RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UKIAH APPROVING AN AMENDMENT
TO THE UKIAH GENERAL PLAN LAND USE MAP FOR 350 NORTH ORCHARD AVE. APN 002-
370-270
WHEREAS, the City adopted its current General Plan, including the land use map in December of
1995; and
WHEREAS, Dan Thomas (owner) has applied for a General Plan Map Amendment to change the land
use designation on APN 002-370-270 350 N Orchard Avenue. from High Density Residential (HDR) to
Commercial (C) to facilitate a more appropriate land use designation given and surrounding uses; and
WHEREAS, the proposed amendment is deemed to be in the public interest because it could facilitate
infill development in proximity to established neighborhoods, foster economic development, and reduce
needless vehicle trips as called for in the Ukiah General Plan; and
WHEREAS, the proposed amendment is consistent and compatible with the other goals and policies of
the General Plan, particularly the Economic Development which identifies support for the local
economy as a strong need in the community; and
WHEREAS, the potential impacts of the proposed amendment have been assessed and have been
determined not to be detrimental to the public health, safety, and general welfare because after
mitigation it would not create impacts to the neighborhood, nor would it be out of character in terms of
use because other commercial developments are in the area, and the future design would be similar to
the adjacent commercial uses; and
WHEREAS, the proposed amendment has been processed in accordance with the applicable
provisions of the California Government Code and the California Environmental Quality Act (CEQA).
An Initial Study was prepared and demonstrated that there is no substantial evidence that supports a
fair argument that the project, as mitigated, would have a significant effect on the environment. The
Initial Study and the Notice of Intent to Adopt a Mitigated Negative Declaration were publically noticed
as required. The amendment has been processed as required by the California Government, including
the requirement to provide public notice of the project and public hearing.
WHEREAS, the Planning Commission held a duly noticed Public Hearing on January 11, 2017, to
consider the General Plan Amendment and after receiving testimony, considering the staff report, and
due deliberation; the Planning Commission formulated a recommendation to the City Council to adopt
the Resolution amending the General Plan.
NOW THEREFORE BE IT RESOLVED that the City Council hereby approves the Mitigated Negative
Declaration and General Plan Map Amendment to change the land use designation on APN 002-370-
270 from Commercial High Density Residential (HDR), to Commercial (Cl).
