 2.8 acres encompassed by Ukiah Green/South is zoned PD, Planned Development, and WHEREAS, the PD, Planned Development zone requires a use permit to be reviewed and approved by the Planning Commission and the City Council prior to development taking place within that zone, and WHEREAS, on June 27, 1984 the Planning Commission approved Use Permit No. 84-71 with 20 conditions, and WHEREAS, a Negative Declaration for the project was approved by the Planning Commission on June 27, 1984, and by the City Council on July 18, 1984. NOW THEREFORE BE IT RESOLVED that Use Permit No. 84-71 is approved subject to the following conditions: 1. Water and sewer improvement plan to be approved by the City Engineer and include mains in the new street section through the project. 2. Five foot public utility easement in back of sidewalk be continued on Mulberry Street. 3. On-site fire hydrant Rich #76 or equal to be provided. 4. Sound attenuation measures be taken to insure noise levels do not exceed the maximum allowable levels to the approval of the Building Inspector. 5. Dedication of a 50 ft. public right-of-way to provide access and utilities to the southern property line. Said right-of-way be constructed by developer to City standards for a 50' street including curb, gutter, sidewalk, paving, street lights and drainage. --1-- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 6. Process parcel map to eliminate property line through development. 7. Existing sewer laterals that are not used should be abandoned by the City at the developer's expense. A drainage easement be dedicated to the City for the area outside the development. Drainage shall be taken through storm drains or in pipes under sidewalk to face of curb. It will be necessary to convey drainage from property to the west through the development and into the drain system on Mulberry. 9. On-site paving to be a minimum 2" of asphaltic concrete of a 6" aggregate base. 10. Undergrounding of utilities required at developer's expense, including necessary street lights along street frontages. 11. Capital Improvement fees as set forth by the Director of PUblic Works be paid by the Applicant. 12. Trash collection facilities be aesthetically screened from view. 13. Any roof mounted air conditioning apparatus be aesthetically screened from view. 14. Ail landscaping be irrigated by an automated irrigation system and maintained in a neat, weed-free manner. A landscaping plan be approved by the Director of Planning prior to placement. 15. Standard Conditions 1-9. 16. Improvement plans shall be prepared by a Civil Engineer at the developer's expense and approved by the Director of Public Works. 17. Directional address sign be located at the Mulberry St. access. 18. Ail setbacks shall be as depicted on the approved site plan. 19. Ail improvements and conditions of approval be completed prior to use and occupancy. --2-- 8, 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 20. The Director of Planning is requested to work with the developer regarding the feasibility of fencing in the lot in conjunction with an opinion from the City Attorney in that it will be to the discretion of the Planning Director to have that as a condition if it is found to be necessary and feasible.
